Dear Mr. McLawhorn:
The Division has reviewed the Association's September 16,2011,letter requesting modification of its
NPDES permit and is forwarding herewith the revised pages of the permit(cover sheet and Appendix
A). This permit modification is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental
Protection Agency,dated October 15,2007.
Please insert these revised pages in your current permit and discard the corresponding pages.
The revised Appendix A reflects the following changes for calendar year 2011:
• Addition of the City of Havelock as a co-permittee member of the NRCA,as requested.The City
brings with it an estuary allocation of 21,400 lb/yr and is located in the 100% transport zone.
• The transfer of allocations to the City of Raleigh from three non-member facilities that have
connected to the City's collection system. The facilities and their estuary allocations are as follows:

• Recalculation of the Association's Estuary TN Allocation and Limit in light of the above changes.
With these adjustments,the Association's Estuary TN Allocation and Limit increase from 1,160,662
lb/yr to 1,184,165 lb/yr effective January 1,2012.
All other terms and conditions contained in the original permit remain unchanged and in full effect.

hearing upon written request within thirty (30) days following receipt of this letter. This request must
be a written petition conforming to Chapter 150B of the North Carolina General Statutes,filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh,North Carolina 27699-6714).
Unless such demand is made,this decision shall be final and binding.

The Neuse River Compliance Association
and Its Co-Permittee Members
are hereby authorized to discharge Total Nitrogen from the Co-Permittee Member treatment facilities
listed herein to receiving waters in the Neuse River Basin in accordance with effluent limitations,
monitoring requirements,and other conditions set forth in this Permit.
This Permit shall become effective January 1,2012
This Permit and the authorization to discharge shall expire at midnight on December 31,2013

allocation,such as when the facility holds part of the allocation in reserve or is subject to more stringent limits in order to protect local water quality.
(2) Progress Energy's Lee Steam Plant is allowed a baseline TN load of 3,260 lb/yr at its Outfall 001 (2,282 lb/yr at the estuary).Progress has leased
additional allocation from the NRCA to ensure coverage for TN discharges from its new Rotamix system from 2009 through 2013.The allocations
listed in this table and the amounts to be reported by Progress under this permit pertain strictly to any load in excess of the baseline allowance.The
table does not reflect the lease amount(9,000 lb/yr for 2009),in part because the amount of the lease will vary from year to year.The leased amount
will not exceed the 24,400 lb/yr available in the Burlington Industries allocation.
(3) Allocation purchased and held in reserve for future use by the co-permittee member.
