PO Box 1562

Subject: Issuance of NPDES Permit NCC000001
Neuse River Compliance Association
Dear Mr. Phthisic:
In accordance with the application for discharge permit received on June 29,2007,and
subsequently revised, the Division is forwarding herewith the NPDES permit for the Neuse River
Compliance Association. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and to the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 15,2007. •
The Division published notices in newspapers of general circulation in the affected counties,
inviting public comments on the draft permit. We received comments from the Association and the
USEPA's Region 4 staff during the 30-day review period. The following is a response to your
comments and a summary of changes made as a result:
• Goldsboro corrections. The final permit includes the correct name for Goldsboro's
Wastewater Reclamation Facility. It also includes updated names for the Apex,North Cary,
South Cary, and Kinston Regional WRFs.
The discharge allocations in the City's individual NPDES permit are correct and now
replace the values in the draft Appendix A.
• Reserve allocations. The reserve allocations for SGWASA and the Town of Clayton were
listed in the draft permit but inadvertently omitted in calculating the Association's Estuary
TN Limit. The final limit includes these allocations.
• Allocations for Town of Wilson. Since we discussed this at the NRCA's December 4
meeting, the Town requested a technical correction to its individual permit, on an unrelated
matter. We were able to include the allocation for the one connection omitted earlier. As a
result,Appendix A includes this connection transfer as part of Wilson's allocation.
• Allocations for City of New Bern. As agreed, the Division will add the allocations for
connected facilities as part of the City's 2009 permit renewal and then include them in the
next modification of the group permit.
• Progress Energy—Lee Steam Electric Plant. Although the Association has voted to lease
9,000 lb/yr of estuary allocation to Progress Energy, the final permit,as agreed, shows an
allocation of zero for the facility. This is consistent with the handling of other leases internal
to the Association and does not affect the Estuary TN Limit for the group. The final permit

also includes a new footnote that explains the baseline allowance and use of the leased
allocation for TN loads above the baseline.
EPA's Region 4 staff raised several general questions about the permit and the workings of the
Association. We addressed•those to their satisfaction, and they indicated they had no further
comments.
With the adjustments described above, the Association's Estuary TN Allocation for calendar year
2009 becomes 1,149,391 lb/yr. The combined estuary allocation for all affected point source
discharges in the Neuse River basin remains at 1,640,000 lb/yr.
If any requirements contained in this permit are unacceptable to you,you have the right to an

STANDARD CONDITIONS FOR NPDES PERMITS
SECTION A- APPLICABILITY OF PARTS II AND III
1. The permit conditions in Parts II and III of this permit are standard conditions in NPDES
wastewater permits in North Carolina. They are intended to apply specifically to individual
permittees that own or operate a treatment facility. Thus, many are not applicable to the Neuse
River Compliance Association and its Co-Permittee Members. They are included in this permit in
their entirety as a compilation of standard conditions. These conditions shall apply as follows:
a. The Neuse River Compliance Association serves as a governing body for its Members. It
neither owns nor operates any treatment facilities.Consequently, the standard conditions in
Parts II and III of this permit which by their terms or meaning assume the permittee owns or
operates a treatment facility,or which are inconsistent with the Special Conditions in Part I of
this permit, shall neither be applicable to nor enforceable against the Association. These shall
include the following,at a minimum: in Part II,Conditions B.5.-12.and Sections D and E;
and,in Part III,Sections A and B.However, consistent with the intent of state and federal
NPDES regulations, the Association must still summarize monitoring results on a Discharge
Monitoring Report form approved by the Director;and it must retain all monitoring records
for a period of at least three years.
b. Each of the Co-Permittee Members governed by this Association permit owns or operates one
or more treatment facilities. Each holds an individual NPDES permit for each facility and
remains subject to the standard conditions in its permit(s).Consequently, the standard
conditions in this Association permit shall neither be applicable to nor enforceable against the
individual Co-Permittee Members.
c. Wherever a standard condition in this Association permit is by its terms or meaning
applicable to the Association or to its entire membership in its entirety, and it refers to"the
permittee,"it shall be construed to read"the Association."

