Ross,Jr.,Secretary CO Department of Environment and Natural Resources y Coleen H.Sullins,Director O Y Division of Water Quality November 14,2008 Mr. Haywood Phthisic III,President The Neuse River Compliance Association PO Box 1562 Apex,North Carolina 27602-3562 Subject: Draft NPDES Permit No.NCC000001 Neuse River Compliance Association Dear Mr. Phthisic: The Division of Water Quality has reviewed the Neuse River Compliance Association's application for renewal of its NPDES permit and has considered the group's requests for modification of the roster and allocations list in Appendix A of the permit.The Division has made a tentative determination to re-issue the permit,with changes,and we are enclosing a draft permit and fact sheet for your review and comment. The draft permit includes the following changes: • The body of the permit is identical to the current permit except that reporting dates and the address for the Wetlands Restoration Program have been updated. • Appendix A includes several proposed changes: • Progress Energy Carolinas,Inc., owner of the Lee Steam Electric Plant,is now listed as a co-permittee member of the Association.Appendix A shows an allocation of zero. If Progress's request to lease allocation is approved and the Association provides documentation of the completed lease before the end of this comment period,the Division will include the transfer in the final permit. The leased allocation will then be deducted from the former Burlington Industries allocation.Because the leased allocation comes from within the Association,the transaction will not affect the group's total TN allocation. • The table adds nine new allocations,to credit NRCA members for regionalization of other facilities and elimination of those dischargers: five at New Bern,three at Goldsboro,and one at Raleigh's Neuse River plant. • The table also reflects Kinston's connection of its Peachtree system to its Northside plant and the elimination of the Peachtree discharge point. With these adjustments,the Association's Estuary TN Allocation increases by 17,380 lb/yr,from 1,137,171 to 1,154,5511b/yr,for calendar year 2009. The combined estuary allocation for all affected point source discharges in the Neuse River basin remains at 1,640,000 lb/yr. The permit does not reflect the sales of allocation from UNIFI-Kinston to Johnston County and Clayton,nor the sale from Benson to Johnston County. Although these members have already executed contracts for the transactions,the closure of UNIFI's operations and uncertainty about future operations at the site have delayed action on that permit renewal. The Division,in turn,has delayed actions on the other individual permits so that we could act on the permits as a group and ensure that all of the revised nitrogen limits become effective simultaneously.We are now moving forward with the UNIFI(now DuPont)renewal and expect to send the draft permits out for public review in early 2009. At this time,the Division is submitting a notice to the newspapers of general circulation in the counties of the Neuse River basin,inviting public comment on the draft permit. The notice is scheduled to be published on or about November 15th.Following a 30-day comment period,we will review all pertinent comments received and take appropriate action on the permit renewal. DEFINITIONS (a.) Allocation(or"TN Allocation"): The mass quantity(as of TN)that a discharger or group of dischargers(such as the Association)is allowed to release into surface waters of the Neuse River Basin.TN Allocations may be expressed as Estuary TN Allocation or as the equivalent Discharge TN Allocation. (b.) Association: The Neuse River Compliance Association,a not-for-profit corporation comprised of NPDES-permitted dischargers in the Neuse River Basin;established voluntarily under T15A NCAC 2B .0234 to meet the aggregate Estuary TN Allocation of its members. (c.) Co-Permittee Members: Those NPDES dischargers that for a given calendar year are members of the Association and are listed in Appendix A of this Permit. (d.) Discharge TN Allocation: TN Allocation specified at the point of discharge(or"end-of-pipe"). A Co-Permittee Member's Discharge TN Allocation is equivalent to its Estuary TN Allocation divided by the applicable Transport Factor. (e.) Discharge TN Load: Actual TN Load measured at a Co-Permittee Member's point of discharge (or"end-of-pipe"). (f.) Estuary: The Neuse River estuary,which extends from approximately Streets Ferry to the Pamlico Sound. (g.) Estuary TN Allocation: TN Allocation specified at the estuary. (h.) Estuary TN Load: TN Load determined at the estuary. A Co-Permittee Member's Estuary TN Load is equivalent to its Discharge TN Load multiplied by the applicable Transport Factor. (i.) Load(or"TN Load"): The actual mass quantity(as of TN)that a discharger or group of dischargers releases into surface waters of the Neuse River Basin.TN Loads may be expressed as Discharge TN Load or as the equivalent Estuary TN Load. (j.) Regionalization: The consolidation of wastewater collection and/or treatment systems that results in the elimination of one or more NPDES-permitted discharges. (k.) Total Maximum Daily Load(of TMDL): The allowable load of a pollutant that can be discharged to a water body without causing loss of that water's designated uses.Also,the Phase II of the Total Maximum Daily Load for Total Nitrogen to the Neuse River Estuary,North Carolina,approved by the U.S.Environmental Protection Agency on March 19,2002,and subsequent revisions approved by the EPA. (1.) Total Nitrogen(TN): The sum of the organic,nitrate,nitrite,and ammonia species of nitrogen in a water or wastewater. (m.) Transport Factor: Fraction of the TN in a discharge that is predicted to reach the estuary,as determined by the Division. Part I DRAFT Page 2 of 4 Permit No.NCC000001 A.