Request for a Major Variance from the Jordan Lake Riparian Area Protection Rule by Toll NC II, LP
for the Pines at Wake Crossing at O Parlier Drive, Apex NC (Action Item) (Sue Homewood)
A request has been received for the Water Quality Committee to grant a Major Variance from the
Jordan Lake Riparian Area Protection Rule to Toll NC II, LP for the excavation of 14,110 square feet
buffer within the Pines at Wake Crossing Residential Subdivision to resolve a violation of FEMA
regulations. The Town of Apex has been designated authority to administer the Jordan Lake Riparian
Area Protection Rule. The Town of Apex Board of Adjustments approved a Major Variance from the
Town of Apex Unified Development Ordinance in accordance with the requirements in Section 2.3.8(D)
and have submitted their Findings of Fact and Conclusions of Law for consideration by the Water
Quality Committee of the Environmental Management Commission (Attachments enclosed: Town of
