However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on February 8, 2023. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant’s responsibility. In addition, any omissions made in responding to the outstanding items in Sections A through F, or failure to provide the additional information on or before the above requested date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2). Please reference the subject application number when providing the requested information. Please provide a cover letter that lists all of the items included in the application package, as well as a brief description of the requested permitting action. B. Application Fee: 1. Not applicable. C. Application: 1. Our understanding is that the applicant wishes to have the facility designation changed from “construction only” to “continued operation”. Unfortunately, a certified application was not provided that pertains to this submittal. Please complete and certify Form RWPI 06-16. 2. Our records do not show Mr. Jose F. Rosado as having signature authority as described in 15A NCAC 02T .0106 for Lake Point Properties on Santeetlah, LLC. A review of the Secretary of State business registration records shows only two managing members, Mr. Jack Minski and Mr. Jose Minski. Mr. Jack Minski has signed on behalf of Lake Point Properties on Santeetlah, LLC in the past. Please have either Mr. Minksi sign the application or complete the signature authority delegation letter (Form NDSDAL 01-20) to grant Mr. Jose F. Rosado the authority to sign permit applications in accordance with 15A NCAC 02T .0106(c). D. Existing Permit: 1. Please address the following concerning Condition I.1 of the existing permit: a. The provided Plat does not appear to delineate the exact location of the recreational amenity which was required in Condition I.1. Please amend the Plat to clearly delineate the recreational amenity. b. The provided Plat has not been fully executed by the Graham County Register of Deeds. A copy of the recorded Plat (including the delineated recreational amenity) is required to satisfy Condition I.1. 2. Please address the following concerning Condition I.2 of the existing permit: a. The provided Declaration of Covenants and By-Laws documents appear to be the original, unamended documents. Please provide the amended copy that includes information about the proposed recreational amenity. This information shall include, at minimum, the residential owners financial responsibilities to upkeep and maintain the recreational amenity through the contracted landscaping company. This amended document is required to satisfy Condition I.2. b. A budget showing how much each residential owner must annually pay to maintain the recreational amenity does not appear to be included in the provided documents. A copy of this budget is required to satisfy Condition I.2. 3. The submittal included a signed and sealed page from the RWNC 06-16 Non-Conjunctive Utilization application form. This page was signed by Mr. William E. Fenner, Jr. Unfortunately, this certification is not the Engineer’s Certification form required to satisfy Condition I.3 of the existing permit. Please have Mr. Fenner certify the attached Engineer’s Certification form. Mr. Jose F. Rosado January 9, 2023 Page 3 of 3 4. A Site Map containing the information required by Condition I.6 does not appear to have been submitted. The submittal included the Plat as well as site plan documents for the Santeetlah facility; however, these did not depict all of the required information. Please provide a site map that shows the location and identification of the monitoring wells, the location and identification of major components of the waste disposal system, the perimeters of all irrigation area fields/zones as outlined in Attachment B of the permit, location and ownership of property boundaries within 500 feet of the irrigation area (including road/rail right-of-ways and easements), delineation of the waste and compliance boundaries, distance measurements verifying all setbacks are being met, and delineation of the 100-year floodplain. 5. The facility description within the existing permit appears to be inaccurate based on the site visit performed by Asheville Regional Office staff. The current facility description states that Santeetlah Lakeside WWTP is to serve “26 bedrooms on 13 residential lots, a private bathhouse restroom, and a 1,500 square foot (ft2) food stand”. Please provide a description of the planned development (bedrooms/lots, other amenities) to be connected to the reclaimed water system. E. Operator in Responsible Charge (ORC) Documentation: 1. The Operator Designation Form cannot be processed by the Non-Discharge Branch. Please submit the Operator Designation form to the Water Pollution Control System Operators Certification Commission (WPCSOCC) via email (certadin@ncdenr.gov). If you need further assistance, please contact the Certification Staff (URL: https://deq.nc.gov/about/divisions/water-resources/operator- certification/wastewater-operator/staff-ww). 2. The provided contract with Environmental, Inc. outlines duties for “No Flow Status” only. Has Environmental, Inc. been contracted for facility operations with flow through the treatment plant? F. Operation & Maintenance Plan: 1. The provided Operation & Maintenance (O&M) Plan does not meet the requirements of 15A NCAC 02U .0801. Please provide an O&M Plan that: a. Describes the operation of the system in detail to show what operations are necessary for the system to function and by whom the operations are to be conducted; b. Includes a sampling and monitoring plan to evaluate quality of reclaimed water within the distribution system to provide quality assurance at the time of reuse, and specify actions to be taken in response to unsatisfactory monitoring results; c. Provides a map of all reclaimed water distribution lines and record drawings of all reclaimed water utilization systems under the Permittee’s control; d. Describes anticipated maintenance of the system; e. Includes provisions for safety measures, including restriction of access to the site and equipment as required in the 02U rules; and f. Includes spill control provisions, including response to upsets and bypasses (including control, containment and remediation), and contact information for plant personnel, emergency responders, and regulatory agencies.
