Mr. Prunchak, 

On December 8, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water 
Quality Certification from the Division for the subject project. The Division has determined that your application is 
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:  

1. The PCN indicates that the project will not involve the expenditure of public funds or the use of public land; 
however, the applicant is the Town of Lake Lure and the project will occur on land owned by the Town. Please 
clarify whether public funds or lands will be involved. If so, please indicate whether a SEPA environmental 
document is required and the status of that document, if applicable. If finalized, please provide a copy of the 
SEPA final approval letter. The Division cannot take action on a project for which a SEPA environmental 
document is being prepared or under review. [15A NCAC 01C .0107] 

Pursuant to Title 15A NCAC 02H .0502(c) and 15A NCAC 01C .0107, the applicant shall furnish all of the above requested 
information for the proper consideration of the application. Please provide your response by January 30, 2022. If all of 
the requested information is not received, the Division will be unable to approve the application and it will be denied as 
incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete 
application package and appropriate fee.