Part II
Permit No.NCC000001
a. The "monthly average discharge"is defined as the total mass of all daily discharges sampled
and/or measured during a calendar month on which daily discharges are sampled and
measured, divided by the number of daily discharges sampled and/or measured during such
month. It is therefore,an arithmetic mean found by adding the weights of the pollutant found
each day of the month and then dividing this sum by the number of days the tests were
reported. The limitation is identified as"Monthly Average"in Part I of the permit.
b. The"weekly average discharge"is defined as the total mass of all daily discharges sampled
and/or measured during the calendar week(Sunday-Saturday)on which daily discharges
are sampled and measured, divided by the number of daily discharges sampled and/or
measured during such week.It is,therefore,an arithmetic mean found by adding the weights
of pollutants found each day of the week and then dividing this sum by the number of days
the tests were reported. This limitation is identified as"Weekly Average"in Part I of the
permit.
c. The"maximum daily discharge"is the total mass(weight)of a pollutant discharged during a
calendar day.If only one sample is taken during any calendar day the weight of pollutant
calculated from it is the"maximum daily discharge."This limitation is identified as"Daily
Maximum,"in Part I of the permit.
d. The"average annual discharge"is defined as the total mass of all daily discharges sampled
and/or measured during the calendar year on which daily discharges are sampled and
measured, divided by the number of daily discharges sampled and/or measured during such
year. It is,therefore,an arithmetic mean found by adding the weights of pollutants found each
day of the year and then dividing this sum by the number of days the tests were reported.
This limitation is defined as"Annual Average"in Part 1 of the permit.
6. Concentration Measurement
a. The"average monthly concentration,"other than for fecal coliform bacteria,is the sum of the
concentrations of all daily discharges sampled and/or measured during a calendar month on
which daily discharges are sampled and measured, divided by the number of daily discharges
sampled and/or measured during such month(arithmetic mean of the daily concentration
values). The daily concentration value is equal to the concentration of a composite sample or
in the case of grab samples is the arithmetic mean(weighted by flow value)of all the samples
collected during that calendar day.The average monthly count for fecal coliform bacteria is
the geometric mean of the counts for samples collected during a calendar month. This
limitation is identified as"Monthly Average"under"Other Limits"in Part I of the permit.
b. The"average weekly concentration,"other than for fecal coliform bacteria,is the sum of the
concentrations of all daily discharges sampled and/or measured during a calendar week
(Sunday/Saturday)on which daily discharges are sampled and measured divided by the
number of daily discharges sampled and/or measured during such week(arithmetic mean of
the daily concentration values). The daily concentration value is equal to the concentration of
a composite sample or in the case of grab samples is the arithmetic mean(weighted by flow
value)of all the samples collected during that calendar day.The average weekly count for
fecal coliform bacteria is the geometric mean of the counts for samples collected during a
calendar week.This limitation is identified as"Weekly Average"under"Other Limits"in Part
I of the permit.
c. The"maximum daily concentration"is the concentration of a pollutant discharge during a
calendar day.If only one sample is taken during any calendar day the concentration of
pollutant calculated from it is the"Maximum Daily Concentration".It is identified as"Daily
Maximum"under"Other Limits"in Part I of the permit.
d. The"average annual concentration,"other than for fecal coliform bacteria,is the sum of the
concentrations of all daily discharges sampled and/or measured during a calendar year on
Part II

Permit No.NCC000001
which daily discharges are sampled and measured divided by the number of daily discharges
sampled and/or measured during such year(arithmetic mean of the daily concentration
values). The daily concentration value is equal to the concentration of a composite sample or
in the case of grab samples is the arithmetic mean(weighted by flow value)of all the samples
collected during that calendar day.The average yearly count for fecal coliform bacteria is the
geometric mean of the counts for samples collected during a calendar year. This limitation is
identified as"Annual Average"under"Other Limits"in Part I of the permit.
e. The"daily average concentration"(for dissolved oxygen)is the minimum allowable amount of
dissolved oxygen required to be available in the effluent prior to discharge averaged over a
calendar day.If only one dissolved oxygen sample is taken over a calendar day,the sample is
considered to be the"daily average concentration"for the discharge. It is identified as"daily
average"in the text of Part I.
f. The"quarterly average concentration"is the average of all samples taken over a calendar
quarter. It is identified as"Quarterly Average Limitation"in the text of Part I of the permit.
g. A calendar quarter is defined as one of the following distinct periods:January through March,
April through June,July through September, and October through December.
7. Other Measurements
a. Flow,(MGD):The flow limit expressed in this permit is the 24 hours average flow, averaged
monthly. It is determined as the arithmetic mean of the total daily flows recorded during the
calendar month.
b. An"instantaneous flow measurement"is a measure of flow taken at the time of sampling,
when both the sample and flow will be representative of the total discharge.
c. A"continuous flow measurement" is a measure of discharge flow from the facility which
occurs continually without interruption throughout the operating hours of the facility.Flow
shall be monitored continually except for the infrequent times when there may be no flow or
for infrequent maintenance activities on the flow device.
8. Types of Samples
a. Composite Sample: A composite sample shall consist of:
(1) a series of grab samples collected at equal time intervals over a 24 hour period of
discharge and combined proportional to the rate of flow measured at the time of
individual sample collection,or
(2) a series of grab samples of equal volume collected over a 24 hour period with the time
intervals between samples determined by a preset number of gallons passing the
sampling point.Flow measurement between sample intervals shall be determined by use
of a flow recorder and totalizer, and the present gallon interval between sample
collection fixed at no greater than 1/24 of the expected total daily flow at the treatment
system,or
(3) a single, continuous sample collected over a 24 hour period proportional to the rate of
flow.
In accordance with(1)above,the time interval between influent grab samples shall be no
greater than once per hour, and the time interval between effluent grab samples shall be no
greater than once per hour except at wastewater treatment systems having a detention time of
greater than 24 hours. In such cases, effluent grab samples may be collected at time intervals
evenly spaced over the 24 hour period which are equal in number of hours to the detention
time of the system in number of days. However,in no case may the time interval between
effluent grab samples be greater than six(6)hours nor the number of samples less than four
(4)during a 24 hour sampling period.
Part II
Permit No.NCC000001
b. Grab Sample:Grab samples are individual samples collected over a period of time not
exceeding 15 minutes;the grab sample can be taken manually.Grab samples must be
representative of the discharge or the receiving waters.
9. Calculation of Means
a Arithmetic Mean:The arithmetic mean of any set of values is the summation of the individual
values divided by the number of individual values.
b. Geometric Mean:The geometric mean of any set of values is the Nth root of the product of the
individual values where N is equal to the number of individual values. The geometric mean is
equivalent to the antilog of the arithmetic mean of the logarithms of the individual values. For
purposes of calculating the geometric mean, values of zero(0)shall be considered to be one(1).
c. Weighted by Flow Value:Weighted by flow value means the summation of each
concentration times its respective flow divided by the summation of the respective flows.
10. Calendar Day
A calendar day is defined as the period from midnight of one day until midnight of the next day.
However, for purposes of this permit, any consecutive 24-hour period that reasonably represents
the calendar day may be used for sampling.
11. Hazardous Substance
A hazardous substance means any substance designated under 40 CFR Part 116 pursuant to
Section 311 of the Clean Water Act.
12. Toxic Pollutant
A toxic pollutant is any pollutant listed as toxic under Section 307(a)(1)of the Clean Water Act.
SECTION C- GENERAL CONDITIONS
1. Duty to Comply

