This final permit includes no major changes from the draft permit sent to you on March 29, 2006. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. NC0022985 Trays Island Creek Class C 031302 jrnn Facility requesting expansion flow for existing discharger to Trays Island Creek. The flow would increase from 0.300 MGD to 0.600 MGD. The subdivision is located about 0.1 mile below Fairfield Lake. The stream segment then goes only about 0.1 mile before its confluence with Horsepasture River. Horsepasture River flows less than 0.5 miles before it forms Sapphire Lake. (See attached schematic). Should be aware of the predicted residual CBOD and NBOD from the Fairfield discharge that will be going into the lake. The estimated drainage area and flows at Fairfield Subd: DA = 2.24 mil QA = 8 cfs s7Q10 = 1.0 cfs w7Q10 = 2.0 cfs There are no other existing dischargers to this segment of Trays Island Creek or Horsepasture River. Model results: Level B model contains 3 reaches based on Trays Island Creek flowing into Horsepasture River and one tributary downstream. Model length is only about 0.8 miles. There would be some complexity trying to model into Sapphire Lake. Therefore, stopped the model just upstream of the lake and observed the residual CBOD and NBOD. ■ Summer and winter BODS limits of 30 mg/l and an effluent DO limit of 5 mg/l will protect the instream DO standard of 5 mg/l. • NH3 toxicity limits must be applied at the expansion flow of 0.600 MGD to protect instream toxicity standards. ■ The summer NH3 tox limit is 1.8 mg/l. —v CftP*'V--D AT 2 .o -'1-4 ■ The winter NH3 tox limit is 5.2 mg/l. ■ Will apply limits for fecal coliform = 200/100m1 ■ TRC = 28 ug/l ■ pH = 6-9 SU The End CBOD of 8 mg/l (BODS- 5.38 mg/1) is high to be going to a lake. However there is a half mile se e .ver before it starts to widen into the lake. The DO levels are good, a may want to lower the BOD5 emit to 15 mg/1 a safety factor. Will consult with modeling staff about this. The End NBOD of 1.96 mg/l (NH3= 0.43 mg/1) is double the desired 1 mg/1 NBOD. Require an alternatives analysis be done and give summer limits of 5 mg/L (BOD5) and 1 mg/L (NH3-N) and winter limits of 10 mg/L (BOD5) and 1.8 mg/L (NH3-N) after a three-year period, if the discharge continued. 2. Require an alternatives analysis to meet the above limits, but renew the permit without a change in limits (i.e., no 3-year compliance schedule to meet limits) during that permit cycle. 3. Require an alternatives analysis to meet summer limits of 5 mg/L (BODs) and 2 mg/L (NH3-N) and winter limits of 10 mg/L (BOD5) and 4 mg/L (NH3-N) without a change in limits during that permit cycle. If alternative #1 was implemented in a previous permit, then these limits should be maintained with the exception of ammonia limits, which should be changed to reflect current BAT for facilities with permitted flows of less than 1.0 MGD (2 mg/L and 4 mg/L in the summer and winter, respectively). An alternative analysis is not necessary for these discharges. As per NPDES policy, the facility prepared and submitted an FAA on 12/97. They were also given NH3-N limits of 2 mg/L for summer and 4 mg/L for winter. Unless the facility begins to violate the stream DO standard, more stringent BOD limits will not be implemented. The current limits on BOD and TSS are 30/45. Existing BOD5 limits will be maintained unless Instream data indicates a potential violation of the dissolved oxygen water quality standard. REASONABLE POTENTIAL ANALYSIS: . Reasonable Potential Analysis was not appropriate for any of the pollutants monitored through this permit. PROPOSED CHANGES: • Contact Infornurtion: The new name for the site contact and the address for the facility have been added during this permit renewal. • Monitoring Frequencies: Priority pollutant monitoring on an annual basis has been added to fulfill the permit application requirement in the future. • Instream Monitoring: A review of the Instream data for the facility at the current monitoring locations indicates that the discharge may not have much impact in terms of oxygen consuming wastes. The impact of the effluent with respect to nutrient loading of the receiving stream is unclear. • Limits: A Total Residual Chlorine Limit of 17 ug/1 will be included for all three outfalls in this permit renewal. The estimates of 7Q10 for each location were completed in July 1988 in response to a previous request. The estimated 7Q10 for Trays Island Creek near Cashiers (station id 021842222, drainage area 2.24 sqmi, at U.S. Highway 64) is 1.0 cfs and is equivalent a 7Q10 low -flow yield (expressed as flow per sqmi of drainage area, or cfsm) of about 0.45 cfsm. Notes in the low -flow files indicate this estimate, initially prepared in the early 1970's, is based on assessment of a few discharge measurements made at this site in 1959. The estimated 7Q10 for Horsepasture River above Mud Creek near Cashiers (station id 0218422324, drainage area 11.8 sqmi) is 4.5 cfs and is equivalent to a 7Q10 low -flow yield of about 0.38 cfsm. Notes in the low -flow files indicate that low -flow characteristics estimated for this site on Horsepasture River based flow characteristics at a nearby discontinued gaging station at Horsepasture River near Sapphire (station id 02184240, drainage area 21 sqmi). There are several other nearby USGS partial record stations in this headwaters area of the Savannah River basin. Estimates of the 7Q10 low -flow yield range from 0.3 to 0.7 cfsm, with an average being about 0.45 cfsm. Where the USGS has collected streamflow data in southeastern Jackson County and southwestern Transylvania County, 1 of 3 9/28/2005 8:39 AM FW: 7Q10 Stream Flow Determination discharge records indicates some of the highest yields that occur in North Carolina. It is not uncommon to see estimates of the 7Q10 this basin and the headwaters of the French Broad and Cullasaja Rivers to be around 0.5 cfsm. The most recent statewide low -flow report is USGS Water -Supply Paper 2403, "Low -flow characteristics of streams in North Carolina" (Giese and Mason, 1993). Regional statistical relations presented in this report suggest low -flow yields for the area of southeastern Jackson County and southwestern Transylvania County as being estimated at upwards of 0.6 cfsm. Nevertheless, in the absence of any further data or analyses, I would suggest that the previous estimates determined for the above two sites be considered appropriate with the recognition that higher rates based on yields up to about 0.5 - 0.6 cfsm may be possible. If you still need to have formal estimates for these locations, we can proceed doing so. The charge is $150 for each site and the invoice would be included with a response letter and low -flow estimates. The turnaround time is approximately 4 to 5 weeks. Because of the limited discharge records in this area, I would not anticipate the results of any "updated" estimates being much different from what has been identified in the files. Yowmay want to check with the N.C. Division of Water Quality concerning this information before making any further'efforts to obtain formal estimates. Hope this information is helpful. Thank you.