(2.) CO-PERMITTEES AND TN ALLOCATIONS (a.) Co-Permittees to this Permit shall be the Neuse River Compliance Association(the"Association") and each of its Co-Permittee Members.The Co-Permittee Members,the Transport Factors assigned to each,the Members'individual TN allocations,and the Association Estuary TN Allocation shall be as listed in Appendix A,which is hereby incorporated into this Permit in its entirety. (b.) Upon timely and proper notification by the Association as described elsewhere in this Permit,the Division shall revise Appendix A to incorporate changes in Association membership,allowable changes in TN Allocations,or reapportionment by the Association. (i.) Changes in membership. (A) Enrollment. In the event that a discharger joins the Association,the Division shall add the discharger and its TN Allocation to Appendix A as a Co-Permittee Member and adjust the Association's TN Estuary Allocation accordingly. (B) Termination. In the event that a Co-Permittee Member's membership is terminated, the Division shall delete the departing Member and its TN Allocation from Appendix A and adjust the Association's TN Estuary Allocation accordingly. (ii.) For the purposes of this Permit,allowable changes in TN Allocations include those resulting from purchase of allocation from the Wetlands Restoration Fund;purchase,sale,trade,or lease of allocation among the Association,its members,and non-member dischargers; regionalization;and other transactions approved by the Division. (iii.) The Association may reapportion its TN Allocation among its Co-Permittee Members; however,the Division shall only incorporate the corresponding changes into Appendix A when specifically requested in writing by the Association. (c.) Changes in Association membership and changes in individual or Association TN Allocations shall become effective only at the beginning of the following calendar year(January 1). A.(3.) EFFLUENT LIMITATIONS (a.) Beginning on the effective date of this Permit and lasting no later than the expiration date,the Co- Permittees are authorized to discharge Total Nitrogen(TN)from the treatment facilities listed in Appendix A subject to the following effluent limitations. (i.) Association TN Limitation. In any calendar year,the Association's Estuary TN Load shall not exceed its Estuary TN Allocation as specified in Appendix A: Association TN Limitation: For any calendar year, Association Estuary TN Load < Association Estuary TN Allocation where Association Estuary TN Load(or Allocation) = Sum of Estuary TN Loads(or Allocations) for All Co-Permittee Members (ii.) Co-Permittee Member TN Allocations. In any calendar year,a Co-Permittee Member shall be in compliance with its Estuary TN Allocation in Appendix A if: (A) the Association Estuary TN Load complies with the Association Estuary TN Allocation in Appendix A,or Part I DRAFT Page 3 of 4 Permit No.NCC000001 (B) in the event that the Association Estuary TN Load exceeds its Estuary TN Allocation, the Co-Permittee Member's Estuary TN Load does not exceed that Member's Estuary TN Allocation in Appendix A. (b.) Other Individual Limitations. In the event that a Co-Permittee Member's membership in the Association is terminated,the departing Member shall no longer be eligible for coverage under this Permit and shall become subject to the TN limitation set forth in its individual NPDES permit. (i.) Termination of membership shall become effective only at the beginning of a calendar year (January 1). Re-imposition of a discharger's individual TN limitation shall become effective only at the beginning of a calendar year(January 1). (ii.) The Association shall notify the Division if it determines that any Member will depart at the end of a calendar year and shall provide an accounting of all allowable changes in the Member's TN Allocation since the most recent issuance of the departing Member's individual NPDES permit. (iii.) Upon receipt of the notification and accounting described above,the Division shall modify the TN limitation in the departing Member's individual NPDES permit,effective January 1 of the succeeding year,to reflect all allowable changes in the Member's TN Allocation and shall also modify Appendix A of this permit accordingly. A.(4.) MONITORING REQUIREMENTS (a.) Each Co-Permittee Member shall continue to monitor its discharge(s)and report the results to the Division as specified in its individual NPDES permit. (b.) The Association shall assemble the results of its Co-Permittee Members and report the combined results to the Division as specified in Condition A.(5.),below. A.(5.) REPORTING REQUIREMENTS (a.) The Association shall serve as the primary point of contact between the Division and the Co- Permittee Members on matters related to this Permit,unless otherwise noted.The Association's responsibilities in this regard include: (i.) preparation and submittal of any reports required by this permit or of related information requested by the Division; (ii.) submittal of any request for modification or renewal of this permit;and (iii.) distribution to the Co-Permittee Members of correspondence from the Division,including but not limited to that pertaining to permit issuance,modification,and renewal; compliance;and reporting. (b.) Mid-Year Report. No later than August 31 of each year,the Association shall submit a mid-year report to the Division.The report shall include,at a minimum,the following information: (i.) for the period beginning July 1 of the preceding year and ending June 30 of the current year, a Discharge Monitoring Report,for informational purposes only,of each Co-Permittee Member's Discharge and Estuary TN Loads and the Association's Estuary TN Load. (ii.) notification of any changes in Association membership or TN Allocations to become effective in the following calendar year. (c.) Year-End Report. No later than February 28 of each year,the Association shall submit a year-end report to the Division.The report shall include,at a minimum,the following information for the previous calendar year: Part I DRAFT Page 4 of 4 Permit No.NCC000001 (i.) for the period from January 1 through December 31 of the preceding year,a Discharge Monitoring Report of each Co-Permittee Member's Discharge and Estuary TN Loads and the Association's Estuary TN Load; (ii.) a summary of changes in Association membership,including regionalization of discharges; (iii.) a detailed summary of all purchases,sales,trades,leases,and other transactions affecting the TN Allocations of the Association or its Co-Permittee Members; (iv.) a description of the Association's TN control strategy for the preceding year and changes for the coming year; (v.) a detailed summary of measures taken to control TN discharges; (vi.) an assessment of progress made;and (vii.) a description of efforts planned for the upcoming calendar year(s). (d.) Five-Year Report. No later than July 1,2013,in conjunction with application for renewal of this Permit,the Association shall provide a detailed summary of all membership changes and allowable changes in TN Allocations of the Association or its Co-Permittee Members occurring during the term of this Permit. A.