permit.
4. Bypassing of Treatment Facilities
a. Definitions
(1) "Bypass" means the known diversion of waste streams from any portion of a treatment
facility including the collection system, which is not a designed or established or
operating mode for the facility.
(2) "Severe property damage"means substantial physical damage to property, damage to the
treatment facilities which causes them to become inoperable,or substantial and
permanent loss of natural resources which can reasonably be expected to occur in the
absence of a bypass.Severe property damage does not mean economic loss caused by
delays in production.
b. Bypass not exceeding limitations.
The permittee may allow any bypass to occur which does not cause effluent limitations to be
exceeded, but only if it also is for essential maintenance to assure efficient operation. These
bypasses are not subject to the provisions of Paragraphs c.and d.of this section.
c. Notice
(1) Anticipated bypass. If the permittee knows in advance of the need for a bypass,it shall
submit prior notice,if possible at least ten days before the date of the bypass;including
an evaluation of the anticipated quality and affect of the bypass.
(2) Unanticipated bypass. The permittee shall submit notice of an unanticipated bypass as
required in Part II,F. 6.of this permit.(24 hour notice).
d. Prohibition of Bypass
(1) Bypass is prohibited and the Permit Issuing Authority may take enforcement action

(A) Bypass was unavoidable to prevent loss of life, personal injury or severe property
damage;
(B) There were no feasible alternatives to the bypass, such as the use of auxiliary
treatment facilities, retention of untreated wastes or maintenance during normal
periods of equipment downtime. This condition is not satisfied if adequate backup
equipment should have been installed in the exercise of reasonable engineering
judgment to prevent a bypass which occurred during normal periods of equipment
downtime or preventive maintenance;and
(C) The permittee submitted notices as required under Paragraph c.of this section.
(2) The Permit Issuing Authority may approve an anticipated bypass, after considering its
adverse affects,if the Permit Issuing Authority determines that it will meet the three
conditions listed above in Paragraph d.(1)of this section.
5. Upsets
a. Definition.
"Upset"means an exceptional incident in which there is unintentional and temporary
noncompliance with technology based permit effluent limitations because of factors beyond
the reasonable control of the permittee. An upset does not include noncompliance to the
Part II

extent caused by operational error, improperly designed treatment facilities, inadequate
treatment facilities, lack of preventive maintenance,or careless or improper operation.
b. Effect of an upset.
An upset constitutes an affirmative defense to an action brought for noncompliance with such
technology based permit effluent limitations if the requirements of paragraph c.of this
condition are met. No determination made during administrative review of claims that
noncompliance was caused by upset, and before an action for noncompliance,is final
administrative action subject to judicial review.
c. Conditions necessary for a demonstration of upset.
A permittee who wishes to establish the affirmative defense of upset shall demonstrate,
through properly signed, contemporaneous operating logs,or other relevant evidence that:
(1) An upset occurred and that the permittee can identify the cause(s)of the upset;
(2) The permittee facility was at the time being properly operated;and
(3) The permittee submitted notice of the upset as required in Part II,F.6. (b)of this permit.

