Accordingly, we are forwarding the corrected permit pages. Insert the attached pages into your permit; the old pages may be discarded. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This modified permit includes the following changes from your current permit: ) The permittee name has been changed to CWS Systems, Inc. If any parts, measurement frequencies or sampling requirements contained in this specific modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included herein. CWS Systems, Inc. is hereby authorized to: 1. Continue to operate an existing 0.30 MGD wastewater treatment system with the following components: • Two 0.075 MGD extended aeration wastewater treatment system • One 0.150 MGD extended aeration wastewater treatment system • Three effluent chlorine contact/fine solids settling ponds The facility is located in Sapphire Valley at Fairfield Sapphire Subdivision WWTP off U.S. Highway 64 West in Jackson County. 2. After receiving an Authorization to Construct from the Division, construct the necessary facilities to increase plant capacity to 0.80 MGD, and 3. Discharge from said treatment works at the location specified on the attached map into Trays Island Creek, classified C waters in subbasin 03-13-02 of the Savannah River Basin. Utilities, Inc.' We have noted an error that needs to be corrected. The permittee is now incorrectly shown as Carolina Water Service Inc. of NC. The permittee for this facility is and has been CWS Systems, Inc. The draft permit showed this correctly but it has been changed for some reason. Both entities are related "sister" companies but the correct legal permittee should be shown. We would appreciate if you would make these corrections in all applicable locations and issue a revised permit.
