Box 590 Raleigh,North Carolina 27602 Subject: Modification of Permit No. NCC000001 Neuse River Compliance Association Dear Mr. Donnelly In its 2003 Mid-Year Report, the Neuse River Compliance Association reported the addition of a new co-permittee member for 2004. Accordingly,the Division has modified Appendix A of the Association's NPDES permit to include the new member: Permitted Flow, Transport TN Allocation(Ib/yr) Permit Permittee Facility 1995(MGD) Factor Discharge Estuary NC0064564 Heater Utilities,Inc. Neuse Colony WWTP 0.75 50% 8,448 4,224 With this addition,the Association's Estuary TN Allocation for 2004 is increased to 1,073,115 lb/yr. We are enclosing a new permit cover sheet and the modified Appendix A for your records.We will contact Heater Utilities separately regarding its individual NPDES permit for the Neuse Colony facility. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. If any parts,measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty(30)days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings(6714 Mail Service Center, Raleigh,North Carolina 27699-6714).