Special Condition A.(3.)regarding applicability of individual WQBLs in lieu of group limit.A member's estuary limit may be less than its estuary
allocation, such as when the facility holds part of the allocation in reserve or is subject to more stringent limits in order to protect local water quality.
(2) Progress Energy's Lee Steam Plant is allowed a baseline TN load of 3,260 lb/yr at its Outfall 001 (2,282 lb/yr at the estuary).Progress has leased
additional allocation from the NRCA to ensure coverage for TN discharges from its new Rotamix system from 2009 through 2013.The allocations
listed in this table and the amounts to be reported by Progress under this permit pertain strictly to any load in excess of the baseline allowance. The
table does not reflect the lease amount(9,000 lb/yr for 2009),in part because the amount of the lease will vary from year to year. The leased amount
will not exceed the 24,400 lb/yr available in the Burlington Industries allocation.

POINT SOURCE FACILITIES ASSIGNED TOTAL NITROGEN ALLOCATIONS
NEUSE RIVER BASIN
The following is a list of all treatment facilities that,as holders of individual NPDES permits in 1995,are
assigned a Total Nitrogen(TN)allocation pursuant to state rule T15A NCAC 2B.0234,Neuse River Basin
Nutrient Sensitive Waters Management Strategy-Wastewater Discharge Requirements, adopted December
1997 and revised October 2002.
The rule establishes an aggregate Estuary TN Allocation of 1.64 million pounds TN per year for these
facilities and prescribes how the allocation is to be divided among the individual facilities. The
allocations, individual and aggregate, become effective with calendar year 2003.
The Total Maximum Daily Load for Total Nitrogen to the Neuse River Estuary,North Carolina, approved by
the USEPA Region 4 in July 1999,also concludes that this aggregate allocation is the maximum
allowable contribution from point source dischargers to the Neuse River estuary.

