McLawhorn,Chairman The Neuse River Compliance Association PO Box 1410 Apex,North Carolina 27528-1410 Subject: Modification of Permit No. NCC000001 Neuse River Compliance Association Dear Mr. McLawhorn: The Division has reviewed the Association's October 28 letter requesting modification of its NPDES permit and is forwarding herewith the revised pages of the permit(cover sheet and Appendix A).This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency, dated October 15,2007. Please insert these revised pages in your current permit and discard the corresponding pages. The revised Appendix A reflects the following changes for calendar year 2011: • Transfer of ownership of the UNIFI-Kinston facility back to DuPont. • Sale of allocation from UNIFI-Kinston to Johnston County,the Town of Clayton,and Contentnea MSD prior to the transfer of ownership. A portion of Clayton's allocation is included as reserve allocation,at the Town's request. • Sale of allocation from the Town of Benson to Johnston County. • Transfer of allocations to the City of New Bern from five facilities that connected to the City's collection system in previous years but whose connection had not been credited to the City. • Corrections to the Goldsboro (discharge)and Raleigh-Smith Creek (estuary) allocations to be consistent with their individual NPDES permits. • Recalculation of the Association's Estuary TN Limit. The`Q95' column has also been deleted from the table,since we agree it no longer serves a useful purpose in the permit. With these adjustments,the Association's Estuary TN Allocation increases to 1,160,662 lb/yr effective January 1,2011. (2) Progress Energy's Lee Steam Plant is allowed a baseline TN load of 3,260 lb/yr at its Outfall 001 (2,282 lb/yr at the estuary).Progress has leased additional allocation from the NRCA to ensure coverage for TN discharges from its new Rotamix system from 2009 through 2013.The allocations listed in this table and the amounts to be reported by Progress under this permit pertain strictly to any load in excess of the baseline allowance.The table does not reflect the lease amount(9,000 lb/yr for 2009),in part because the amount of the lease will vary from year to year.The leased amount will not exceed the 24,400 lb/yr available in the Burlington Industries allocation.
