As included in the attached report,the co-permittee members discharged a total of 497,639 pounds of total nitrogen to the Neuse Estuary during calendar year 2009,approximately 43%of the permit limit of 1,149,391 pounds. We are very proud of the continued accomplishments of the Association and the efforts made by our members to reduce nitrogen loading to the Neuse River Estuary. Neuse Colony - Aqua NC Progress Energy South Granville Water and Sewer Authority This report includes the following information to be submitted by February 28,2010: 1) For the period from January 1 through December 31 of the preceding year,a Discharge Monitoring Report of each co-permittee member's discharge and estuary TN loads and the Association's estuary TN load.; 2) A summary of changes in Association membership,including regionalization of discharges; 3) A detailed summary of all purchases, sales,trades, leases,and other transactions affecting the TN allocations of the Association or its Co- Permittee Members; 4) A description of the Association's TN control strategy for the preceding year and changes for the coming year; 5) A detailed summary of measures taken to control TN discharges; 6) An assessment of progress made, and; 7) A description of efforts planned for the upcoming calendar year(s). 2 1 In compliance with the permit,the annual report for 2009 is as follows: Item 1. The Discharge Monitoring Report of each Co-Permittee Member's Discharge and Estuary Loads and the Association's Estuary TN Load is attached. Co-permittee members discharged a total of 497,639 pounds of total nitrogen(TN)to the Neuse estuary on the basis of individual TN discharges and estuary transport factors established by the Division of Water Quality. The calculated estuary loading is substantially less than the permitted estuary allocation of 1,149,391 pounds(43%of permitted limit). The 1995 TN loading from the NRCA members was 1,784,130 pounds with a flow of 83.808 MGD. The 2009 numbers reflect an average flow of 98.570 MGD and a total loading of 497,639 pounds of TN at the estuary. The NRCA has added 4 new members since the original group reported their baseline loading in 1995. The nitrogen loading reported in 2009 indicates the members have reduced the nitrogen loading from these point sources by 72%over the loading reported in 1995, even while flows have increased. Item 2. Summary of changes in Association membership, including regionalization of discharges: Progress Energy became a member in 2009 and leased nitrogen from the association for the Lee Steam Plant near Goldsboro. This facility did not receive a nitrogen allocation as designated by the Neuse Rules. To control NOx air emissions a process was added that ultimately increased nitrogen in the cooling water stream. Progress Energy purchased off sets from the EEP program and requested membership in the NRCA in 2008 (also LNBA member). Progress Energy is retiring the coal fired units which will eliminate the need to lease nitrogen after 2013. Item 3. Detailed summary of all purchases,sales,trades,leases and other transactions affecting the TN allocations of the Association or its Co-Permittee members. Johnston County acquired 1,645 estuary pounds of nitrogen from Unifi-Kinston, LLC in 2007. Their permit revision has been requested and is pending with NCDENR-DWQ. The Town of Clayton also acquired 1,645 estuary pounds from Unifi-Kinston, LLC. The Town requested a revision in their permit for 716 estuary pounds of the 1,645 lbs with the remainder held in reserve. These transactions will reduce the allocation of Dupont- Kinston, Inc. (formerly Unifi)by 3,290 estuary pounds. Short term lease agreements that have been entered into by NRCA members for 2009 are as follows: The Town of Kenly has leased 1,745 estuary pounds of nitrogen from Johnston County in order for them to comply with their allocation while they upgrade their facility. Aqua NC (Neuse Colony facility)has leased 2,550 estuary pounds from Dupont-Kinston, Inc. in order for them to comply with their allocation while they upgrade their facility. Progress Energy Carolinas has signed a lease with the association to lease up to 9,000 estuary pounds(Burlington Industry allocation)each year for 5 years beginning in 3 January 01,2009. Progress Energy anticipates the retiring the coal fired plant service by December 31,2013 thus not requiring the nitrogen lease in the future. Item 4. Description of the Association's TN control strategy for the preceding year and changes for the coming year: The Association continues to monitor member's compliance with TN allocations and enforces against its members based on the following policy. The Association assessed one member for exceeding their nitrogen allocation in 2008 and collected the assessment. The assessment amount was$118,651.15. In addition,the Bylaws of the Association allow the group to establish policies and procedures and establish a framework to encourage the transfer of TN allocation by members in a manner that is cost effective and that provides incentives for TN reduction that will be most beneficial to the Neuse Estuary. Three members have chosen temporary leases to meet their nitrogen allocations(listed in Item#3). Kenly and Aqua NC (Neuse Colony facility)are planning upgrades to their facilities which should be completed in 2010. Policy and/or rulemaking goals that should be pursued. (1) Point source/non-point source trading may be advantageous and should be pursued. (2) The association reviews and revises its bylaws to continually encourage its membership to reduce nitrogen to the estuary. The Association's enforcement policy was originally based on the offset fees required to be paid to the Ecosystem Enhancement Program. While these fees are being revised by rule, the association continues to revisit their enforcement policy in order to strengthen it in an effort to encourage members to treat to the lowest levels possible. 