2008 Renewal - Final
PERMIT ACTION
The Neuse River Compliance Association and its co-permittee members applied for renewal of the
NPDES permit governing the group's discharge of Total Nitrogen to the Neuse River and its tributaries.
The group made application on June 28,2007,and modified its application on July 25,2007,and
October 6,2008.
The Division found the Association's application to be acceptable and made a tentative determination
to re-issue the permit, with changes. The Division provided a copy of the draft permit package to the
permittee and to the Neuse Riverkeepers via email on November 14,2008,and published a notice of the
draft permit in the principle newspaper for each county in the river basin beginning on November 16.
The Division received comments from the permittee and considered those in preparing the final permit.
We also the discussed the permit and the workings of the Association with USEPA Region 4 staff, after
which they indicated they had no further comments.
The permit was issued December 31,2008,effective January 1,2009,and expires December 31,2013.
INTRODUCTION
The Neuse River Basin is classified as Nutrient Sensitive Waters(NSW),due to long-term nutrient
impacts on the river's estuary from point, nonpoint, and natural sources of pollution. In December 1997,
the Environmental Management Commission adopted the Neuse River Basin Nutrient Sensitive Waters
(NSW) Management Strategy,a rules package designed to address these nutrient impacts and restore
water quality in the basin. The Strategy required that Total Nitrogen(TN)loads to the estuary (1995
baseline)be reduced by 30 percent by the year 2003.
The basin has also been listed on the state's 303(d)list of impaired waters because of the nutrient
impacts. The Division developed Total Nitrogen TMDLs for the basin, based upon the NSW
Management Strategy,and the USEPA approved the TMDLs in 1999(Phase I)and 2002(Phase II).The
2000 303(d) list again includes the basin, now noting that the TMDLs have been approved and are being
implemented.
One portion of the NSW Management Strategy, the Wastewater Discharge Requirements rule(T15A
NCAC 2B .0234),establishes specific nutrient control requirements for the point source dischargers in
the basin.
• The rule sets forth a system of Total Nitrogen allocations to achieve the stated 30 percent
reduction in point source loads to the estuary.Toward this end,it:
• sets a wasteload allocation of 1.64 million pounds TN per year(at the estuary)for all point
source dischargers in the basin.
• further divides this allocation among the existing dischargers.
• requires that large facilities(those with permitted flows equal to or greater than 500,000
gallons per day)meet their individual TN allocations, effective in 2003.
• prescribes what allocations are required for new and expanding dischargers as well as how
they will be handled when permitted facilities consolidate(regionalize)their wastewater
discharges.
• provides that interested dischargers can form a group compliance association and work
together to meet their combined TN allocation. Under this option, the individual
FACT SHEET Neuse River Compliance Association
NPDES PERMIT-2008 Final NPDES No.NCC000001
dischargers are subject to TN limits in a group compliance NPDES permit in lieu of the TN
limits in their individual NPDES permits.
• The rule also prescribes Total Phosphorus limits for the most significant dischargers in the
basin.
The subject permit is a group compliance permit as described above. It first became effective January 1,
2003,and is the only such permit to be developed under the Strategy's Wastewater Discharge rule.
PERMIT OVERVIEW
Co-Permittees
The Neuse River Compliance Association("NRCA," or the"Association")is a not-for-profit corporation
established in North Carolina in 2002.The purpose of the Association is to function as a"group
compliance association" as provided in the Wastewater Discharge rule.
The Association's members include both public and private entities, all of which discharge treated
wastewater in the Neuse River basin under existing individual NPDES permits.
The Association and each of its members are co-permittees under the group permit. In general, the
Association serves as the contact between the Division and its co-permittee members in matters
pertaining to this permit.
Scope of the Permit
The group compliance permit governs the combined discharge of Total Nitrogen from the co-permittees
to the estuary.Requirements in this permit supplement those in the co-permittee members'individual
NPDES permits but do not replace the requirements in the individual permits except where specifically
stated.
Each member's individual NPDES permit remains in effect and continues to govern the other
parameters of concern for that discharge.
PROPOSED EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
The Division developed effluent limitations, monitoring requirements, and special conditions for the
original group permit based on the Neuse River Basin Nutrient Management Strategy, the approved
TN TMDLs,and extensive deliberations with the USEPA Region 4 and with the affected dischargers. In
subsequent years, the Division has modified Appendix A to reflect changes in membership and
transfers of allocation to and among the members.
The body of the proposed permit is unchanged from the original permit except for an updated address
in Condition A.(6.).The draft Appendix A has again been revised to reflect changes in membership and
transfers of allocation.
Effluent Limitations
Group and Individual TN Limitations
Appendix A of the permit contains the definitive list of(1)Co-Permittee Members in the Association,(2)
discharge and equivalent estuary TN allocations for each member,and(3)the transport factor for each.
These values are taken from allocation method in the Wastewater Discharge rule.
The appendix also includes the sum total of the member's estuary allocations, which represents the
Association Estuary TN Allocation. All TN allocations are expressed in terms of pounds of TN per year
and apply to a calendar year period.
FACT SHEET Neuse River Compliance Association
NPDES PERMIT-2008 Final NPDES No.NCC000001
The permit establishes TN limits for the Association and, under certain conditions, for the individual
co-permittee members.Any group or individual TN limit in this permit is equal to the corresponding
estuary TN allocation in Appendix A.
The Association is subject to a TN limit, equal to its Estuary TN Allocation, throughout the term of this
permit.
Individual members of the Association will be subject to individual TN limits only in those years in
which the Association exceeds its limit. In that case, each co-permittee member is subject to its
individual TN limit from Appendix A.If the Association as a whole complies with its limit, the member
dischargers are not subject to individual limits for that calendar year.
Changes in Membership or TN Allocations
The TN allocations of the co-permittee members can change as the result of purchases, sales, trades,
leases,and other transactions.These changes,in turn,affect the Association's TN allocation.Changes in
membership also affect the Association's allocation due to the addition or subtraction of the discharger's
allocation from the group total.
Whenever changes in the allocations or the membership occur,Appendix A of the permit must be
modified in order to formally incorporate those changes and adjust the enforceable limits in the permit.
The TN allocations and limits are expressed as calendar year values;therefore, any adjustments can
become effective only at the beginning of the calendar year(January 1)following the transaction or
membership change. The Association will notify the Division each year of proposed changes in
Appendix A(see Reporting Requirements,below).

FACT SHEET Neuse River Compliance Association
NPDES PERMIT-2008 Final NPDES No.NCC000001
The TN allocation for each member is included in Appendix A of the permit. These allocations include
the original allocation assigned to the facility in the Wastewater Discharge rule plus any allocation
acquired through regionalization or other transactions.
The Association also holds the TN allocation originally assigned to Burlington Industries(formerly
NC0001376),which the industry deeded to the Association.
As this permit is released for public review,Progress Energy is negotiating a lease of nitrogen allocation
from the Association. The Division proposes to include any such lease under this permit if the
Association documents that the lease is completed prior to the end of the public comment period. The
transfer would then be reflected in Appendix A. Because the leased allocation comes from within the
Association, the transaction will not affect the group's total TN allocation.
Monitoring Requirements
All members of the Association are required under the individual NPDES permits to monitor TN on a
regular basis and report the results in their Discharge Monitoring Reports(DMRs).The group
compliance permit does not duplicate these monitoring requirements or require additional TN
monitoring.
Instream monitoring is not required under this permit. However,it is required of the co-permittee
members through their individual NPDES permits and,for most,is conducted by the Lower Neuse
Basin Association,a coalition of dischargers that,by agreement with the Division, conducts instream
monitoring for its members.
Reporting Requirements
Each member will continue to report its TN monitoring results on its individual DMRs.The Association
is not required to duplicate these detailed reports.
The Association will submit year-end,mid-year,and 5-year reports on its activities to the Division. The
year-end report(due February 28 of each year)will include an accounting of the Association's and its
members'TN discharges for the previous calendar year for compliance purposes. It will also include a
list of transactions during that period affecting TN allocations,an assessment of progress made, and
planned activities for the coming year. The mid-year report(due August 31 of each year)will include an
updated accounting of TN discharges for informational purposes. It will also identify any changes in
TN allocations or in membership for the following year and will serve as a request to modify Appendix
A to incorporate those changes. The 5-year report is intended to ensure that the Division and the
Association agree on the group and individual allocations at the end of the permit term.
Compliance
The Association is required by rule to make offset payments to the Wetlands Restoration Fund for any
calendar year in which it exceeds its TN limit. In addition, the Division may take appropriate
enforcement action against the Association or its co-permittee members or both in the event that they
exceed applicable TN limits in the permit.
The Association has not exceeded its TN limit in the first six years of its existence. The group's
combined nitrogen reduction has been exemplary, reaching nearly 70% reduction from 1995 baseline
levels as compared to the mandated 30% reduction for point source discharges in the basin.
Expiration Date
The original permit expired December 31,2007.The Division received timely application for renewal
and, with the Association's consent, administratively extended the permit and delayed renewal for one
year. As a result, renewals of this group permit will now follow-rather than precede-those of the
members'individual NPDES permits, whose nitrogen limits it is meant to reflect.

