Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
and Intent to Assess Civil Penalty, which was issued for BOD daily maximum exceedance on July 19th,
2022, Solids Total Suspended daily maximum exceedance on July 19th, 2022, Solids Total Suspended
monthly average exceedance on July 31st, 2022.
Monitoring Violations for Flow in conduit or thru treatment plant frequency violations on July 9th, 2022,
July 10t, 2022, July 16th, 2022, and July 17th, 2022.
Reporting Violations for Practice Greens field site missing on October 30t, 2022, Practice Areas Field Site
missing on October 30th, 2022, Driving Range Tees Field site missing on October 30th, 2022, Driving Range
Fairways field site missing on October 30th, 2022, found in July 2022 Non -Discharge Monitoring Report.
Aqua's Response:
In July of 2022, Aqua was noticing that the sand filters were not performing as well as they had been.
As our team investigated, they identified a couple valve repairs needing completed and the sand filter
media was not holding up like it should. The identified valves and the filter media were all replaced in
August of 2022.
This notice also states that Aqua failed the Monthly Average for TSS in July. Aqua did take additional
samples in July but they were not properly entered on to the DMR. Our records show that we had a total
of 4.45 with a limit of 5. Attached is the revised DMR.
The missing flow information for July of 2022 was captured at the correct time but was inadvertently
missed being annotated on the DMR. Attached is the revised DMR.
The missing spray fields parameters in October of 2022 were recorded at the proper time and must have
failed to upload when Aqua electronically submitted. Attached is the revised DMR