4 Item S. Detailed summary of measures taken to control TN discharges: A summary from each member is provided below: Town of Apex- The Town continues manipulation of ditch rotors(on/off)in the aerobic zones to create more anoxic zones. Feeding Micro CG(carbon source)to aid in denitrification. South Granville Water and Sewer Authority- Plant operational and optimization study completed. The evaluation resulted in associated process control parameters being adjusted to improve nutrient reductions. Chemical treatment for phosphorous was implemented. Town of Cary-North/South WWTF - These plants are designed to biologically remove nutrients from wastewater without chemical addition. The North plant discharges to Crabtree Creek. The South Plant discharges to Middle Creek. Both facilities remove nitrogen very efficiently and effectively. The north wwtp diverted 568 million gallons (from the Neuse River)to Durham County Triangle WWTF during 2009. Cary also diverted an equivalent of 6,241 lbs. of nitrogen(241.98 million gallons)through its reclaimed water system for 2009. This includes use for irrigation, commercial cooling towers,dust control, road bed compaction,and sewer line cleaning. Johnston County- The County continues to optimize the use of their denitrification filters and to irrigate with reclaimed wastewater(April thru October). The County's facility continues to produce low nitrogen concentration effluent(1.80 mg/L average for 2009). The County is completing an expansion project that will increase its rated capacity from 7.0 to 9.5 mgd. Town of Clayton-The Town of Clayton has completed their reuse project to Pine Hollow Golf Course for nitrogen reduction. Goldsboro- The City of Goldsboro WRF uses biological treatment control to reduce the amount of total nitrogen that is discharged from the plant into the Neuse River. The City also reduces the amount of total nitrogen that is discharged into the Neuse by using reuse water for irrigation at a hay farm and at the golf course,as well as a constructed wetlands polishing project. Town of Kenly- The Town is preparing to upgrade its process controls so that continuous monitoring will result in improvements in their plants nitrogen reduction capabilities. City of Kinston- Kinston is producing a low level nitrogen concentration in their effluent(1.80 mg/L average for 2009). City of New Bern-Plant staff has been reviewing plant data to improve plant's nitrogen reduction capability. 5 City of Raleigh/Neuse River-The facility continues to operate and optimize the existing BNR process. Raleigh is producing a low level nitrogen concentration in their effluent (2.15 mg/L average for 2009). City of Wilson-Continue improvements to the methanol feed system,replaced mixing system to improve RAS management in the BNR system, and expanded the reclaimed water distribution system. City of Raleigh/Little Creek- This facility continues to produce a low TN concentration effluent(2.07 mg/L average for 2009). We have seen that the commitment,experience and knowledge of our members has helped the group to minimize nitrogen loading which we hope will further improve water quality in the Neuse River estuary in the future. 7 Item 7: Description of efforts planned for the upcoming calendar year(s): The following details were provided by our members on their plans for 2010 and beyond. Apex- The town plans to purchase of a biosolids thickener in 2010 to aid/control the decanting of the digester waste streams and internal nutrients. South Granville Water and Sewer Authority- SGWASA plans to continue implementation and recommended improvement from their study. Additional equipment will be purchased to support the BNR process. Town of Cary- The Town plans to continue optimal performance of its two biological nutrient removal water reclamation facilities and reuse system. Johnston County- The County plans to continue the present course of optimization of the denitrification filters and reuse system to reduce nitrogen in plant effluent. Also continue to investigate options for carbon sources for denitrification filters. Methanol costs continue to cause wide cost fluctuations. Clayton-Plan to continue current strategies. Contentnea MSD- CMSD has started upgrade including new headworks,modification to the flow train to aid in nutrient removal,addition of denitrification sand filters,UV disinfection and the construction of an outfall pipe. Completion slated for late fall 2010. Goldsboro- The City of Goldsboro WRF will continue the present strategies on the reduction of the total nitrogen at its water reclamation facility. Kenly - Kenly continues to aggressively pursue enforcement action a local meat processing facility that is contributing high levels of nitrogen and complete the installation of automated process controls. Kinston- Plan to continue current strategies. Town of LaGrange- The Town should complete their reuse project in 2010 to reduce the plant effluent discharge(will be irrigating 100 acres). New Bern- The City of New Bern will continue to operate its land application/reuse program and will strive to improve operation. Raleigh/Neuse River-Plans are to remove two package plants from operation during 2010(3,175 lbs EOP),complete expansion of their reuse system,complete the installation of 10 new denitrification filters,and continue current operating strategies.
