Dear Mesdames:
The purpose of this letter is to request modification and renewal [reverification] of the United States Army
Corps of Engineers (USACE) Section 404 Nationwide Permit 14 and associated North Carolina Division
of Water Resources (NCDWR) Section 401 Water Quality Certification under a Regional General Permit
50 for the above referenced project.
Revisions resulting in changes to permitted impacts proposed include an additional 30 linear feet of stream
bank stabilization (Permit Site 1A) under the old and new bridge location to protect the waters edge and
immediate bank areas.
Previously permitted stream impacts included 12 linear feet of stream bank stabilization at the outlet of a
new ditch, and 0.12 acre of temporary stream impacts from causeways needed for removal of the existing
bridge and construction of the new one. There are no wetland impacts.
The revised stream impacts for the project total 42 linear feet of stream bank stabilization 0.12 acre of
temporary stream impacts.

This is a new site resulting in an additional 30 linear feet of bank stabilization along the Mitchell River.
Stabilizing the banks under the old and new bridge locations will protect the waters edge and immediate
bank area. The river appears to have migrated closer to the west/end bent one side, so additional protection
will be helpful, and given the sandy nature of the soils, it will be difficult to pull out the concrete slope
protection on the east/end bent one side and regrade the banks with just coir fiber as the stabilization.
Rip rap will only be placed on the waters edge and up a few feet to the top of bank on the west/end bent
one side, and up the slope along the east/end bent two side to or near the bench for the proposed
greenway. Therefore, including the greenway bench, there will still be a wide, rock -free bench on both
sides for wildlife usage.
A good portion of the banks in this location are already hardened with concrete, so the only new impacts to
the stream would be 30 linear feet of bank stabilization. See the attached drawing showing the impact
location. This would not be a loss of water and no mitigation for this impact will be required.
No changes have occurred to special commitments for this project. Tribal coordination was completed
prior to issuance of the original permits.
Section 7 is up to date. As of January 13, 2023 IPaC lists four protected species within the project area:
gray bat, northern long-eared bat (NLEB), bog turtle, and Schweinitz's sunflower. Tricolored bat is listed
as a proposed species. Tree clearing has already occurred for this project. If any other tree needs to be
removed in order to demolish the existing bridge, it will be done outside of active bat season. No habitat is
present for the gray bat or bog turtle. While NLEB does show up in IPaC within the project area, this

project is outside the local range used by the USFWS Asheville Regulatory Field office (AFO), and
therefore No Effect. Habitat does exist for Schweinitz's sunflower, but surveys performed on September
19, 2018, October 5, 2020, and September 23, 2022 did not identify any individuals of this species. The
biological conclusion for this species remains No Effect.
NCDOT requests to modify and renew/reissue the permit for this project under RGP 50. Application is
hereby made for modification and of the USACE 404 permit and the 401 WQC from NCDWR. We have
provided a method of debiting $570.00 to be submitted to the NCDWR for processing the WQC
modification and renewal for BR-0048, as noted in the subject line of this application.

be sloped to 1.5:1 or flatter and keyed in (no geotextile). See detail F.

The North Carolina Department of Transportation (NCDOT) proposes to replace bridge number 103 on NC
268 with a new bridge just north of the existing alignment. Traffic will utilize the existing bridge during
construction.
As a result of replacing the existing bridge, there will be 12 linear feet of stream bank stabilization at the
outlet of a new ditch, and 0.12 acre of temporary stream impacts from causeways needed for removal of
the existing bridge and construction of the new one.
Please see enclosed copies of the Pre -Construction Notification (PCN), bat memo, Catawba response letter,
Stormwater Management Plan, and Permit Drawings. A Minimum Criteria Determination Checklist
(MCDC) was completed in May 2019 and distributed shortly thereafter. Additional copies are available
upon request.
This project calls for a letting date of June 15, 2021 and a review date of April 27, 2021.

This project is the replacement of NCDOT Structure Bridge #850103. The existing bridge length is 210 feet (1 @ 70', 1 @ 70', and 1 @ 70' RC Deck on 1-beams) while the proposed
bridge will be 215 feet (1 @ 55', 1 @ 105', and 1 @ 55' 63" MBT). The new bridge will be placed immediately north of the existing structure and traffic maintained on the existing bridge
during construction. Standard road building equipment such as trucks, dozers, and cranes will be used.

