8. PROJECT SUMMARY:
The applicant proposes to replace and newly construct a 1,751-foot long vinyl bulkhead, a six slip
docking facility including a shoreside dock, seven finger piers, and boathouse, a gravel parking area,
excavate an area of uplands to widen canal, and repair a 100-foot long wood groin adjacent to a
manmade canal and Pasquotank River on his property located at lots 209, 42, 43, 44 Heron Court,
Pelican Pointe Subdivision, off Weeksville Rd. (NC 3445), Elizabeth City, Pasquotank County.
PROJECT SETTING
The location of the proposed development site is at the end of an approximate 146-acre Pelican Pointe
Subdivision, north of the U.S. Coast Guard Air Station, off NC 3445, Elizabeth City, Pasquotank County
and on a manmade canal and Pasquotank River. The proposed development will take place on and
adjacent to lots 209, 42, 43, and 44 Heron Court, totaling 3.71 acres. The lots have an elevation of
approximately 4-feet above normal water level (NWL), and have Mattapex (Md) very fine sandy loam.
To access the lots, drive into the subdivision from Weeksville Rd. (NC 344S), remain straight all the way
to the back of the subdivision where Heron Court ends at a cul-de-sac. The property had historically
been used for agricultural crop production prior to 2003, when it was permitted fora 213 unit single-
family residential building lot and an adult community subdivision (CAMA MP#160-03).
Lots 42, 43, and 44 have a failing wood bulkhead and lot 209 has a partial bulkhead, which was
permitted under CAMA Major Permit #107-95. A 100-foot long wood groin exists off lot 42 and extends
into Pasquotank River. The pilings appear to be in good shape; however, the sheathing is missing. The
lots have not been developed and contain no impervious surfaces. The lots have the appearance of a
peninsula, being surrounded by the manmade canal Pelican Creek to the west and Pasquotank River to the
east. The property is vegetated with native weeds and lawn grasses, and lightly vegetated with Loblolly
pine, sweet gum, and maple trees. There were no Coastal Wetlands, Submerged Aquatic Vegetation
(SAV) or evidence of Section 404 Wetlands located on the property or in the waterbody on November 14,
2006.
The canal is approximately 151-feet wide adjacent Lot 209 and runs in an east-west direction, then
decreases to approximately 50-feet wide and heads north immediately south of Lot 42. The canal widens
to approximately 500 feet adjacent Lot 42, where a narrow peninsula across the basin from Lot 42 forms
an approximate 50-foot long by 50-foot wide opening to Pasquotank River. Water depths near the canal
shore adjacent Lot 209 are -4 feet to -5 feet, and reach approximately -7 feet in the center of the canal.
The adjacent riparian properties west of Lot 209 and south of Lot 44 are similar to the applicant's
property. The riparian lots are cleared, flat, and vegetated with native grasses with a few pine, maple
and sweet gum trees. There are currently no impervious surfaces or single-family dwellings on either lot.
The riparian lot on the Pasquotank River side has a bulkhead, while the riparian lot on the canal side has
a natural shrub shoreline.
Reviews of available information suggest that there are no known archeological sites or geologic
formations associated with the applicant's property. The waters of Pasquotank River in this area are