(6.) COMPLIANCE (a.) In the event that the Association exceeds its Estuary TN Allocation in a given calendar year,the Association shall make offset payments for the excess TN for that year at a rate of$11 per pound (15A NCAC 2B.0240)or such other rate as may be adopted by the Commission. Payment shall be made no later than May 1 of the year following the exceedance and shall be submitted to: NCDENR/Ecosystem Enhancement Program Attn: Wetlands Restoration/ In-Lieu Fee Program 1652 Mail Service Center Raleigh,NC 27699-1652 and three copies shall be submitted to: NCDWQ/Point Source Branch Attn: Neuse River Basin Offset Payments 1617 Mail Service Center Raleigh,NC 27699-1617 (b.) For any calendar year in which the Association exceeds its Estuary TN Allocation,the Association shall be in violation of this Permit,and the Division may take appropriate enforcement action against the Association for such exceedance. (c.) For any calendar year in which the Association exceeds its Estuary TN Allocation,any Co- Permittee Member that exceeds its Estuary TN Allocation shall also be in violation of this Permit; and the Division may take appropriate enforcement action against the Member. (d.) Submittal of offset payments shall not limit the Division's authority to enforce the terms and conditions of this Permit,nor shall it relieve the Association or its Co-Permittee Members of their responsibility to comply with any other applicable federal,state,or local law,rule,standard, ordinance,order,judgment,or decree. In determining the amount of any penalty to be assessed against the Association or its Co-Permittee Members,the Division shall credit the Association or its Members for any offset payments submitted by each;provided that the Association includes with the offset payment submittal an accounting of each Member's contribution. (e.) The group made application on June 28,2007,and modified its application on July 25,2007,and October 6,2008. The Division finds the Association's application to be acceptable and has made a tentative determination to re-issue the permit,with changes. The Division will publish a notice of this determination in the principle newspaper for each county in the river basin on or about November 15,2008,and will accept comments on the draft permit for 30 days following publication.After the close of the public comment period,the Division will consider all significant comments and make its final decision regarding this permit action. INTRODUCTION The Neuse River Basin is classified as Nutrient Sensitive Waters(NSW),due to long-term nutrient impacts on the river's estuary from point,nonpoint,and natural sources of pollution. In December 1997, the Environmental Management Commission adopted the Neuse River Basin Nutrient Sensitive Waters (NSW)Management Strategy,a rules package designed to address these nutrient impacts and restore water quality in the basin.The Strategy required that Total Nitrogen(TN)loads to the estuary(1995 baseline)be reduced by 30 percent by the year 2003. The basin has also been listed on the state's 303(d)list of impaired waters because of the nutrient impacts.The Division developed Total Nitrogen TMDLs for the basin,based upon the NSW Management Strategy,and the USEPA approved the TMDLs in 1999(Phase I)and 2002(Phase II).The 2000 303(d)list again includes the basin,now noting that the TMDLs have been approved and are being implemented. One portion of the NSW Management Strategy,the Wastewater Discharge Requirements rule(T15A NCAC 213 .0234),establishes specific nutrient control requirements for the point source dischargers in the basin. • The rule sets forth a system of Total Nitrogen allocations to achieve the stated 30 percent reduction in point source loads to the estuary.Toward this end,it: • sets a wasteload allocation of 1.64 million pounds TN per year(at the estuary)for all point source dischargers in the basin. • further divides this allocation among the existing dischargers. • requires that large facilities(those with permitted flows equal to or greater than 500,000 gallons per day)meet their individual TN allocations,effective in 2003. • prescribes what allocations are required for new and expanding dischargers as well as how they will be handled when permitted facilities consolidate(regionalize)their wastewater discharges. • provides that interested dischargers can form a group compliance association and work together to meet their combined TN allocation. Under this option,the individual dischargers are subject to TN limits in a group compliance NPDES permit in lieu of the TN limits in their individual NPDES permits. FACT SHEET Neuse River Compliance Association DRAFT NPDES PERMIT NPDES No. NCC000001 • The rule also prescribes Total Phosphorus limits for the most significant dischargers in the basin. The subject permit is a group compliance permit as described above.It first became effective January 1, 2003,and is the only such permit to be developed under the Strategy's Wastewater Discharge rule. PERMIT OVERVIEW Co-Permittees The Neuse River Compliance Association("NRCA,"or the"Association")is a not-for-profit corporation established in North Carolina in 2002.The purpose of the Association is to function as a"group compliance association"as provided in the Wastewater Discharge rule. The Association's members include both public and private entities,all of which discharge treated wastewater in the Neuse River basin under existing individual NPDES permits. The Association and each of its members are co-permittees under the group permit.In general,the Association serves as the contact between the Division and its co-permittee members in matters pertaining to this permit. Scope of the Permit The group compliance permit governs the combined discharge of Total Nitrogen from the co-permittees to the estuary.Requirements in this permit supplement those in the co-permittee members'individual NPDES permits but do not replace the requirements in the individual permits except where specifically stated. Each member's individual NPDES permit remains in effect and continues to govern the other parameters of concern for that discharge. PROPOSED EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS The Division developed effluent limitations,monitoring requirements,and special conditions for the original group permit based on the Neuse River Basin Nutrient Management Strategy,the approved TN TMDLs,and extensive deliberations with the USEPA Region 4 and with the affected dischargers.In subsequent years,the Division has modified Appendix A to reflect changes in membership and transfers of allocation to and among the members. The body of the proposed permit is unchanged from the original permit except for an updated address in Condition A.