Dear Mr. Medric:
This correspondence is in reference to the Monitoring Year 2 (MY2) Report dated
October 2022, submitted in support of your request for the fourth credit release for the Puncheon
Fork Mitigation Site, part of the RES French Broad 05 Umbrella Mitigation Bank, located
approximately five miles northwest of Swiss in Madison County, North Carolina. The purpose
of this letter is to confirm the MY2 release of credits for this mitigation site.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish
the RES French Broad 05 Umbrella Mitigation Bank, approved May 30, 2019; the site -specific
Puncheon Fork Final Mitigation Plan dated May 22, 2020 and a final plan addendum received
September 4, 2020, ten percent (10%) of the mitigation site's total restoration and enhancement
credits shall be available for sale immediately upon completion of the required tasks pursuant to
the Mitigation Plan.
By copy of this correspondence, we confirm that you have satisfied the above
requirements for the MY2 release for all parcels within the bank; 283.6 SMU's and 0.098
WMU's constituting 10% of the mitigation site's total restoration and enhancement credits are
now available for sale.
Although the IRT did not visit this site as part of the MY2 evaluation, we have reviewed
the Year 2 Monitoring Report and offer the following comments, which should be addressed
during next year's monitoring review:
Todd Tugwell (USACE) comments:
I. You indicated that there are plans to install Flexi Baffles during low flow conditions
during the 2023 growing season 2023. Please be sure to provide photographs of the
installation in the MY3 report.
2. We appreciate the documentation of the repairs conducted at J135-C. Please continue
to watch these areas closely and provide an update in the MY3 monitoring report.
