The Scout Mitigation Site is part of the RES Yadkin 01 Umbrella Mitigation Bank, located approximately eight miles west of Clemmons and five miles northwest of Bermuda Run, in Davie County, North Carolina. The 13.22-acre project presents stream restoration and enhancement generating 2,918 warm Stream Mitigation Units (SMU), after non- standard width buffer adjustments, along Hauser Creek and two unnamed tributaries in the Upper Yadkin Watershed of the Upper Pee Dee River Basin (03040101). The purpose of this letter is to confirm the MY2 release of credits for this mitigation site. Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the RES Yadkin 01 Umbrella Mitigation Bank, approved December 4, 2019; and the site -specific Scout Final Mitigation Plan dated August 2019, ten percent (10%) of the mitigation site's total restoration and enhancement credits shall be available for sale immediately upon completion of the required tasks pursuant to the Mitigation Plan. By copy of this correspondence, we confirm that you have satisfied the above requirements for the MY2 credit release for all parcels within the bank; and 291.8 SMU's constituting 10% of the mitigation site's total restoration and enhancement credits are now available for sale. Including this credit release, 1,459 SMU's have now been released for the Scout Mitigation Site which totals, 50% of the approved credit. The NCIRT did not visit the site in 2022, however after review of the MY2 report the following comments were provided by agency representatives regarding concerns noted with the MY2 conditions: USACE comments: 1. USACE appreciates the quick response to address easement encroachments, besides additional signage, was the encroachment addressed with the entity responsible? 2. When supplemental planting occurs after the MY2 dormant season, consider agency concerns for low diversity with new plant selection and distribution. 3. I'm glad black walnut was not present in MY2 veg plots. Are they being removed from the remainder of the site or just veg plots? 4. Please continue to track the progress of previous IRT comments through future monitoring reports. DWR comments: 1. DWR appreciates the swift response to address new mowing encroachments, as well as planned supplemental planting to enhance species diversity. DWR was concerned with the low diversity reported in multiple veg plots. 2. DWR reiterates our recommendation to check monitoring gauges quarterly. It would've been helpful to have late summer flow data from CHI. DWR is not requesting a site visit. We support the proposed credit release. With the MY2 review by the IRT and subsequent credit release completed, please move forward with providing the appropriate bond for the monitoring phase of the project as approved in the Scout final mitigation plan/UMBI. This involves releasing the MY2 Performance Bond No. SUR0069926. As reported by RES, the revised penal sum at Year 2 credit release should be $83,495.71 per the bond reduction schedule for a reduction amount of $16,699.14. Thank you for your time and cooperation.
