Bog 1415, Nags Head, NC 27959 Authorizing development in Dare County 2004 S. Croatan Highway, in Kill Devil Hills , as requested in the permittee's application dated 7/30/2013 including the attached workplan drawings (8) 2 dated 7/25/13 and 6 dated revised 7/31/13 This permit, issued on tine 18 2014 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below Any violation of these terms may be subject to fines, imprisonment or civil action, or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with removing all existing improvements and constructing four warehouse units with associated water lines, utilities, parking area, and septic system within and adjacent to the fresh pond Public Water Supply Area of Environmental Concern (AEC) between Nags Head and Kill Devil Hills, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 264-3901 for this determination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or 4 other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be i This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Davis, Director ivision of Coastal Management This permit and its conditions are hereby accepted Signature of Permittee Mulehide, LLC ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit # 109-13 Page 2 of 2 NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan shall be filedat least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889 2) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 3) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Management 4) The N.C. Division of Energy, Mineral, and Land Resources approved this project under stormwater management rules of the Environmental Management Commission by way of Stormwater Permit No. SW7130802 which was issued on 9/23/2013. Any violation of the permit approved by the DEMLR will be considered a violation of this CAMA permit. General 5) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 6) No vegetated wetlands shall be excavated or filled, even temporarily. 7) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit.