(6.).The draft Appendix A has again been revised to reflect changes in membership and transfers of allocation. Effluent Limitations Group and Individual TN Limitations Appendix A of the permit contains the definitive list of(1)Co-Permittee Members in the Association,(2) discharge and equivalent estuary TN allocations for each member,and(3)the transport factor for each. These values are taken from allocation method in the Wastewater Discharge rule. The appendix also includes the sum total of the member's estuary allocations,which represents the Association Estuary TN Allocation.All TN allocations are expressed in terms of pounds of TN per year and apply to a calendar year period. Changes in Membership or TN Allocations The TN allocations of the co-permittee members can change as the result of purchases,sales,trades, leases,and other transactions.These changes,in turn,affect the Association's TN allocation.Changes in membership also affect the Association's allocation due to the addition or subtraction of the discharger's allocation from the group total. Whenever changes in the allocations or the membership occur,Appendix A of the permit must be modified in order to formally incorporate those changes and adjust the enforceable limits in the permit. The TN allocations and limits are expressed as calendar year values;therefore,any adjustments can become effective only at the beginning of the calendar year(January 1)following the transaction or membership change.The Association will notify the Division each year of proposed changes in Appendix A(see Reporting Requirements,below). As this permit is released for public review,Progress Energy is negotiating a lease of nitrogen allocation from the Association.The Division proposes to include any such lease under this permit if the Association documents that the lease is completed prior to the end of the public comment period.The transfer would then be reflected in Appendix A. Because the leased allocation comes from within the Association,the transaction will not affect the group's total TN allocation. Monitoring Requirements All members of the Association are required under the individual NPDES permits to monitor TN on a regular basis and report the results in their Discharge Monitoring Reports(DMRs).The group compliance permit does not duplicate these monitoring requirements or require additional TN monitoring. Instream monitoring is not required under this permit.However,it is required of the co-permittee members through their individual NPDES permits and,for most,is conducted by the Lower Neuse Basin Association,a coalition of dischargers that,by agreement with the Division,conducts instream monitoring for its members. Reporting Requirements Each member will continue to report its TN monitoring results on its individual DMRs.The Association is not required to duplicate these detailed reports. The Association will submit year-end,mid-year,and 5-year reports on its activities to the Division.The year-end report(due February 28 of each year)will include an accounting of the Association's and its members'TN discharges for the previous calendar year for compliance purposes. It will also include a list of transactions during that period affecting TN allocations,an assessment of progress made,and planned activities for the coming year.The mid-year report(due August 31 of each year)will include an updated accounting of TN discharges for informational purposes. It will also identify any changes in TN allocations or in membership for the following year and will serve as a request to modify Appendix A to incorporate those changes.The 5-year report is intended to ensure that the Division and the Association agree on the group and individual allocations at the end of the permit term. Compliance The Association is required by rule to make offset payments to the Wetlands Restoration Fund for any calendar year in which it exceeds its TN limit. In addition,the Division may take appropriate enforcement action against the Association or its co-permittee members or both in the event that they exceed applicable TN limits in the permit. The Association has not exceeded its TN limit in the first six years of its existence.The group's combined nitrogen reduction has been exemplary,reaching nearly 70% reduction from 1995 baseline levels as compared to the mandated 30% reduction for point source discharges in the basin. Expiration Date The original permit expired December 31,2007.The Division received timely application for renewal and,with the Association's consent,administratively extended the permit and delayed renewal for one year. Shortly after it was formed, it applied for and received,NPDES permit number NCC000001. This permit was issued in compliance with the Neuse River Nutrient Management Strategy, which authorized the group compliance approach,allowing the group to comply with an aggregate limit for Total Nitrogen into the Neuse River Estuary. We are happy to report that the NRCA has been in existence for five years and has cumulatively removed 8,579,433 pounds of Total Nitrogen from the estuary compared to the discharge that was occurring in 1995. The group was given a mandate to reduce their Total Nitrogen discharge by 30%, and in 2006,this group of dischargers had removed 70% of that original loading to the estuary. The NRCA has served as a national model for"compliance associations"and the success that can be achieved when point sources work together. Through this innovative and altruistic approach, our members have collectively spent in excess of$50 million dollars and many of them are now treating well below the limits established as 'Best Available Technology." Though the efforts of our members we have upgraded treatment plants, encouraged optimization of treatment processes,encouraged reuse projects,and we are currently discharging at just under 50%of our permitted limit for Total Nitrogen. The Neuse River Compliance Association and its Co-Permittee Members hereby apply to renew their permit,NCC000001 