NPDES PERMIT-2008 Final NPDES No. NCC000001
Response to Comments
The Division received one set of comments on the draft permit, from the permittee. The comments and
the Division's responses are presented below.
Comment 1) The name of the City of Goldsboro's treatment facility was changed 7 years ago to the
Goldsboro Water Reclamation Facility. This should be reflected in Appendix A. The
draft permit lists a different permit number for the Town of Eureka(which was tied to
the Goldsboro facility)than is in the permit for the City of Goldsboro. Their permit lists
the permit number as NC0048062. There are also some questions about the allocations
involving the Town of Eureka and Wayne County Schools. Goldsboro's current permit
lists the allocation for Eureka to be 578 pounds and Wayne County Schools to be 317
pounds. This differs from the amounts in the draft NRCA permit. The total difference
amounts to 359 pounds.
Response The final permit includes the correct name for Goldsboro's Wastewater Reclamation
Facility. It also includes updated names for the Apex,North Cary,South Cary, and
Kinston Regional WRFs.
The discharge allocations in the City's individual NPDES permit are correct and now
replace the values in the draft Appendix A.Allocations from connected facilities must
be transferred as estuary allocations, then converted to discharge allocations using the
'parent' facility's transport factor. In this case,I used the connecting facilities'transport
factors, and three of the five were located in a different transport zone.To avoid this
occurring in the future,I removed TF values for all connected facilities.
Comment 2) The reserve allocations for South Granville Water and Sewer Authority and the Town
of Clayton need to be included in the total allocation for the Association. These
reserves, although they cannot be used by these two dischargers under their current
permits, are part of the point source allocation for the Neuse TMDL and should be
accessible to other dischargers as long as there are no local water quality concerns.
These additional 6113 pounds need to be added to the group's allocation.
Response Reserve allocations. The reserve allocations for SGWASA and the Town of Clayton
were listed in the draft permit but inadvertently omitted in calculating the Association's
Estuary TN Limit. The final limit includes these allocations.
Comment 3) The Town of Wilson and the City of New Bern agree that the additional allocations
that were added for tie-ons that are not reflected in their individual permits need to be
removed from the NRCA permit until modifications are made to their individual
permits. These amounts are 11,274 pounds/yr.for the City of New Bern and 101
pounds/yr. for the City of Wilson.
Response Since we discussed this at the NRCA's December 4 meeting, the Town of Wilson
requested a technical correction to its individual permit,on an unrelated matter. We
were able to include the allocation for the one connection omitted earlier. As a result,
Appendix A includes this connection transfer as part of Wilson's allocation.
As agreed, the Division will add the allocations for connected facilities as part of the
City of New Bern's 2009 permit renewal and then include them in the next modification
of the group permit.
FACT SHEET Neuse River Compliance Association
NPDES PERMIT-2008 Final NPDES No.NCC000001
Comment 4) We have agreed that the allocation for the Lee Steam Plant,Progress Energy Permit
No.NC0003417 shall remain"0." We would request that a footnote be added that
would indicate that the Division has agreed that this facility has a background level of
3260 pounds per year of Total Nitrogen occurring at the discharge point. The Division
should indicate that the facility is allowed to discharge this amount under the non-point
source allocation under the Neuse Rules and that they shall only be responsible for
levels in excess of this background level that is passing through their plant. The
footnote may also state that they have entered into a lease agreement with the NRCA for
an additional allocation of TN. The Association would like this background allocation
to be specified,as it will be up to the Association to establish compliance with the
allocation in the future and this amount will need to be subtracted from the monitored
loading in order to establish compliance.
Response Although the Association has voted to lease 9,000 lb/yr of estuary allocation to Progress
Energy, the final permit,as agreed, shows an allocation of zero for the facility. This is
consistent with the handling of other leases internal to the Association and does not
affect the Estuary TN Limit for the group. The final permit also includes a new footnote
that explains the baseline allowance and use of the leased allocation for TN loads above •
the baseline.
The staff of the Raleigh Regional Office suggested changes in their staff report, but these did not result
in changes to the permit.

