The purpose of this correspondence is to respond to an email request for additional information that we
received from Sam Daily with the US Army Corps of Engineers on December 29, 2022. The Corps' request is
in bold and italics and our response immediately follows in standard text.
Per our discussion, the Corps requests that you provide additional avoidance and
minimization regarding Impact G1 (lot fill). Based on the revised design drawings
(provided on 1211212022), Impact G1 would result from single family residential lots,
roadway infrastructure (including a cul-de-sac) and storm water control measures. There
is also an impact associated with gravity, sewer installation, but this impact is temporary
and would be restored. As proposed, there does not appear to be any effort in avoiding
and minimizing this wetland impact.
We have worked with the client to avoid and minimize wetland fills at Impact G1. The 27% reduction in
requested impacts can be achieved in a manner that maintains the $2.7 million dollars in revenue that are
needed to offset initial project costs and maintain the expected rate of return.
Minimizing wetland impacts at location G1 were achieved by reducing the length of the cul de sac and shifting
the location of the stormwater basin. The attached site plan shows the proposed revisions that are being
drafted in anticipation of their approval. The reduction in the length of the road and the relocation of the storm
feature allowed for some savings that allowed for the developer to lose some developable area. Further
reductions are not plainly obvious to the developer or the project engineers.
The minimization is achieved through the use of a wall that shortens the length of the road.
The new plan avoids impacts to the higher quality portions of the Impact G1 wetland area. The wetlands in the
avoided areas have a longer hydro period, more diverse vegetation (and less invasive species), and a more
forested wetland structure. The saturation and minor ponding are good amphibian habitat and the edges
provide songbird habitat. The ecological conditions allow for the area to act as a wildlife refuge area and
dispersal corridor. This dispersal corridor is associated with the contiguous riparian corridors along the totality
of T1 from the little river to the adjacent properties.
The applicant will mitigate for the losses at Impact G1 at a 2:1 ratio and will mitigate for the conversion of
wetlands at impact S1 at a 1:1 ratio.
