Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This final permit includes no significant changes from the draft permit sent to you on October 10, 2012.
Correction has been made to the facility description, as requested in your December 4, 2012 e-mail message.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that
may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terns, and provisions included herein.
Carolina Water Service, Inc. of North Carolina
is hereby authorized to:
Continue to operate an existing 0.50 MGD wastewater treatment system with the following
components:
• One common equalization basin
• Three separate plants operating in parallel

The facility is located in Norwood Hollow, southeast of Banner Elk, at 291 Norwood Hollow Road,
in Avery County.
2. After receiving an Authorization to Construct from the Division of Water Quality, construct the
necessary facilities to increase the plant capacity to 1.0 MGD.
3. Discharge from said treatment works at the location specified on the attached map into Flattop
Creek, classified C waters in the Watauga River Basin.

A.(3). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) Until expansion above 0.5 MGD
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 72%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase R Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions. The tests will be performed during the months of January, April, July and October. Effluent sampling
for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the
permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two
following months as described in "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP313 for the
pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days

concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility
name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the
comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited
above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid
test and will require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

FACT SHEET FOR EXPEDITED PERMIT RENEWALS
This form must be completed by Permit Writers for all expedited permits which do not require
full Fact Sheets. Expedited permits are generally simple 100% domestics (e.g., schools, mobile
home parks, etc) that can be administratively renewed with minor changes, but can include
facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing,
instream monitoring, compliance concerns).

Hi Martin,
Here are a couple of updates — not great updates, but updates nevertheless
The SOC for Fairfield Harbor is in the Director's Office. I spoke with his administrative assistant yesterday. She's assured
me she has placed it under his nose and advised him there is some time sensitivity in the matter. I think our managers
are getting caught up in matters associated with the change in administrations, but I expect him to sign it today.
Regarding the Sugar Mountain WWTP, the options I can offer you are pretty much what we talked about earlier. The
existing ammonia limit (12 mg/L) at 0.5 MGD flow was established back in the 1980s using a model that sets limits based
upon predicted effects of the discharge on dissolved oxygen in the receiving stream. Another model was used later
when the facility sought the expansion to 1.0 MGD. That model establishes levels protective of toxicity that may result
from ammonia and chlorine (you may note they are much more restrictive). It wasn't available when the ammonia
limits were first established, but when you use the model today, it suggests monthly average ammonia limits be set at
1.3 mg/L in the summer and 2.6 mg/L in the winter for the 0.5 MGD permitted discharge. The 12 mg/L limit has been
retained through the years only because the facility also conducts the toxicity test.
What I can offer for your consideration is removal of the toxicity monitoring requirement at the 0.5 MGD permitted
flow, but only with the inclusion of tighter limits for ammonia. Those limits would be set at 2 & 4 mg/L as the summer
and winter monthly average limits, with associated 10 & 20 mg/L daily maximum limits. I've only eyeballed data for the
facility, but it does appear you may have trouble maintaining consistent compliance with those limits. Let me know
what you'd like to do and I'll get the permit ready for issuance.

Hi Martin,
Thanks for asking about the SOC. I agree with your thinking.
The document was routed through our management for the Director's signature on 12/6. Everything in it is now
straightforward and can't be modified because attorneys have been involved. 1 can't tell you why it's taking so long, but
I'll look into it and find out. Sometimes state government works just like it's stereotyped.
I'll be back in touch later in the day.
On another note, the permit for Hound Ears has been signed. I'll try to get you definitive word on the options for Sugar
Mountain today.

• Supplement to permit cover sheet —facility description —the draft says there is a flowmeter for each of the
three parallel plants which is inaccurate. There is only one common combined flow meter.

I goofed up on this one and didn't include you on the copies when the draft permit was prepared last month. I've
attached a copy now.
This one is a bit unusual. It's 100% domestic flow and it has both ammonia limits (summer only) and toxicity testing.
The permittee has asked if the toxicity testing requirement can be removed from the permit. There's a cryptic note in
the file 1997 where the Asheville Regional Office recommended removal of the tox test, perhaps if the facility would

action was taken during that permitting cycle.
The facility seems to have a pretty good toxicity compliance history, though it's not 100% on the summary. For other
parameters, there have been no reported violations during the past 3 years.

I'm looking into the matter. The decision will be made primarily by our Aquatic Toxicology Unit, but there may be other
permitting considerations (and personalities) at play. From looking at the file, there may be some buy in on a removal of
the tox limit if the ammonia limits were set 2.0 & 4.0 mg/L summer and winter. Those are just hints from the file; I'm
not in a position to offer that to you. From looking at recent data, such limits may place the facility in more compliance
jeopardy than you'd be comfortable with.
On a different topic, do you foresee this WWTP expanding in the future such that the 1.0 mgd set of limits would come
into effect?
I'll try to get you some updates on the status of some other permits we have up here. We've had some administrative
problems that led to issues regarding the public notice of draft permits, which is partially the reason that some of them
have been slow to move to you as final, issued permits.

laundry facility as a customer and as we discussed, the tiny arsenic water treatment backwash.
