On December 12, 2014, the Division of Water Resources (Division) received your application
dated December 17, 2014, requesting a Major Variance from the Division for the subject
project. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until all of the following information is received:
1. Please re- submit your application on the current variance application form available at

2. This office does not have a record of receiving a Certification of Completion for the minor
variance issued on August 20, 2012. You can find the form at the following link:

Additional Forms and Documents. Please submit a completed certification of completion
for the minor variance issued previously.
3. Buffer mitigation is required for the proposed Zone 1 and Zone 2 buffer impacts. Please
submit a mitigation plan detailing how the impact will be mitigated. You may elect to
perform buffer restoration or pay a compensatory mitigation fee. The following link under
Options for Compensatory Mitigation provides contact information for private mitigation
banks in the Neuse River Basin (outside of the Falls Lake Watershed) with riparian buffer
credits available:

Enhancement to purchase buffer restoration credits (919-7O7-Q976). |f you choose to
satisfy the buffer mitigation required with e compensatory mitigation fee, then you will
need to provide a letter from the private bank or NCEEP indicating the availability of buffer

5. Stormwater treatment must be provided for an area equal to the new deck area added
within the riparian buffer, which totals 1,140.4 square feet as indicated in your application.
We will accept treatment of the same amount of area from existing stormwater
discharge(s) in lieu of treating stormwater from the proposed deck area. Your application
indicates that "storrnvvater runoff onexisting permit covers run off for #3,#4,#S,#O and #7.
Your minor variance approval for Units #1 and #2 required stormwater treatment of 431
square feet of impervious area. The stormnvvater management plan included abioretentiun
area designed to treat 655 square feet of roof drainage from Unit #1 resulting in 224 square
feet of excess sLronmvvatertreatment. Please provide astornnvvater management plan for
treating stormwater runoff from the remaining 916.4 square feet of impervious area that is

is not received in writing within 30 calendar days uf receipt ofthis letter, the Division will be
unable to approve the application and it will bereturned. The return of this project vviU
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC27G99-16I7.
Please be aware that you have no authorization under the Buffer Rules for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