for another five year period. It should be noted that one new member was added to the group in 2004 (Neuse Colony) and two additional members were added in 2005 (MCAS Cherry Point and Unifi-Kinston, LLC.) We have seen that the commitment, experience and knowledge of our members has helped the group to minimize nitrogen loading,which we hope will further improve water quality in the Neuse River estuary in the future. Enforcement Summary The Association has an internal enforcement policy that requires the individual members to report to the group and to pay an assessment if they violate their individual nitrogen allocation. The group notifies any member who is out of compliance with their individual allocation for a given year, and requires the payment of an assessment and submission of a compliance schedule to insure that the noncompliance is being addressed. The enforcement policy gave the members one year of leniency(2003) before assessments were made. Starting with 2004's data the group notified two members that they had exceeded their allocation for that year. The Town of Kenly and Contentnea MSD(CMSD) were assessed and paid penalties under the group's enforcement strategy. In 2005, these two dischargers paid to lease nitrogen from other members in order to establish their compliance, rather than to face continued enforcement. The group requires regular updates on these member's status and their plans to bring their plants into compliance. The three towns that make up CMSD are working to control infiltration and inflow. This is a slow and expensive task for small towns. They have made major improvements to the collection system, however I&I is still a major priority. The board has been presented with a plan which includes an upgrade and expansion of this facility. A decision should be made in the next 6 months. During 2006, the facility experimented with"Kenaf'to assist in TN reduction. The regional office of DWQ was aware of this test and other facilities have used this product with some degree of success. The facility ran the study for 6 months using this product and determined that it was detrimental to the treatment process and did not accomplish any nitrogen removal. They discontinued the study in August of 2006. The Town of Kenly was asked by the Association to secure the services of a consulting engineering firm to assist them in planning for improvements to their facility. The Association had sent several operators from large facilities to the Town of Kenly in efforts to assist the operator to optimize their treatment process. It appeared that the inability to control the process 24 hours per day, due to a lack of automation and an "around the clock"staff, was limiting their success in meeting the nitrogen allocation. The NRCA formally asked the Town of Kenly for an engineering report in late 2006. The Town presented their engineering report to the Association at their May meeting. The Town is pursuing funding to carry out the necessary improvements to their wastewater process. The Association will continue to monitor their progress in this effort. The Marine Corps Air Station at Cherry Point joined the Association in 2005. The base had problems meeting their nitrogen allocation in the past and wished to lease nitrogen from the Association to allow them to be compliant while they upgraded their plant. The Base has begun construction of the upgrades to their facility and has brought the plant into compliance with the nitrogen allocation, without the use of the leased nitrogen. They accomplished this through staffing changes and by educating their staff in nitrogen removal optimization techniques. The basin covers all or part of 19 counties and has a population of 1.3 million people. (See Figure 1.) The Neuse River Estuary is a shallow estuary that feeds directly into the Albemarle-Pamlico Sound system which is the United States' second largest estuarine complex and a key fisheries nursery for the mid-Atlantic coastal region.' The estuary has experienced major eutrophication issues since the early 1970's. The increased nutrient loading to the estuary has caused major algae blooms and fish kills. The publication of the book"And the Waters Turned to Blood"by Rodney Barker in 1997 brought considerable attention to the plight of the Neuse River Estuary. When initial research indicated that phosphorus was the problem, the State of North Carolina initiated a phosphorus detergent ban in 1987. Problems in the estuary continued and further research pointed the finger at nitrogen as the limiting factor. The management strategy for the Neuse River Estuary included a Total Maximum Daily Load (TMDL)that was adopted in 1999. Studies showed that a reduction of 30%was necessary in the Total Nitrogen loading, with a deadline of 2003. The point source dischargers in the basin were given an allocation of 1,640,000 pounds of Total Nitrogen in order to meet this reduction. There was no allocation reserved for new or expanding facilities. Allocations were given based on the permitted flows that existed in the permits in 1995. This caused a great inequity in the distribution of the Total Nitrogen allocations, Paerl,Hans W.,Lexia M. This group was primarily a basin coalition that conducted comprehensive basin-wide monitoring of the river and it's tributaries in order to comply with their individual NPDES permits. Due to the inequities caused by the distribution of the allocations, the "Neuse Rules"that were developed by the State, allowed for the formation of compliance groups by the major point source dischargers. The concept of the compliance group was to allow a group of dischargers to meet a collective limit, thus allowing them to pursue reduction strategies where the most benefit could be enjoyed at the lowest cost. In 1996, the General Assembly of the State of North Carolina appropriated 2 million dollars for the Lower Neuse Basin Association, to provide grants Page 3 of 16 to dischargers in the basin to help them pursue nitrogen reduction strategies at their plants, or to remove wastewater discharges from the river. From the members of the Lower Neuse Basin Association came an altruistic group of dischargers who became the Neuse River Compliance Association (NRCA). The NRCA is a non-profit, 501 c (3) organization. They worked with the State and were given the first permit issued to a compliance association in the United States in December, 2002. The members