The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *February 1987) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 33 % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform Quarter monitoring using this procedure to establish compliance with the permit condition. The first test will be pperforrm�tmed after thirty days from issuance of this permit during the months of Fib ,46t /Wu . Effluent sampling for this testing shall be performed at the NP S p rmitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address: Attention: Technical Services Branch North Carolina Division of Environmental Management P.O. Box 27687 Raleigh, N.C. 27611 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). The monitoring shall be performed as a Daphnia pulex or Ceriodaphnia 48 hour static test, using effluent collected as a 24 hour composite. The LC50 of this effluent using the previously stated methodology may not at any time be less than ,Q t. Effluent samples for self -monitoring purposes must be obtained dur- ing representative effluent discharge below all waste treatment (including disinfection). There is to be no removal of chlorine by any method prior to testing. The first test will be performed within thirty days from issuance of this permit. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the appropriate parameter code. (N00004685), this letter is to provide coumlents on the draft permit and to request additional information necessary for complete review of the draft permit. The first oamnt pertains to the Wasteload Allocation Approval Form (attached to the daft permit) which contains recommended limits for zinc (0.2 mg/1) miq and copper (0.06 mg/1), yet these parameters are not limited in the daft permit. It seems that Section 15 NCAC.0211(b)(4) (Action Levels for Toxic Substances) should apply to this discharge and thus limit copper and zinc to ,yJ�* 0.015 mg/1 and 0.05 mg/1 respectively or with an appropriate toxicity limit. ►� Please provide specific reasons why zinc and copper are not being limited in ,y.� the permit. The second comment applicable to PPG Industries, Inc., is that Federal NPDES regulations applicable to delegated State programs require that industries in the primary categories, which includes textile mills, provide analyses for certain pollutants including metals and organic toxic pollutants (see 40 CFR Section 122.21(g)(7)). The draft permit contains monitoring for chromium, lead, zinc, copper and COD. Based on these parameters, it Sm'---c annrnnriate to rernlire chronic toxicity testing of the effluent from outfall serial number 001. In surmlary, EPA requests the following information for PPG Industries in order to complete our review: 1. A completed application, including all analyses testing as required by 40 CFR Section 122.21. �, ) 2. Documentation of past bioassays conducted using effluent from the Iv'/ subject facility and the results of any such bioassays; also any wastewater characterization which might serve to indicate or identify which contaminants are responsible for any observed toxicity to aquatic organisms. Any orders, consent agreements, letters or any other docu mentatian �� of how DEM intends to control the discharge of toxic substances from this facility, what bionmitoring is required and what would constitute a violation of North Carolina regulations regarding the discharge of toxic substances. 4. Until such information is provided, along with a completed application, EPA review of this permit cannot proceed, and issuance of this permit until such review is completed would be contrary to the MQA and NpDES regulations.
