Dear Mr. Phthisic:
In its 2004 Mid-Year Report and further correspondence,the Neuse River Compliance Association
requested modification of its NPDES permit to incorporate the following changes for calendar year
2005:
• acceptance of the Unifi-Kinston as a co-permittee member,
• acceptance of the US MCAS Cherry Point as a co-permittee member,and
• adjustment of the NC DHHS allocation for its Town of Butner's John Umstead WWTP to reflect
its purchase of allocation from the Bay River Metropolitan Sewerage District.
The Division issued the modified permit on December 30,2004.Subsequently,the Neuse River
Foundation and the City of Raleigh challenged the increase in DHHS's allocation.By its letter of
March 31,2005,the Association requested a"correction" in Appendix A of the permit to address the
issue.
We have since entered into negotiations with the petitioners,the NRCA,the DHHS,and Granville
County/ South Granville Water and Sewer Authority(prospective owners of the Butner wastewater
utilities).There has been considerable discussion among all parties in an effort to resolve the issue of
local water quality impacts in Falls Lake that could result from an increase in DHHS's allocation.
After further consideration of these matters,the Division hereby rescinds the December 30,2004
permit modification and is issuing a newly modified Appendix A.The modification still adds the
two facilities as Co-Permittee Members of the Association;however,it does not include DHHS's
added allocation.This course of action is consistent with Secretary Odom's withdrawal of DHHS's
request for a facility expansion. And it is consistent with program changes we discussed in our
recent mediation conference,in which it was proposed that a change in a discharger's allocation
must be incorporated into its individual NPDES permit before it is added to the Association's group
permit.
We are enclosing the modified pages of the permit(cover sheet and Appendix A)for your records.
Please add these to your current permit and remove the corresponding pages,which are now void.

All other terms and conditions contained in the original permit remain unchanged and in full effect.
This permit modification is issued under the requirements of North Carolina General Statutes 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental
Protection Agency.
If any parts,measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you,you have the right to an adjudicatory hearing upon written
request within thirty(30)days following receipt of this letter. This request must be a written
petition conforming to Chapter 150B of the North Carolina General Statutes,filed with the Office of
Administrative Hearings(6714 Mail Service Center,Raleigh,North Carolina 27699-6714). Unless
such demand is made,this decision shall be final and binding.