The epsting bridge has 12" HDPE funnel drains on both ends of the bridge. The proposed bridge will have deck drains on the right side that are
outside top of banks and not over the water. The roadway runoff will be discharged on to riprap pads located as far away from the river as practicable.
A shoulder berm gutter will be placed at the beginning and end of the bridge on the right side to help guide the road runoff to the two GIs.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:*
Temporary causeways will be used to remove epsting abutments and set proposed interior girders. Only one workpad will be placed at a time to
maintain 50 % of the river width. Traffic will be maintained on the epsting bridge during construction. NCDOT will adhere to Best Management Practices
for Construction and Maintenance Activities.

As of 7/17/20, the USFWS lists five protected species for Surry County. See attached memo for gray bat and NLEB info. Habitat is present for
Schweinitts sunflower. Walking visual surveys of all areas of habitat were conducted by NCDOT biologists and no individuals of this species were
identified, therefore this project will have no effect on Schweinitz!s sunflower.
No habitat is present for the bog turtle, and small whorled pogonia is listed as historical for Surry County, therefore surveys are not required.

This project is the replacement of the NCDOT Structure Bridge #850103. The existing bridge length is 210 feet (1 @ 70', 1 @ 70', and 1 @ 70' RC Deck on I -Beams) while the

SUBJECT: Section 7 survey results for the northern long-eared bat (Myotis
septentrionalis) and gray bat (Myotis grisescens) associated with the
replacement of Bridge No. 103 over the Mitchell River on NC 268 in Surry
County, TIP No. 1311-0048.
The North Carolina Department of Transportation (NCDOT, Division 11) proposes to replace
Bridge No. 103 over the Mitchell River on NC 268 in Surry County, TIP No. BR-0048. The
existing bridge is a three span structure with steel beams, concrete deck, end walls and guard
rails. The overall length of the structure is 210 feet.
Northern long-eared bat
The project to replace Bridge No. 103 has been reviewed for effects on the northern long-
eared bat (NLEB). As of May 4, 2015, NLEB is listed by the U.S. Fish and Wildlife Service
(USFWS) as "Threatened" under the Endangered Species Act of 1973. As of July 30, 2020,
NLEB is listed by USFWS(http://www.fws.gov/raleigh/specieslcntylist/nc counties.html)
as "probable/potential" in Surry County.
According to the North Carolina Natural Heritage Program (NHP) Biotics Database, most
recently updated April 2020, the nearest NLEB hibernacula record is 59 miles southwest
of the project and no known NLEB roost trees occur within 150 feet of the project area.

NCDOT has also reviewed the USFWS Asheville Field office website
(http://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html) for consistency
with NHP records. This project is located entirely outside of the red highlighted areas (12-
digit HUC) that the USFWS Asheville Field Office has determined to be representative of an
area that may require consultation. The closest 12 digit (030501010502) red HUC is
approximately 57 miles away (Upper Wilson Creek).
On May 30, 2018, NCDOT biologists assessed Bridge No. 103 for potential northern long-
eared bat habitat. No crevices suitable for roosting were present on the structure. No
evidence (bats, staining, and guano) of bats was observed. Snags and shaggy barked trees
greater than 3" dbh are present within the project area. Based on the presence of suitable
roost trees, NCDOT recommends a Biological Conclusion of May Affect Not Likely To
Adversely Affect for the northern long-eared bat. To minimize impacts to potential roosting
habitat, a tree clearing moratorium may be required between April 15 and August 15 of any
year.
Gray bat
The project to replace Bridge No. 103 has also been reviewed for effects on the gray bat
(MYGR). As of April 28, 1976, the gray bat was listed by the U.S. Fish and Wildlife Service
(USFWS) as "Endangered" under the Endangered Species Act of 1973. According to the
USFWS Surry County webpage (accessed July 30, 2020),
(http://www.fws.gov/raleigh/species/cntylist/nc counties.html), the gray bat is listed by
USFWS as "current" in Surry County.
According to the North Carolina Natural Heritage Program (NHP) Biotics Database, most
recently updated in April 2020, MYGR have not been documented in Surry County. NHP data
indicate that the closest known occurrence of MYGR is approximately 91 miles west of
the project site. In September 2019, a gray bat was found roosting in a bridge in Surry
County 10 miles north of the project (personal correspondence). As of this writing, the Surry
County occurrence is not yet reflected in the NHP Biotics Database.
On May 30, 2018, NCDOT biologists assessed bridge No. 103 for potential bat habitat. No
crevices suitable for roosting were present on the structure. No evidence (bats, staining, and
guano) of bats was observed. No caves or mines are located within the project footprint or
within line of sight of the bridge. Based on the lack of evidence of bats, and the lack of caves
or mines in the project vicinity NCDOT recommends a Biological Conclusion of NO EFFECT
for gray bats.
Final design, tree clearing, and percussive activities information will be provided in the
permit application.
