Salem Street Apex, NC 27502 Subject Property: Whitehall Manor Greenway Ut to Beaver Creek [030605, 16-41-10-(0.5), WS1V, NSW] AFTER-THE-FACT REQUEST FOR MORE INFORMATION Dear Mr. Robertson: On August 17, 2007, the Division of Water Quality (DWQ) received your After-the-Fact application dated August 17, 2007, to fill or otherwise impact 0.05 acres of 404/Wetland, 148 linear feet perennial stream impact, and 115 linear feet intermittent stream impact, to construct the proposed residential subdivision. On September 10, 2007 and October 2, 2007, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: You reported your After-the-Fact impact at Grappenhall Drive (Impact Area No. 2) to be 148 linear feet of perennial stream in your PCN application, however, this Office measured 172 linear feet of perennial stream impact at this location based on your submitted materials and a site visit conducted on September 28, 2007. Therefore, 172 linear feet of compensatory stream mitigation is required for this project. Please provide a compensatory mitigation plan. The plan must conform to the requirements of 15A NCAC 2H .0500 and must be appropriate to the type of impacts proposed. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
