Good Afternoon Ms. Homewood, Attached is an alternative stabilization design for Country Line Creek based on our discussions with you and subsequent internal discussions. The updated design utilizes step pools to reduce stream velocity and stays within the limits of the existing ROW. The design places the upstream mat edge downstream of the existing bedrock step and with the placement of sturdy fill from the edge of the visible bedrock downstream to the pipeline the step feature would be transitioned to an in -channel pool. The graded aggregate base and articulating mat would be shaped as it exits the pool, over the pipeline, and immediately downstream which will direct low or normal flow to exit the pool in one area. The mat immediately downstream of the pipeline would mimic the current bedrock step and water would drop into the rip rap plunge pool (-10' linear stream feet). On either side of the rip rap plunge pool, two layers of large stones would be embedded at the toe of the slopes. We wanted to get this updated drawing to you this week in case you were planning on working next week or it will be waiting for you at the new year. Mr Bailey— We plan to submit updated fill amounts based on this design but thought it made sense to wait until everyone has had a chance to take a look at these revised drawings. Additional information is necessary to complete my review. Please provide the following items within 30 days of this email. Please note that the application will be considered on hold until receipt of a complete response. 1. DWR has significant concerns that the proposed design creates an armored streambed at a slope of 18%. This is an extreme slope and as evidenced by the current stream conditions, the existing stream substrate is already subject to erosion and incision. DWR would typically expect to see a step pool design for extreme grade changes such as those proposed. We acknowledge that a scour pool has been designed at the end of the proposed project, however our experience is that this may not be sufficient to reduce the instream velocity during high flow events. Please consider alternative stabilization designs for this location or provide DWR with detailed stream velocity calculations/moedling in support of the current design. I have reviewed the information and require additional information before proceeding with verifying the use of Nationwide Permit (NWP) 12 (https://saw- reg.usace.army.mil/NWP2021/NWP12.pdf). Please note the required items below: 1) Given the proximity of this project to known populations of threatened/endangered aquatic species, as well as potentially suitable habitat for these species occurring within the project Action Area, we will initiate informal consultation with the US Fish and Wildlife Service (USFWS). Please note that the Corps cannot verify the use of a NWP until Section 7 consultation is complete; 2) This project appears to require an Individual 401 Water Quality Certification from NCDWR; please note that the Corps cannot verify the use of any NWP without a valid 401 WQC. For NCDWR: After review of the submitted PCN for the above referenced project, and NWP 12 Water Quality General Certification No. 4245, dated 12/18/2020 (https://saw- reg.usace.army.mil/NWP2021/NWP12 StateWQC.pdf), it appears an Individual 401 Water Quality Certification (WQC) is required from the NCDWR for the proposed activities. The PCN received by our office provided the 9 required elements for an individual WQC and constitutes the Corps initial receipt of the WQC application. The reasonable period of time (RPOT) for you to act on this WQC request will begin is 120 calendar days from the date of the complete WQC request. Unless NCDWR is granted a time review extension, the date upon which a waiver of the WQC will occur if you do not act on the certification is 2/10/2023. Please let me know if you have any questions.
