Atlas Environmental staff completed the delineation on June 2, June 3, August 24, October 19, and November 16, 2022, and assessed the presence of five perennial streams, three intermittent streams, and nine abutting wetlands. The review area mostly consists of forested land and agricultural fields along with a power line that runs Southwest through the property. CH 100, 1630 LF (0.116 acres), contains sections of both perennial and intermittent flow and is located near the Eastern portion of the review area continuing off property flowing in a Southernly direction. CH 300, a perennial channel, is approximately 2457 LF (0.614 acres) and is located along the West and Southwest portion of the review area. CH 300 meanders on and off property along the Western boundary of the property. CH 400, 216 LF (0.009 acres), is an intermittent draw that converges into CH 300 near the Southern boundary. CH 500, 190 LF (0.009 acres), and intermittent channel also converges into CH 300 near the Sothern boundary, flowing North. CH 600, 590 LF (0.035 acres), a perennial channel is located near the Southern border of the property flowing South into CH 300. CH 700, 45 LF (0.002 acres), starts offsite and converges into CH 300 and is a perennial channel. CH 800, 1115 LF (0.124 acres), is located on the Western portion of the property area and flows in a Southernly until it converges into CH 300 off property. CH 800 is also a perennial channel. All the wetlands in the review area are abutting streams. WL 2200 (N0.095 acres) , WL 2300 (N0.030 acres), WL 2400 (N 0.022 acres), WL 2500 (N 0.003 acres), and WL 2600 (N0.001 acres) all abut CH 100, starting South to North going upstream, in the perennial stretch of the stream. WL 5000 (N0.049 acres) is located near the Southern border and ties into CH 500. WL 6000 (N0.152 acres) and WL 6100 (N0.242 acres) tie into CH 600 and are located near the Northern reaches of CH 600. The project purpose is for the construction of three industrial warehouse buildings and associated truck and trailer parking, employee parking, stormwater treatment, utilities, and additional required infrastructure. Seven impacts are proposed for the construction including wetland impacts as W1 and W2, as well as two impacts to intermittent streams S3 and S4, and three impacts to perennial streams S1, S2, and S5. Impact W1 is being permitted under the NWP 39 is for the permanent fill to the entirety of WL 6000 (0.152 acre). Impact W2, also permitted under NWP 39, 0.242 acres of permanent fill to the entirety of wetland WL 6100. Both impacts to wetlands are for the construction of one building and subsequent parking. Impact S3 is being permitted under the NWP 39 and is a permanent impact of 232 LF (0.02 acres) to CH 100 in the intermittent reach of the channel for construction of the entrance road and parking. Impact S4 is a permanent impact of (N0.002 acres) of CH 400 (N27 LF, 0.002 acres) for SCM slope fill. This impact falls under an NWP 18. All three impacts to perennial channels are permitted under the NWP 39. Impact S1 is for 399 LF (0.025 acre) to CH 600 for permanent parking, driveway access, and slope fill. Impact S2 is for 28 LF (0.003 acre) and is impacting CH 100 near the existing culvert for the construction of an entrance road. Impact S5 is a temporary impact of 40' (0.006 acre) for the proposed installation of a sanitary sewer. Impacts have been significantly reduced by the proposed design and location of the buildings and other infrastructure. The permittee has avoided and minimized impacts through multiple methods including avoiding impact to the floodplain and using 3:1 side slopes grading. Additional minimization efforts include constructing retaining walls and headwalls. The total linear footage of streams on site is 6,243 LF. Over 89% of the streams onsite will not be permanently impacted. The total acreage of wetland on the site is 0.595 acre and almost 34% is not being impacted. Wetland impacts exceed 0.099 acre so Corps and DWR mitigation is required. Stream impacts exceed 0.02 acre and 300 linear feet so Corps and DWR mitigation is required. The proposed mitigation is as follows: 2:1 ratio for perennial stream impacts, 1.5:1 ratio for intermittent stream impacts, and a 2:1 ratio for wetland impacts. The following mitigation is proposed to compensate for project impacts: 854 credits for perennial stream impacts, 389 credits for intermittent stream impacts, and 0.788 credits for riparian wetland impacts. See the enclosed NC Division of Mitigation Services acceptance letter for stream and wetland mitigation credits proposal. RES does not have any wetland credits and will not have enough stream credits if they sell the expected credits that have been spoken for in the next month. An SOA is included from RES but it is not anticipated that these stream credits will be available when the 404 and 401 are issued for this project.