Dear Mr.Templeton:
The Neuse River Compliance Association(NRCA)has reviewed the draft NPDES permit
for the association(NCC000001) and would offer the following comments per our
discussions with you:
1) The name of the City of Goldsboro's treatment facility was changed 7 years ago
to the Goldsboro Water Reclamation Facility. This should be reflected in
Appendix A. The draft permit lists a different permit number for the Town of
Eureka(which was tied to the Goldsboro facility)than is in the permit for the City
of Goldsboro. Their permit lists the permit number as NC0048062. There are
also some questions about the allocations involving the Town of Eureka and
Wayne County Schools. Goldsboro's current permit lists the allocation for
Eureka to be 578 pounds and Wayne County Schools to be 317 pounds. This
differs from the amounts in the draft NRCA permit. The total difference amounts
to 359 pounds.
2) The reserve allocations for South Granville Water and Sewer Authority and the
Town of Clayton need to be included in the total allocation for the Association.
These reserves, although they cannot be used by these two dischargers under their
current permits, are part of the point source allocation for the Neuse TMDL and
should be accessible to other dischargers as long as there are no local water
quality concerns. These additional 6,113 pounds need to be added to the group's
allocation.
3) The Town of Wilson and the City of New Bern agree that the additional
allocations that were added for tie-ons that are not reflected in their individual
permits need to be removed from the NRCA permit until modifications are made
to their individual permits. These amounts are 11,274 pounds/yr. for the City of
New Bern and 101 pounds/yr. for the City of Wilson.
4) We have agreed that the allocation for the Lee Steam Plant, Progress Energy
Permit No. NC0003417 shall remain"0." We would request that a footnote be
added that would indicate that the Division has agreed that this facility has a
background level of 3,260 pounds per year of Total Nitrogen occurring at the
discharge point. The Division should indicate that the facility is allowed to
discharge this amount under the non-point source allocation under the Neuse
Rules and that they shall only be responsible for levels in excess of this
background level that is passing through their plant. The footnote may also state
that they have entered into a lease agreement with the NRCA for an additional
allocation of TN. The Association would like this background allocation to be
specified, as it will be up to the Association to establish compliance with the
allocation in the future and this amount will need to be subtracted from the
monitored loading in order to establish compliance.
We appreciate your willingness to discuss these changes with our group. If you need any
further information, or if we can be of any assistance to you in completing this permit,
please do not hesitate to contact me at 919/989-5044 or Cindy Finan at 919/387-3478.

Re: Modification to Neuse River Compliance Association NPDES Permit No.
NCC00000I
Dear Ms. Sullins:
The Neuse River Compliance Association(NRCA)holds NPDES Permit Number NC00000I
from the Division of Water Quality. This permit has not been modified since January,2006 and
is currently awaiting renewal. To date,we have not received a draft of the permit.
This letter is to officially notify you that the NRCA has accepted Progress Energy, Lee Steam
Plant(NPDES Number NC0003417) into membership in the NRCA. This membership was
approved at our meeting in September,2008. Progress Energy is not a newcomer to our
organizations. They have been a member of the Lower Neuse Basin Association, our sister
organization, since it was created in the 1990's. We have been anticipating this request, since
Progress Energy first came to our board with this concept in 2007. Due to ongoing negotiations
between DWQ and Progress Energy,we have been in constant contact with Mike Templeton of
your staff, regarding our ability to assist Progress Energy. Both Mike and Progress Energy felt it
necessary to resolve certain issues before their membership was considered by our board.
In light of this situation,we would request the Division include this Progress Energy facility in
our renewed permit, when it is issued.
Thank you for your consideration and attention to this matter. If you have any questions or need
any further information regarding this request, please feel free to contact me at 919.989.5044, or

Dear Mr.Templeton:
The Neuse River Compliance Association(NRCA)submitted the application for renewal of
NPDES permit number NCC000001 on June 28,2007. As per our discussions,we have several
corrected pages to submit for inclusion in the application package.
The original application package included forms from each of the co-permittee members of the
NRCA giving specific information on their facilities, including their individual nitrogen
allocations. Several of the members reported their allocations incorrectly,by including nitrogen
allocations that had not yet been added to their individual permits. We asked them to correct
these forms and have enclosed the corrected, signed copies to be substituted into the application
package. There were also several members who had not sent us forms with original signatures by
the submission deadline. We have enclosed those forms as well.
Enclosed, please find original signatures for the City of Wilson and the City of Raleigh(3 plants.)
Also enclosed are corrected nitrogen allocation forms for New Bern,Clayton,Goldsboro,Kenly,
LaGrange,and Kinston.
If you have any questions or need any further information, please do not hesitate to contact me at

