This letter is to inform you that the Division has finalized its review and the comment period is now closed
for NPDES permit NC0023191. A final copy of the permit is attached to this letter. This permit is issued pursuant
to the requirements of the North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. In addition, this permit does not affect the legal
requirement to obtain other permits which may be required by the Division of Water Quality or permits required by
the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit
that may be required.

NOTIFICATION OF INTENT TO ISSUE A STATE NPDES PERMIT
On the basis of thorough staff review and application of Article 21 of Chapter 143, General Statutes of
North Carolina, Public Law 92-500 and other lawful standards and regulations, the North Carolina
Environmental Management Commission proposes to issue a permit to discharge to the persons listed
below effective 11/8/99 and subject to special conditions.
Persons wishing to comment upon or object to the proposed determinations are invited to submit same in
writing to the above address no later than 10/22/99. All comments received prior to that date will be
considered in the formulation of final determinations regarding the proposed permit. A public meeting may
be held where the Director of the Division of Environmental Management finds a significant degree of
public interest in a proposed permit.
A copy of the draft permit is available by writing or calling the Division of Environmental Management,

The application and other information may be inspected at these locations during normal office hours.

Public notice of intent to issue a State NPDES permit to the following:
1. NPDES No. NC0023191. David Millsaps, Seven Cedars Mobile Home Park, 1124 Radio Road,
Statesville, NC 28677 has applied for a permit renewal for a facility located at Seven Cedars Mobile
Home Park, 1124 Radio Road, Statesville, Iredell County. The facility discharges 0.010 MGD, of treated
domestic wastewater from one outfall into Third Creek, a Class C stream in the Yadkin -Pee Dee River
Basin which has a 7Q10 flow of 12.2 cfs. No parameters are water quality limited, but this discharge may
affect future allocations.
2. NPDES No. NC0081779. Sackner Products, 166 Orbit Road, Statesville, NC 28677-2600 has
applied for a permit renewal for a facility located at the subject address in Iredell County. The facility
discharges 0.0016 MGD of industrial wastewater from one outfall into an unnamed tributary to Back
Creek, a Class C stream in the Yadkin River Basin which has a 7Q10 flow of 0 cfs and a 30Q2 flow of 0
cfs. No parameters are water quality limited, but this discharge may affect future allocations.

Seven Cedars NIP WWTP was last inspected on January 16, 1998, by Mr.
Roberto L. Scheller of the NC Division of Water Quality Mooresville Regional
Office.
It was noted during a review of the permit that the monitoring of influent at this
facility is inappropriate and should be removed from the permit. Upon
recommendation that I request this modification, this letter hereby serves as a
formal request for permit modification to remove sampling requirements.

violations.
To improve water quality in impaired streams and protect other waters from
further degradation, the specific pollutant sources must be identified. As

resources allow, DWQ intends to develop NPS management strategies for
this waterbody for the second Yadkin -Pee Dee River Basin Plan.
Staff Report (most recent dated February 19,1999): Facility has the

of approximately 100 mobile homes. At the present time, 66 mobile homes
are connected to the WWTP facility. The existing permit contains a flow
limitation of 0.010 MGD, which is more representative of current hydraulic
flow. Facility is classified as a Class II facility. Residuals are currently
disposed of via a septage hauler (Sigmon Environmental) who takes the
residuals to CMUD McAlpine Creek WWTP for disposal.
Region has requested that influent BOD and TSR be removed from the
permit. Region has no other comments in reference to the permitted facility.
Region recommends renewal of permit as requested by Permittee.
• Wasteload Allocation (prepared 2/9/93): Limits were determined to be
watery q a Ity limited. 01) limit was set at 16 mg/l. Ammonia limit was set
at 9.0 mg/l, DO limit was set at 6.0 mg/l, TSS limit was set at 30.0 mg/l,
Fecal Coliform was set at 200 /100ml.
Instream monitoring was recommended for DO, Temperature, Fecal
Coliform, and Conductivity.
• DMR Review:
Facility appears to be operating within the constraints of their existing permit
conditions. BOD levels range from 1.74 mg/l to 11.0 mg/l, TSS levels range
from 5.5 m to 3.5 mg/l over the period from 1998 to Apn-TF999 (monthly
average levels).

On September 26, 1994, the Division of Water Quality issued NPDES Permit No. NCO023191
to David Millsaps. A review of the permit file has indicated that an error was inadvertently made in
the permit. Accordingly, we are forwarding herewith modifications to the subject permit to correct
the error. These permit modifications are issued to delete influent sampling from the effluent page.
Please find enclosed an amended effluent page which should be inserted into your permit. The
old effluent page should be discarded. All other terms and conditions contained in the original
permit remain unchanged and in full effect. These permit modifications are issued pursuant to the
requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon written

5. Directions to Site: From the junction of Hwy. 70 and SR 2359 (Bethesda Rd.) east of the
City of Statesville, travel south on SR 2359 approx. 2.3 miles and tam left into the entrance
of the MHP. The W WTP site is located at the end of this road.

observed in the receiving stream. The area is generally rural and the receiving stream
is primarily used for secondary recreation.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
a. Volume of Wastewater: 0.025 MGD (Design Capacity)
b. What is the current permitted capacity: P.010 MGD (see Part IV below).

d. Description of existing or substantially constructed WWT facilities: The existing
W WT facilities consist of a bar screen, an aeration basin (diffused), a clarifier, a V-
notch weir, a gravel filtration tank, chlorine contact tank with tablet chlorination, and
three (3) non -aerated sludge holding tanks.
e. Description of proposed treatment facilities: There are no proposed W WT facilities.
f. Possible toxic impacts to surface waters: Chlorine is added during the treatment
process.
2. Residuals handling and Disposal Scheme: Residuals are currently disposed of via a septage
hauler (Sigmon Environmental) who takes the residuals to CMUD's McAlpine Creek
WWTP for disposal.

PART IV - EVALUATION AND RECOMMENDATIONS
The existing WWT facility serving the Seven Cedars Mobile Home Park has a design
capacity of 0.025 MGD which would allow the connection of approximately 100 2-bedroom mobile
homes. At the present time, 66 mobile homes are connected to the WWT facility. The Permit,
however, contains a flow limitation of 0.010 MGD, which is more representative of current
hydraulic flow.
The Permit also contains influent monitoring for BOD and TSR. The collection of this data
is considered unnecessary since the data provides little, if any benefit in the day -today operation of
the W WTP. It is recommended that the influent monitoring of the aforementioned parameters be
removed at Permit reissuance. _
The permittee proposes no other changes and/or modifications to the Permit at this time.
It is recommended that the permit be renewed as requested.
