Request for Extension on Reporting New Member .
Dear Mr.Klimek:
The Neuse River Compliance Association(NRCA)holds group permit NCC000001 for Total
Nitrogen,which was issued in December,2002. The permit requires the NRCA to notify the
Division.of any changes in the Association's membership in conjunction with the Midyear Report
that is to be submitted by August 31. New members would then be added to the permit beginning
in the next calendar year.
The Association has been involved in lengthy negotiations with USMC Cherry Point Air Station
regarding their potential membership. Cherry Point officially requested membership in the
NRCA just prior to the Association's internal deadline of July 1. The membership considered
this request at their meeting on July 22, 2004 and several issues were left unresolved. While the
Association's attorney and representation from Cherry Point have been in constant
communication,the details of an agreement have just been finalized and can now go back to the
Association's board for a final vote.
As this cannot be accomplished by the August 31'deadline,we would respectfully request an
extension of 30 days to resolve this issue. While we do not know how the membership will vote
on this issue,we are confident that a final decision will be reached at our meeting scheduled for
Sept. 23, 2004 in Apex,NC. If the extension is granted,we will notify the Division of the
outcome at the conclusion of the meeting.
In the mean time,we have accepted one new member,Invista, Inc.(formerly DuPont,Kinston
Plant.) They have been included,as required,in the Midyear Report. This report has been
submitted,in its entirety,with the exception of the pending membership of Cherry Point.
