Dear Mr. Highley:
Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated May 9, 1994 (or as subsequently amended).
Compliance with all terms and conditions of the attached permit is the responsibility of the Permittee. Please note that
T15A 08G .0204 of the North Carolina Administrative Code has been interpreted to mean that the Operator in Responsible
Charge is responsible for operation of water pollution control systems.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the tight to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request
must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made,
this permit shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other
permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal
Area Management Act, or any other Federal or Local governmental permits which may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
CWS Systems, Inc.
is hereby authorized to discharge wastewater from a facility located at the
Fairfield Sapphire Subdivision WWTP
U.S. Highway 64 West near Sapphire Valley
Jackson County
to receiving waters designated as Trays Island Creek in the Savannah River Basin in
accordance with effluent limitations, monitoring requirements, and other conditions
set forth in Parts I, II, III and IV hereof.
This permit shall become effective February 1, 2003.
This permit and authorization to discharge shall expire at midnight on August 31, 2007.

Bruce Haas with Carolina Water Service has requested to have the boiler plate language
(part 3, D) substituted in several of their permits with the following language:
"If the facility is in substantial non-compliance with the terms and conditions of the NPDES
permit or governing rules, regulations or laws for 3 consecutive months, the permittee shall
submit a report in such form and detail as required by the Division evaluating these alternatives
and a plan of action within sixty (60) days of notification by the Division."
According to a letter from Preston Howard dated July 29, 1992, the following language should
he substituted:
"In the event that the wastewater treatment facility is in substantial non-compliance for three
consecutive months with the effluent discharge conditions of this NPDES Permit, the permittee
shall, upon demand of the Division, conduct a study evaluating all available wastewater disposal
alternatives and the permittee shall, within sixty days of notification by the Division, submit a
report in such form and detail as required by the Division evaluating these alternatives with
respect to environmental soundness and cost effectiveness."
After a discussion with Bruce Haas, this language is accepted by Carolina Water Service and will
be inserted into all of their new and renewed permits.

We are in receipt of your May 29, 2002 letter and draft permit within. We do have some issues
to address:
1) Our official Permittee name is CWS Systems, Inc. A copy of our renewal intent
letter and short form D application is enclosed showing identity as CWS Systems,
Inc. not Carolina Water Service, Inc.]. Please change in all applicable places.
2) The facility address is 3500 U.S. Highway 64 West, Sapphire, NC 28774. We
apologize for the error in our application. Please change in all applicable places.
3) In section (3)(D), the word "...substantial..." is used but is not defined. This word
can be very subjective and completely open to interpretation. We object to the
phrasing of this section without a more clear definition of the word "substantial'.