of the NRCA and their respective allocations are listed in the excerpt of the Annual Report for 2005 which is included in AppendixA. For clarification purposes, the members of the Lower Neuse Basin Association and the Neuse River Compliance Association are essentially the same,but the State required that a new non-profit be set up to receive the permit. The NPDES permit,NCC000001, applies only to Total Nitrogen and gives the group a collective limit for the number of pounds of TN that can be discharged by the members in a year. Each member has an allocation for TN that is expressed in two ways; 1)pounds of Total Nitrogen at the point of discharge and 2) pounds of Total Nitrogen at the estuary(which is the discharge pounds multiplied by the transport factor.) Under the group permit, if the group complies with the collective TN limit, then all of the members are deemed by the State to be compliant with their TN limit. If the NRCA were to violate its TN limit for the year, the group would be subject to enforcement from the State and the bylaws of the Association would reflect that violation back to,the member(s)who were in noncompliance with their individual allocation. Under the NRCA Bylaws, the fine paid by the group would ultimately be charged back to the offending members. Page 4 of 16 Accomplishments of the NRCA To date the members of the Neuse River Compliance Association have spent in excess of 50 million dollars on nutrient reduction at their plants. The deadline of a 30% reduction by 2003 was met and exceeded by more than three years. The Total Nitrogen loading from the group in 2000 showed a reduction of 46% over the 1995 levels. By the end of 2001, the group had reduced their nitrogen loading by 53%. As of 2005, the reduction reported by the group was up to 68%! It should be noted that in 2005 the group took on two new members, Unifi-Kinston, LLC and the Marine Corps Air Station at Cherry Point. The collective discharge data for the NRCA is shown in Table 2. A comparison of the discharge from the original group of members and with the addition of the two new members in 2005 is reflected in the table. The rules for the Neuse Basin do not allow for point sources to trade with non-point sources at this time. No discussion of point source/non-point source trading is contained in this nomination package. Trading among point sources encourages economic efficiency in meeting the overall nitrogen limit in the Neuse, based on the assumption that dischargers will make trades to benefit both parties while still meeting the required reduction. The NRCA has no authority over trades at this time, other than the fact that the bylaws prohibit the selling of nitrogen to a non-member (nitrogen allocation cannot leave the group). However, members are free to buy nitrogen from non-members (nitrogen may be brought in from non-members.) One of the keys to achieving benefits from trading is that there is a"transport factor" for nitrogen assigned to each discharger. The State established Nutrient Management Zones with associated transport factors to the various sub-basins of the Neuse. (See Figure 2.) The concept of the transport factor is not unique to the NC strategy, but works on the premise that nitrogen gradually diminishes as it travels down the Neuse to the estuary. A discharger located further upstream may discharge more nitrogen without having an adverse effect on the estuary. For example, one pound of nitrogen discharged directly into the estuary is assumed to have the same effect as two pounds discharged in the Raleigh area. It would Page 6 of 16 follow that rather than spending a certain amount to reduce its nitrogen in the Raleigh are, that same amount would be better spent to reduce a discharge directly into the Neuse estuary and would achieve twice the benefit. In exchange, a discharger in the Raleigh area who provides funds to reduce a discharge at the estuary would receive the nitrogen allocation that the discharger in the estuary was no longer discharging. Due to the fact that nitrogen allocation is a scarce commodity in North Carolina and the management strategy did not reserve any allocation for growth in the basin, dischargers are simply not going to sell nitrogen permanently. There have been Page 7 of 16 only two official sales/trades, involving allocation that was purchased from a system that went to land application of the wastewater. The sales have been controversial, have been highlighted by considerable media attention and the State has not allowed the acquired nitrogen to be added to the NRCA permit as of this date. As a complicating factor, the environmental groups that advocate for the Neuse River do not understand the concept of trading and want any and all reductions to be experienced by the river. They put constant pressure on the State to limit trading, even though it is provided for in the rules, and fight to have every pound of nitrogen that is removed from the river to be removed forever. These groups fail to recognize the significant achievements of the NRCA and the extraordinary reductions that have been achieved by these point sources. The 30% reduction that was identified was mandated for non-point sources as well,but there is little or no pressure on the non-point sources to accomplish the required reductions and there is little data to document what reductions have taken place from non-point sources. Due to the limitations that have been discussed previously, the NRCA has had to been extremely innovative in managing nitrogen within the group. The NRCA has specific bylaws and enforcement policies that prevent members from gaining the protection of the group permit if they are not making necessary improvements to their plant and operations. The enforcement policy requires members who exceed their individual allocation to pay an assessment to the group that doubles each year. The monetary basis for the assessment is the amount that the discharger would pay the State of NC to purchase nitrogen from the Ecosystem Enhancement Project. The first year, the member would pay 25% of this amount, 50%the second year, up to the full amount. If the Page 8 of 16 member is reluctant to make necessary improvements to the plant or fails to pay the assessment, the group can vote to remove them from membership, which would subject them to enforcement from the State of NC for violation of their allocation. In this way the group uses peer