This document replaces the MRTF attached to the Nationwide Permit (NWP) 39 verification dated 10/26/2022; all other aspects of this NWP 39 verification remain unchanged. The MRTF included as part of Special Condition 1 of the above referenced NWP verification specified that wetland credits were to be procured from Falling Creek Umbrella Mitigation Bank, Falling Creek Mitigation Site. However, due to a lack of available credits from the Falling Creek Mitigation Site at the time of NWP verification, and per the permittee's request (see below), the compensatory mitigation requirement is to be satisfied through purchase of credits from the Falling Creek Umbrella Mitigation Bank, McClenny Acres II Mitigation Site. As no revised NWP 39 verification tearsheet will be issued, please retain a copy of this email and attachment for your records. Please let me know if you have any questions. All the wetland credits will be coming from our McClenny Acres II site. I believe we were told in the past to include all our banks that could service the credit needs in these HUCs on our SOAs. That way if a bank sold out from one specific one, there would be the other banks written on the MRTF as well. Not sure if that is something that is still preferred or not. I believe the mitigation has been paid but he cannot move forward with the MRTF the way the bank is listed right now. I've included the SOA and the 404 for your convenience.
