Good morning Ed, The pre-treatment system specified in the permit application was never mobilized to/installed at the site. MOD CLT Property, LLC pursued the discharge permit for dewatering associated with their deep foundations, but by the time the permit was issued, they had already completed the deep foundations. All the groundwater dewatered during that work was containerized in frac tanks and disposed to an appropriately permitted facility. There has not been additional dewatering at the site since the deep foundation work was completed nor is dewatering expected during future phases of the project as the remaining ground disturbance is all quite shallow, so they would like to rescind the permit. Was the system ever installed? The MRO has no record of the system installation. The MRO has not record of any dewatering or treatment activities associated with this permit. (Terracon) requests that the North Carolina Department of Environmental Quality (NCDEQ) rescind the National Pollutant Discharge Elimination System (NPDES) Permit Number NC0090085 for the Radius Dilworth Overlook facility located at 615 East Morehead Street in Charlotte, Mecklenburg County, North Carolina. This permit was issued with an effective discharge date of November 1, 2022 and allows for the discharge of pre-treated groundwater generated during construction -related dewatering associated with deep foundation installations. The deep foundations for MOD's construction project were already completed prior to the issuance of the permit and the remaining ground disturbance required for the project is limited to shallow excavations that are unlikely to encounter groundwater. In absence of the permit, dewatered groundwater was collected in tankers and disposed of offsite. Future discharges are not expected, and as such, the permit will not be required. Based on the above, Terracon requests that NCDEQ rescind Permit Number NC0090085 and waive the requirement for electronic Discharge Monitoring Reporting for the calendar months November and December 2022.
