REQUEST FOR MORE INFORMATION
Dear Mr. Eager:
On October 28, 2006, the Division of Water Quality (DWQ) received your application to
impact an 125 linear feet of waters of the state for the development of the South
Barnabas Development. The DWQ has determined that that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application, as proposed, to
impact protected wetlands and/or streams on the subject property. Therefore, unless
we receive the additional information requested below, we will have to move toward
denial of your application, as submitted, as required by 15A NCAC 2H .0506 and will
place this project on hold as incomplete until we receive this additional information.
Additional Information Requested:
1. Project Information
Under Section III of your application you did not provide the requested information
in the Item Instructions, or provided information which lacks detail /resolution /
legibility as to make the information reviewable. You must provide the following:
• A vicinity map clearly showing the location of the property with respect to
local landmarks such as towns, rivers, and roads.
• A detailed site plan showing property boundaries and development plans in
relation to surrounding properties. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included.
• A copy of recorded deed restrictions must be included for each lot and
shall indicate areas of disturbance allowed.

• Plans must provide legible detail. Most of the submitted information is
illegible.
• Correct buffers must be included on the submitted site plans. The attached
plans indicate a 25' trout buffer. Section III. 10. states that a 100' buffer
shall be maintained.
• Additionally, supplied recorded deed restrictions for each lot shall be
submitted referencing the 100' no-disturbance buffers.
• Maps and plans should include the appropriate USGS Topographic Quad
Map and NRCS Soil Survey with the property boundaries outlined for the
total project and for each lot.
2. Impacts
Application Item VI. 4. requests a list of impacts. You have listed 5 25' culvert
crossings. The submitted plans indicate 20' culvert crossings. The provided
details show grip-rap dissipator, but lack sufficient details to indicate that the
crossings will not exceed 25 linear feet of impact, each.
3. Impact Justification (Avoidance and Minimization)
Your submitted avoidance and minimization discussion indicates that bridges are
cost prohibitive, but have provided no such justification to support this claim.
4. Environmental Documentation
Application Item IX. Indicates that public monies shall be utilized for this
development, but have provided no discussion as to why the SEPA process is not
applicable.
5. stormwater
Application Item XI does not provide a discussion as to how stormwater from this
project will be managed for the life of the project (including home construction,
stormwater collected from homes, roadways, driveways, etc...).
6. Signatory Authority
The Signatory Authority page is not signed in accordance with 15A NCAC 02H
.0502 (f).

This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested
within your application are not authorized (at this time) by the DWQ. Please call Mr.
