Description of projects area and activity: This verification authorizes the permanent discharge of fill material into 0.015 acre (139 linear feet) of stream channel (0.008 acre [87 linear feet] of which are considered a permanent loss) and 0.059 acre of riparian non-riverine wetlands, and the temporary discharge of fill material into 0.003 acre (20 linear feet) of stream channel, necessary for the construction of access and infrastructure for the Ruffin Road Townhomes multi-familv residential development. Minor Discharges SEE ATTACHED NWP GENERAL, REGIONAL, AND/OR SPECIAL CONDITIONS Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached Conditions, your application signed and dated 10/21/2022, and the enclosed plans "Ruffin Rd Wetland and Stream Impact Map" coversheet and sheets 2 through 5, dated 11/22/2022. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA), prior to beginning work you must contact the N.C. Stream banks in temporary construction access impact areas in Stream SB (Impact TS 2) and Bull Run (Impacts TS 3 must be restored to pre -construction grade and contour, stabilized with natural fiber matting, and seeded with a regionally appropriate native riparian seed mix. 2. The finished top elevation of rip rap placed in the stream bed of Bull Run must not exceed that of the original stream bed. 3. Please note that the Ruffin Road townhomes project is considered cumulative with all current and future phases of the of this development with respect to compensatory mitigation and Nationwide Permit thresholds. As such, impacts permitted for this project (SAW-2019-01994) are considered cumulative with impacts proposed for any future phases. Current known cumulative impacts to waters of the US for the Ruffin Road townhomes single and complete project include a total loss of 0.008 acre (87 linear feet) of stream channel and 0.059 acre of wetlands (which are for stormwater management facilities), or a total loss of waters of the US of 0.067acre.
