NOW COMES the Petitioner City of Raleigh and dismisses,without prejudice, its
Contested Case Petition in the above-captioned matter. This Notice of Dismissal is filed
pursuant to 26 NCAC 3 .101(a)and Rule 41(a)(1)of the General Rules of Practice for the
Superior and District Court. The Dismissal is taken consequent to the modification of
NPDES Permit No. NCC000001 by the Respondent on May 26,2005,which
modification had been requested by the Intervenor Neuse River Compliance Association.
The modification moots the bases upon which the Petitioner founded its Contested Case
Petition and affords the relief sought by the Petitioner.