pressure to encourage continuous improvement among the membership. In the same way, the group provides technical assistance to members who could benefit from improved operational strategies. Due to the diversity of the membership in terms of size and resources, the larger members who have more resources, assist the smaller members who may be lacking in knowledge or funds. The best aspect of the enforcement policy as an incentive for compliance, is that any assessments collected from the members are held in escrow and are returned (in the amount of 80%) to the member once compliance is achieved. The group does retain 20% of these funds as an administrative cost. This seems far more palatable to the dischargers than paying fines to the State without hope of getting any of it back! A good example of the effectiveness of the group compliance approach is the situation that was experienced with a new member to the NRCA in 2005. The Marine Corps Air Station at Cherry Point had been exceeding its nitrogen allocation for some time before joining the NRCA. The base joined the NRCA in order to lease nitrogen for a three to five year period to allow them to comply with their permit while the plant was upgraded. The terms of their membership and their agreement to lease nitrogen, showed a major commitment on the part of Cherry Point to make the improvements needed to meet their allocation. The lease agreement called for the cost of the lease to increase each year, providing an incentive for them to make improvements in a timely manner. With these Page 9 of 16 incentives in place, the Marine base began a comprehensive training program for its operators and made some substantial operational improvements to optimize their treatment process. In the end, Cherry Point never did violate their individual allocation and did not need the allocation they had leased. They continued to pay their lease payments, in good faith and have pursued the necessary improvements to their plant. One important feature of this lease agreement, was that the membership determined that the funds paid by Cherry Point would be earmarked for projects that would directly benefit the Neuse River and nutrient management. The group voted to use the funds to partially fund a reuse project for another member that will essentially divert that member's entire wastewater discharge to a nursery operation during the summer months, thus removing this loading from the river when the stress is the greatest. If Cherry Point were not a member of the NRCA, it is doubtful that any regulatory agency could have compelled it to pay a penalty assessment, and even if a penalty was paid, the funds would not have been used to benefit the Neuse. Two smaller members of the NRCA are still pursuing funding for necessary capital improvements to their plants in order to meet their nitrogen allocations. In the mean time, the group monitors their progress, requires them to make regular reports to the group and provides short term leases opportunities for them to avoid the enforcement assessments that the group's enforcement policy requires. In some respects, the members would rather negotiate a short-term lease for needed nitrogen, rather than to fall subject to "enforcement"by the group. Even though lease costs cannot be recouped by the member Page 10 of 16 (as they can from the enforcement policies), it is often cheaper and better to be considered "in compliance." Accounting Procedures and Evaluation of the Program The NRCA is required to report to the State of NC, Division of Water Quality every six months. The group is required to submit two reports to the State each year that include the total loadings from each member, to determine compliance with the permit, along with other aspects of the group's activities. The Midyear Report is due on Aug. 31 of each year, which includes the last 12 months of Total Nitrogen data for each member, reported as Total Monthly Flow,Monthly Average Total Nitrogen and the loading expressed as pounds for each month and totaled for the period. This report is not used for compliance purposes,but is used to give the State a running 12 month snapshot of the group's loading. The Annual Report is required to be submitted by February 28th of each year and includes all data(as described above) for the calendar year along with a survey of member's activities. This report includes information regarding regionalization, a summary of all purchases, sales, trades, leases or other transactions affecting the allocations of the members, enforcement updates, changes in membership, control strategies for the coming year, a summary of measures taken to control TN for the last year(for each member),and an assessment of progress made and a description of other efforts or projects for the coming year(s). The fact that all of the activities of the association are governed and reported under an NPDES permit make this program fairly unique. This type of reporting and its subsequent review by the State provides transparency for all activities of the NRCA and any leases or trades that might take place. The State discourages temporary leases and encourages permanent trades that then can be Page 11 of 16 reflected in the individual NPDES permits. The State uses the NRCA permit as a means of tracking and accounting for all Total Nitrogen Allocations of the members. The NRCA reports are submitted under the conditions of the NPDES permit and are therefore, public information and subject to public scrutiny as well. A copy of the data portion of the 2005 Annual Report is included in Appendix A. The narrative portion of the report is too lengthy to be included here. The Executive Committee and Executive Director of the NRCA are in contact with the staff of the Division of Water Quality on a continuing basis and meetings are held periodically to discuss issues that affect the permit and the group. The uniqueness of this program necessitates constant communication and the utmost cooperation between the NRCA and the State. We are essentially making this up as we go along, so communication and cooperation are essential to the success of the program and to the development of future strategies to enhance membership in the NRCA and the benefit to the Neuse River. Collaboration and stakeholder involvement have always been a part of the NRCA. By its very nature, it includes representatives from 20 members (large municipalities, small towns, a