Ross,Jr.,Secretary r- Department of Environment and Natural Resources 0 .0 Alan W.Klimek,P.E.,Director Division of Water Quality December 29,2005 Mr. Haywood Phthisic III,President The Neuse River Compliance Association PO Box 2263 Smithfield,North Carolina 27577 Subject: Modification of Permit No. NCC000001 Neuse River Compliance Association Dear Mr.Phthisic: The Division has received the Association's 2005 Mid-Year Report and your letter of December 27 requesting modification of the group's NPDES permit to incorporate the following changes for calendar year 2006: • transfer of Wake Forest's Smith Creek WWTP,NC0030759,and its nitrogen allocation to the City of Raleigh,and • transfer of allocation from the Jones Dairy Farm WWTP,NC0064149,to the Smith Creek WWTP as the result of Jones'connection to the Smith Creek system. The Division has modified Appendix A of the Association's NPDES permit to reflect the Smith Creek transfer,as requested. We must defer action on the second item,as explained below. This modification does not affect the Association's Estuary TN Allocation,which remains at 1,137,1711b/yr. We are enclosing the modified pages of the permit(cover sheet and Appendix A) for your records. Please add these to your current permit and remove the corresponding pages,which are now void. In last summer's negotiations regarding the 2005 modification,the Association, the plaintiffs,and the Division agreed to certain changes in the permitting process in order to address concerns that nutrient trades could cause localized impacts on water quality. The agreed-upon approach ensures that the public has the opportunity to comment on new nitrogen limits before they become effective; and it preserves our ability to update Appendix A by minor modification. Transfers of nitrogen allocation must now be incorporated first into a member's individual permit limits before they can be reflected in Appendix A of the group permit. The Division received Raleigh's request to modify the Smith Creek nitrogen limit on December 22. While we support the request and are preparing the draft permit for public review,the modification will not be in place in time to be included in Appendix A for CY2006.However,it could be included for 2007. All other terms and conditions contained in the original permit remain unchanged and in full effect.
