Good afternoon IRT, Hidden Lake, LLC (Sponsor) has submitted a proposed modification to their instrument for the Hidden Lake Mitigation Bank, which is attached for your review along with a cover letter. These documents have also been posted to the RIBITS Cyber Repository for the bank site (see link and instructions provided below). If you are unable to access the document or prefer to have a hard copy mailed to you, please let me know as soon as possible, and I will arrange to get you a copy of the modification. Proposed Modification: The changes to the instrument are proposed to eliminate the condition that all mitigation requirements accepted by the bank be fulfilled with restoration credits at a 1:1 ratio, and that preservation credits only be used for mitigation requirements in excess of a 1:1 ratio. In order to make this change, the Sponsor has proposed to reassess credits generated through wetland preservation activities at the bank at a 10:1 ratio, resulting in a reduction of preservation credits from 151 to 75.4, and a reduction of the total wetland credit provided by the bank from 199.4 to 123.8. Please note that this proposal was previously discussed during the NCIRT meeting held on August 9, 2022. Following our initial review of the proposed changes, we have determined that this modification can be processed using the streamlined review procedures outlined in Section 332.8(g)(2) of the 2008 Federal Mitigation Rule, which requires an IRT review period of 30 calendar days from the date of this email notification. Please provide any comments by 5 PM on January 6t", 2023.
