Director Division of Water Quality May 5, 2006 DWQ Project # 06-0650 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Harold Yelle Aiken & Yelle, Associates, P.A. 3755 Benson Drive Raleigh, NC 27609 Subject Property: Brynnan Place Subdivision Ut to Neuse River [030402, 27-(22.5), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Yelle: On April 12, 2006, the Division of Water Quality (DWQ) received your application, submitted as a courtesy copy dated April 10, 2006, to impact 0.0.015 acres of wetland, 158 linear feet of stream and 7,420 square feet of protected riparian buffer to construct the project you describe in your application. On April 21, 2006, the DWQ sent you correspondence formally withdrawing your application due to gross incompleteness. On May 1, 2006, DWQ staff met with you and Jay Keller to review your application and to help you resubmit a complete application. On May 2, 2006, the DWQ received your revised application dated May 1, 2006 (again submitted as a courtesy copy), however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected riparian wetland and/or stream and riparian buffer on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additionally, please note that although applications for buffer approval only do not require an application fee, they are not deemed courtesy copies by the DWQ. Additional Information Requested: 1. Please provide the proposed lot layout as overlays on the site plan. 2. The street located along Lot 4 cannot be permitted as designed (i.e. no logical terminus). Please resubmit your plans showing the street located along Lot 4 terminating into a cul-de-sac. 3. Please submit level spreader worksheets and a signed and notarized Operations and Maintenance Agreements for the proposed level spreaders. 4. Please specify the percent of project imperviousness area based on estimated built-out conditions and provide an inventory of all impervious surfaces (building footprints, roads,'driveways, decks, sidewalks, gravel-covered areas, etc.). Page 2 of 2 May 5, 2006 written stormwater management plan designed to remove 85% TSS according to the latest version of DWQ's Stormwater Best Management Practices manual at a minimum. Additionally, in watersheds within one mile and draining to 303(d) listed waters, as well as watersheds that are classified as nutrient sensitive waters (NSW), water supply waters (WS), trout waters (Tr), high quality waters (HQW), and outstanding resource waters (ORW), the Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed according to latest version of the NCDENR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan when asite-specific stormwater management plan is required. 5. As discussed in our meeting on May 1, 2006, please provide the DWQ with documentation from the City of Raleigh indicating that the Caliber Woods Drive road segment proposed in your application is required by the City of Raleigh for safety purposes. Please respond within three weeks of the date of this letter by sending this information to me in writing and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
