Subject: Stormwater Management Guidance
Dear Mr. Lane:
I represent Fayetteville Technical Community College. The College has built its Fire and Rescue Training Center on
approximately 15 acres of land in Cumberland County. The College is asked to complete an "As -Built Permittee
Certification" including the certifications required under 15A NCAC 02H.1042(4). One of the certifications asks whether
appropriate deed restrictions have been added to the deed to ensure, among other things, the stormwater retention
pond will be maintained. 15A NCAC 02H.1003(7) provides an option for public entities to "incorporate specific
restrictions and conditions into a facility management plan or other instrument in lieu of deed restrictions and
protective covenants."
Could you please provide guidance as to:
1. What specific restrictions are required in the deed; and,
2. If, as a public entity, the College choses to incorporate restrictions into a "facility management plan," what
requirements must the "facility management plan" meet to be acceptable to DEQ?
I appreciate any guidance you can offer or would appreciate you providing me contact information for a subject matter
expert in the area.
