Good afternoon,
The Division of Energy, Mineral and Land Resources received and accepted a State Stormwater Management Permit
Application for the subject project on January 31, 2022 and requested additional information on March 31, 2022. A
review of the file and delivery logs indicates that, as of this date, the information requested on March 31, 2022 has not
been received in this Office within the stipulated timeframe. Per the requirements of Title 15A NCAC 02H .1042(3)(a)(ii)
of the Stormwater Management Rules, this Office is hereby returning the subject application as incomplete. The $505.00
application fee has been forfeited and a new fee will need to be provided if you choose to resubmit this application in
the future.

Current review times are approximately 90 days. We have not closed out/returned this project so the review would pick
up where we last left off. If you want, you can request that the current Application be withdrawn and reapply under the
Fast -Track process (Review times under Fast -Track are no more than 30 days once we receive a complete submission). I
do not currently have availability in my schedule for a meeting. If there are some particular comments that you would
like clarification on, I can provide that (just email me).

Hi Jim,
This project was paused at some point after original comments were received but we are moving forward again and are
looking for an update on typical review times. We assumed since this project sat dormant for several months that we
would be starting over with a new application package unless otherwise directed. Also, is there an opportunity to request a
fast track or expedited review process?
Either way, we are wondering if you would be available to schedule a call to go over the original comments with ourselves
and the developer to ensure we capture and address the issues appropriately?

process generally take 30 — 45 calendar days, but can take up to 90 calendar days per statute (our other reviewer, Corey
Anen, no longer works for the State, so this review will probably be closer to 45 days than 30). Please upload all

Good Afternoon,
We received your application for a new post -construction stormwater permit on 12/6/2021. At this time, the submission
is not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 1/7/2021) so that we may accept the project and begin
the review process, otherwise, the project will be returned as administratively incomplete.
• 1x original signed (in pen) & sealed hard copy of the latest version of the Supplement-EZ Form. This item is
required per Section V and Section VI, 3 of the Application. The provided form appears to be a photocopy.
• 1x hard copy of the complete Operation & Maintenance Agreement Form. This item is required per Section V
and Section VI, 3 of the Application. Please provide the other pages of this form that outline the maintenance
requirements for the proposed wet pond. NOTE: You may wish to get a second original, signed & notarized hard
copy of the O&M Agreement Form to keep with the permittee's copy of the permit since an original copy is
required to be recorded with the Register of Deeds.
• Please provide an original (in pen) signature for each Property Owner in Section IX of the Application and please
include the contact information (address, phone number, & email) for each property owner in Section III of the
Application (duplicate the pages of the Application as needed). This item is required per 15A NCAC 02H
.1042(2)(a). If Shane Seagle has the legal authority to sign on behalf of all of the Property Owners, please
provide documentation of this.
• Please provide official documentation showing that W M James Jones has signatory authority (Section VI, 11) for
the permittee, "North State Development, LLU (The Secretary of State information for North State
Development does not list him).
• 2x signed & sealed hard copies of the plan sheets. It is noted that the letter of transmittal stated that the plans
were coming in a separate shipment, but as of today, we have not received that shipment (I'll let you know if we
do receive them). Please also note that plan sets should be folded, not rolled (we do not have the ability to store
rolled plans). You are not required to provide extraneous plan sheets, such as utility sheets, lighting plans,
roadway marking plans, etc... that do not directly pertain to the stormwater post -construction review (if you
have difficulty folding the plan sets, please consider removing unneeded plan sheets). The requirements for
what must be included in the plan sets is outlined in Section IV, 8 of the Application and 15A NCAC 02H
.1042(2)(g).
NOTE: This is an administrative completeness review, not a detailed engineering review. The following items were noted
during this review, but do not need to be addressed for this submission to be administratively complete and accepted
for review (but these issues, and possibly others, will probably be brough up during the engineering review):
• The drainage area 1 column on the Drainage Areas Page of the Supplement-EZ Form should be filled out and
should reflect the drainage area to the proposed wet pond (the entire site column should be an accounting of
the Bua within the entire site/project area).
• Any off -site portions of the drainage area to the proposed wet pond that are not bypassed must be accounted
for at their full build -out potential (typically 100% BUA) per 15A NCAC 02H .1003(3)(b).
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process generally take 30 — 45 calendar days, but can take up to
90 calendar days per statute (one of our two reviewer positions is currently vacant so this review will probably be closer
to 45 days than 30).