private utility, industry and a military base.) The diversity of the membership and the various representatives and elected officials who serve as the delegates, deliver a variety of opinions and viewpoints. Due to the state-issued permit, there are opportunities for public input, notice and hearing involving most association activities. The association has kept the conservation groups informed of their efforts and has supplied them with copies of the annual reports. The group is actively involved with two different universities in the North Carolina University System to participate in research Page 12 of 16 and the sharing of data on the Neuse Estuary and to draw on the expertise of academia. These research efforts are explained in a subsequent section of the nomination. Actual or Anticipated Environmental Improvement To reiterate the actual environmental improvement that has been experienced by the Neuse River, thanks to the NRCA: in 1995 the point sources who make up the current membership of the NRCA discharged 1,784,130 pounds to the Neuse River Estuary. The permit that was in force in 2003 and 2004, permitted the group to discharge 1,073,115 pounds of Total Nitrogen. The group reported a discharge of just 722,374 pounds or 67% of the permitted load. In 2004, the members decreased this amount by 163,821 pounds, discharging 558,553 pounds of nitrogen(52%of the permitted limit.) In 2005 the group discharged 566,627 pounds of TN, or 50%of its permitted limit(which increased to 1, 137,171 due to the addition of two new members and their allocations.) The total impact on the Neuse was the reduction of the Total Nitrogen load by 68%or a total of 1,217,503 pounds in 2005 over what was discharged in 1995. If you look at the cumulative reduction since 1996, the NRCA has kept 7,337,508 pounds of TN out of the Neuse River from what was being discharged during the baseline year of 1995. One can only imagine the benefits to the river and estuary from a reduction of this magnitude. Actual or Expected Economic Benefits The economic benefits that have been realized by the Neuse River and its estuary and the State of North Carolina thanks to the efforts of the NRCA are difficult to quantify. A great deal of money has been spent by the municipalities and industries that hold membership in the NRCA. It is estimated that over fifty million dollars has been spent Page 13 of 16 I on upgrades to wastewater facilities and to construct new facilities to remove nitrogen from the receiving waters. The conditions in the Neuse River and the estuary have greatly improved, and the NRCA is now participating in research being conducted by the University of North Carolina at Chapel Hill, Institute of Marine Science to further document the recovery of the estuarine system. The NRCA is supporting this research, in the amount of$65,000 per year, to assist in this effort. In addition to the economic benefits that have undoubtedly been experienced by the aesthetic improvements and public perception of the river and the coast, the other major economic benefit is the growth that the NRCA has now provided for in the eastern part of North Carolina. The development of the TMDL for the Neuse, mandated a 30%reduction in nitrogen loading from point sources. As mentioned previously, there were no provisions for growth in terms of new or expanding wastewater facilities. The 68%reduction that has been realized by the NRCA has bought the State of North Carolina some room to grow, in a part of North Carolina that is trying to grow very rapidly. The improvements made by NRCA members and the fact that many of our members are treating well below what is accepted as Best Available Technology, have provided an excess allocation that stands to allow some growth in the basin that otherwise would have been impossible. The NRCA is currently participating in negotiations with the State that might allow the members of the NRCA to leverage some additional flows for their facilities, based on their ability to treat below BAT levels and based on the unused portion of the allocation that they group holds. The group shares information and promotes reuse projects that will also remove flow and nitrogen from the wastewater Page 14 of 16 discharges, that could allow for more growth for the towns and cities of eastern North Carolina. The NRCA is anxious to pursue point source, non-point source trading as a way of providing additional reductions from agriculture and non-point sources that could help their town provide more growth, while protecting the river and the estuary. The group is currently supporting research by North Carolina State University into alternative methods of providing nutrient offsets, that might allow municipalities to expand buffers within the basin,purchase conservation easements and construct stormwater retrofit projects that would benefit the river and the estuary. The group hopes that by conducting this research and showing the benefit and cost of other alternatives, that the Environmental Management Commission of NC could be persuaded to add some additional measures to provide for this type of non-point source,point source trading. Conclusion This group has had to been innovative, cooperative and altruistic in their struggle to reduce nitrogen loadings to protect the Neuse, while meeting the pressures of growth and economic development. The have proven their ability to meet the challenge of a mandated reduction in nitrogen loading, by working together and sharing information and resources and accomplishing what no one though was possible. They take their obligation to the Neuse very seriously and conduct additional research and monitoring to look for new ways to improve the estuary and to optimize nitrogen removal at their plants. Their efforts have gone unnoticed and unappreciated by the citizens of North Carolina, thanks to conservation groups that fail to acknowledge the effort and commitment they have demonstrated. The NRCA has not simply used nutrient trading in Page 15 of 16 its most traditional sense, but has looked for innovative ways to bring new tools to the trading tool box. To be a member of the NRCA is a much bigger commitment than just agreeing to buy some nitrogen when you need it. This group constantly strives to bring all its members up to a standard of excellence that provides the best treatment and the cleanest reclaimed water to protect the Neuse River and its estuary.
