Subject: Request for Additional Information, Western North Carolina Stream Initiative - Cedar Creek (Jones Site),
Rutherford County (DWR Project #20221354)
Mr. Eckardt,
On September 29, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is received:
1. The PCN indicates that an environmental document is being prepared under the requirements of NEPA or SEPA
and is not finalized. The Division cannot take action on a project for which a SEPA environmental document is
being prepared or under review. Please clarify if a SEPA environmental document is required and if so, please
provide a copy of the SEPA final approval letter. [15A NCAC 01C .0107] Section G.1.b of the PCN was
inadvertently answered incorrectly as "Yes". The proposed work is a non -compensatory stream restoration and
enhancement project that does not require preparation of an environmental document pursuant to the
requirement of NEPA or SEPA. "No" should have been selected for this section of the PCN.
2. Note 2 of Sheets 3.1 and 3.2 indicates that all stream banks require stabilization within 7 days, whereas Note 9
of the same sheets indicates all disturbance within 25' of top of bank must be stabilized by the end of day.
Construction Note 2 of Sheet 0.3 also indicates that work shall be limited to an area that can be stabilized by the
end of each work day. Please clarify the intended construction practice, ensuring that it will not cause or
contribute to a violation of water quality standards or result in secondary or cumulative impacts that cause or
contribute to a violation of water quality standards. [15A NCAC 02H .0506(b)(2) and (3)] Notes 2 and 9 on Sheets
3.1 and 3.2 and Note 2 on Sheet 0.3 have been revised for consistency.
3. The PCN states that in order to avoid or minimize impacts, new channel will be constructed offline where
feasible. Please clarify the intended construction practice when offline construction is not feasible. Typically, a
pump around system is used to avoid excavation in flowing water. If this method will be used, please provide a
detail for the pump around system. [15A NCAC 02H .0506(b)(2) and (3)] Pump around is the proposed method
when working in live stream. A construction note has been added on Sheet 0.3 (Note 6) and Sheets 3.1 and 3.2
(Note 12). A pump around detail has been added to sheet 5.6.
Pursuant to Title 15A NCAC 02H .0502(c) and 15A NCAC 01C .0107, the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please provide your response by December 16, 2022. If all of
the requested information is not received, the Division will be unable to approve the application and it will be denied as
incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete
application package and appropriate fee.
