Dear Mr. McLawhorn:
The Division has reviewed the Neuse River Compliance Association's September 9,2014,request
p P q
for modification of its NPDES permit and is forwarding herewith the revised pages of the permit
(cover sheet and Appendix A). Please replace the affected pages of your current permit,issued
December 30,2013,with these revised pages.This minor permit modification is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency,dated October 15,2007.
The permit includes the following modifications:
• The allocations and limits table in Appendix A now lists Craven County as a co-permittee
member of the NRCA and the proposed Craven County Water Treatment Plant,permit
NC0089460,as a member facility,per your request. The table and a new Footnote 1 reflect that
the County holds no'permanent' Total Nitrogen allocation at this time but has leased
allocation from the Association until the facility's need is determined and the necessary
allocation acquired.
• The previous Footnote 1 regarding the CWS Systems' allocation lease has been deleted now
that the term of the lease has ended.
• Some owner and facility names have been revised to be consistent with the names in their
individual NPDES permits,and the members have been re-listed in alphabetical order.
All other terms and conditions contained in the original permit remain unchanged and in full
effect. These modifications do not affect the Association's Estuary TN Allocation and Limit,which
remain at 1,195,428 lb/yr and 1,190,831 lb/yr,respectively.

2. Progress Energy's Lee Steam Plant is allowed a baseline TN load of 3,260 lb/yr at its Outfall 001 (2,282 lb/yr at the estuary).Progress leased additional allocation
from the NRCA to ensure coverage for TN discharges from its Rotamix system through 2013.It ceased operation of that system in 2012.The allocations listed in
this table and the amounts to be reported by Progress under this permit pertain strictly to any load in excess of the baseline allowance.
3. In 1999,Burlington Industries deeded its TN allocation(since adjusted to 24,400 lb/yr at the estuary)for use by the Association and its Co-Permittee Members.At
present,the allocation is a group holding assigned to this group permit and is not associated with any individual permit.Unless noted otherwise in this Appendix
A,the entire amount of the allocation is active and is included in the Association Estuary TN Allocation and Limit.

Addendum - CY2015 Modification
PERMIT ACTION
By its letter of September 9,2014, the Neuse River Compliance Association requested modification
of its NPDES permit to reflect the addition of one co-permittee member. The Division agreed with
the request and issued the modification on December 29,2014,to become effective on January 1,
2015.The revisions affect only the permit cover page (issuance and effective dates) and Appendix A
of the permit. Allocations and limits for the Association and its members remain are unchanged,
and the permit's expiration date remains at December 31,2018.
SUMMARY OF CHANGES
The revised Appendix A reflects the following changes for calendar year 2015:
• Addition of Craven County as a co-permittee member and its Water Treatment Plant,
NC0089460,as a member facility. The proposed WTP will be located in the 100% transport zone
of the Neuse River basin.
• Deletion of the footnote regarding the CWS Systems' allocation lease,now ended.
• Addition of a new footnote regarding Craven County's allocation lease.
• Correction of owner and facility names,and re-listing of members in alphabetical order.
Craven County currently holds no'permanent' allocation under the Neuse wastewater discharge
rule,T15A NCAC 02B .0234. The rule requires all new dischargers to demonstrate that they have
sufficient allocation prior to application for an NPDES permit;however,the necessary allocation
cannot be determined until the facility becomes operational. The Division issued an NPDES permit
for the proposed facility with requirements that the County monitor its discharge, determine the
amount of allocation needed,and acquire the necessary allocation to satisfy the rule. In the
meantime,the County has agreed to similar requirements as a condition of its membership.
Furthermore,it has leased a nominal amount of allocation from the Association and may lease
additional allocation for some period once its needed are identified.
These changes to the permit do not affect the Association's Estuary TN Allocation/ Limit. The
Allocation and Limit,which first became effective on January 1,2013,will remain at the current
levels of 1,195,428 lb/yr and 1,190,831 lb/yr,respectively.

2014 Permit Revision Request
Dear Mr. Reeder.
The Neuse River Compliance Association (NRCA)requests a revision in its permit to include
Craven County, NPDES Permit#NC0089460, as a co-permittee effective January 1,2014.
The NRCA approved Craven County for membership in February,2014.
The NRCA reported in its 2013 Annual Report a delivered estuary amount of 514,847 pounds of
total nitrogen or approximately 43%of the permit limit of 1,195,428 pounds. Based on the terms
of the NRCA's permit, the midyear report submittal is not required since the Association's Estuary
TN Load for 2013 was less than 80%of the total nitrogen allocation.
We are very pleased that our members have continued to strive to reduce the nitrogen delivered to
the lower Neuse River basin. If you have any questions or require additional information, please