Dear Mr. Templeton:
The Neuse River Compliance Association (NRCA)was formally organized as a not-for-profit
organization in 2001. Shortly after it was formed, it applied for and received,NPDES permit
number NCC000001. This permit was issued in compliance with the Neuse River Nutrient
Management Strategy, which authorized the group compliance approach, allowing the group to
comply with an aggregate limit for Total Nitrogen into the Neuse River Estuary.
We are happy to report that the NRCA has been in existence for five years and has cumulatively
removed 8,579,433 pounds of Total Nitrogen from the estuary compared to the discharge that was
occurring in 1995. The group was given a mandate to reduce their Total Nitrogen discharge by
30%,and in 2006,this group of dischargers had removed 70%of that original loading to the
estuary.
The NRCA has served as a national model for"compliance associations"and the success that can
be achieved when point sources work together. Through this innovative and altruistic approach,
our members have collectively spent in excess of$50 million dollars and many of them are now
treating well below the limits established as 'Best Available Technology." Though the efforts of
our members we have upgraded treatment plants, encouraged optimization of treatment
processes, encouraged reuse projects, and we are currently discharging at just under 50%of our
permitted limit for Total Nitrogen.
The Neuse River Compliance Association and its Co-Permittee Members hereby apply to renew
their permit,NCC000001 for another five year period. The enclosed attachments list the
members of the NRCA and provide the required Five Year Report, which include information on
the group's allocations, activities and performance.
If you have any questions or need any further information, please do not hesitate to contact me at

Five Year Report-Progress Report
Compliance
The NRCA has been in full compliance with the permit since it was issued in 2003.
Current members of the compliance association discharged the following flows and
pounds of total nitrogen to the Neuse Estuary in the years shown:

2006 102.970 542,205_
The Association is extremely proud of the efforts of its members in their ability to
remove more nitrogen from the Neuse every year and the removal rates that they have
been able to achieve. It should be noted that one new member was added to the group in
2004 (Neuse Colony) and two additional members were added in 2005 (MCAS Cherry
Point and Unifi-Kinston, LLC.) We have seen that the commitment, experience and
knowledge of our members has helped the group to minimize nitrogen loading, which we
hope will further improve water quality in the Neuse River estuary in the future.
Enforcement Summary
The Association has an internal enforcement policy that requires the individual members
to report to the group and to pay an assessment if they violate their individual nitrogen
allocation. The group notifies any member who is out of compliance with their
individual allocation for a given year, and requires the payment of an assessment and
submission of a compliance schedule to insure that the noncompliance is being
addressed. The enforcement policy gave the members one year of leniency(2003) before
assessments were made.
Starting with 2004's data the group notified two members that they had exceeded their
allocation for that year. The Town of Kenly and Contentnea MSD (CMSD) were
assessed and paid penalties under the group's enforcement strategy. In 2005, these two
dischargers paid to lease nitrogen from other members in order to establish their
compliance, rather than to face continued enforcement. The group requires regular
updates on these member's status and their plans to bring their plants into compliance.
The three towns that make up CMSD are working to control infiltration and inflow. This
is a slow and expensive task for small towns. They have made major improvements to
the collection system, however I&I is still a major priority. The board has been presented
with a plan which includes an upgrade and expansion of this facility. A decision should
be made in the next 6 months. During 2006, the facility experimented with "Kenaf'to
assist in TN reduction. The regional office of DWQ was aware of this test and other
facilities have used this product with some degree of success. The facility ran the study
for 6 months using this product and determined that it was detrimental to the treatment
process and did not accomplish any nitrogen removal. They discontinued the study in
August of 2006.
The Town of Kenly was asked by the Association to secure the services of a consulting
engineering firm to assist them in planning for improvements to their facility. The
Association had sent several operators from large facilities to the Town of Kenly in
efforts to assist the operator to optimize their treatment process. It appeared that the
inability to control the process 24 hours per day, due to a lack of automation and an
"around the clock"staff, was limiting their success in meeting the nitrogen allocation.
The NRCA formally asked the Town of Kenly for an engineering report in late 2006.
The Town presented their engineering report to the Association at their May meeting.
The Town is pursuing funding to carry out the necessary improvements to their
wastewater process. The Association will continue to monitor their progress in this
effort.
The Marine Corps Air Station at Cherry Point joined the Association in 2005. The base
had problems meeting their nitrogen allocation in the past and wished to lease nitrogen
from the Association to allow them to be compliant while they upgraded their plant. The
Base has begun construction of the upgrades to their facility and has brought the plant
into compliance with the nitrogen allocation, without the use of the leased nitrogen. They
accomplished this through staffing changes and by educating their staff in nitrogen
removal optimization techniques.
