Dear Mr. Lyczkowski:
On October 4, 2022, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification from the Division for the subject project. The
Division has determined that your application is incomplete and cannot be processed. The
application is on -hold until all of the following information is received:
1. Please provide an Agent Authorization letter for Timmons Group.
2. Please provide a Sediment and Erosion Control Plan for the development.
3. Please provide a stormwater management plan for the development. How were the
proposed stormwater control measures sized?
4. Please provide greater detail on the avoidance and minimization measures taken. What
alternative designs were considered? [15A NCAC 02H .0506(b)(1)]
5. Please describe the construction best management practices that will be used to avoid
wetland impacts.
6. Will utilities be co -located with the roads or will there be additional wetland impacts
from utilities?
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by submitting all of the above requested information