classified as SC by the Division of Environmental Management and are closed to shellfish harvesting.
DEVELOPMENT PROPOSAL
The applicant proposes to replace 1,670-feet of existing wood bulkhead 2-feet waterward of NWL with
vinyl bulkhead. The bulkhead replacement adjacent the basin entrance to Pasquotank River will be in the
same alignment as the old bulkhead to prevent narrowing the basin entrance. An additional 81-feet of
new vinyl bulkhead is proposed adjacent the remaining natural shoreline of lot 209 at an average 2-feet,
maximum 7-feet waterward NWL in order to stabilize the shoreline adjacent a proposed 6-slip docking
facility. In order to widen the canal for safer access to the docking facility, the applicant proposes
excavation of Estuarine Shoreline Area of Environmental Concern (AEC) by removal of 1,020 square
feet of uplands to a depth of 6-feet below NWL. The bulkhead will be installed with filter cloth on
landward side prior to backfill placement. A silt fence will be placed along the shoreline adjacent to
proposed highground excavation until bulkhead is installed adjacent excavation area. If the excavation
will be performed during the moratorium between February 15 and October 31 of any given year, a
sediment fence will be installed across canal immediately north of excavation area prior to excavation
activity and will remain in place 72 hours post excavation to prevent turbidity from entering Pasquotank
River. An excavator, backhoe and dump truck will be used to excavate the high ground area, construct
bulkhead, and transport the spoil to Lot 43 behind a silt fence until the spoil is dry for use as bulkhead
backfill. Remaining backfill for the bulkhead will be clean, dry sand from an upland pit.
The applicant proposes a 6-slip docking facility adjacent Lot 209 in the manmade canal to Pasquotank
River. The entire mooring area will be 2,800 square feet of Public Trust Area (PTA), Estuarine Waters
(EW) Area of Environmental Concern (AEC). The docking facility will include seven 20-foot long by
average 3-feet wide finger piers to form three 15-foot wide slips and three 9-foot wide slips. The docking
facility will be roofed by a proposed 80-foot long by 35-foot wide boathouse with sides extending no
further than half way down from the wall plates. It will be located 15-feet from the riparian lot to the
west and extend to -5.3 feet water depth. All the slips will be located in approximate -5 feet water depth.
The docking facility will extend 35-feet into the manmade canal. The applicant proposes three 20-foot
long by 15-foot wide and three 20-foot long by 9-foot wide boatlifts with associated 24 mooring pilings
(four pilings per lift), one in each of the six slips. The applicant also proposes to repair a 100-foot long
by 1-foot wide wood groin adjacent Lot 42 on Pasquotank River by replacing the sheathing to existing
piling structure.
The applicant proposes an 80-foot long by 6-foot wide shoreside dock consisting of elevated, slatted wood
parallel to the proposed bulkhead adjacent the mooring facility. A 60-foot long by 6-foot wide elevated,
slatted wood walkway will connect Heron Court to approximately the middle of the shoreside dock. The
applicant also proposes the construction of a 1,975 square foot gravel parking area using afront-end
loader. The parking area will be located on Lot 209 south of and in close proximity to the mooring
facility with access to Heron Court and the majority located in the Estuarine Shoreline (ES) AEC. The
parking area will accommodate approximately four vehicles.

ANTICIPATED IMPACTS
The proposed bulkhead alignment with backfill will result in the filling of approximately 3,502 square
feet of Public Trust Area (PTA), Estuarine Waters (EW) Area of Environmental Concern (AEC).
Approximately 400 cubic yards of fill material will be placed below NWL for the backfill. Land
disturbance for installation of the bulkhead tiebacks will occur over approximately 17,510 square feet on
upland Estuarine Shoreline (ES) AEC.
The proposed 1,020 square feet of upland excavation from ES AEC will result in 110 cubic yards of
upland excavation and 230 cubic yards of excavation below NWL to a depth of -6 feet. There will be an
approximate 800 square foot spoil area located outside the 30-foot buffer and in the ES AEC until it is
used as bulkhead backfill.
The proposed 6-slip docking facility will shade 2,800 square feet of PTA EW AEC. This will include the
finger piers under the proposed boathouse. Also proposed is 100 square feet of fill in PTA EW AEC for
wood groin repair, which will include replacement of wood sheathing to existing piling alignment.
The proposed shoreside dock and walkway will disturb 750 square feet of uplands in the ES AEC and 90
square feet of uplands outside the ES AEC with pervious surface. The proposed gravel parking area will
fill 1,571 square feet of uplands in the 404 square feet of uplands outside the ES AEC with impervious
surface. This will result in 8.7 % impervious surface in the ES AEC.
Temporary water turbidity will occur during construction. The use of a filter cloth behind the bulkhead
will minimize future erosion and turbidity.

The proposed project is located within a manmade canal connected to the Pasquotank River
within Lots 209, 42, 43 and 44 off Heron Courtin Pelican Point Subdivision located off Weeksville
Road (Hwy 34}, Elizabeth City, Pasquotank County. Total square footage of Lot 209 is 22,651
s.f. (0.52 ac.), Lot 42 is 69,696 s.f. (1.6 ac.), Lot 43 is 52,272 s.f. (1.2 ac.) and Lot 44 is 16,988
s.f. (0.39 ac.).
PROPOSED CONSTRUCTION:
Water dependant structures within 30' buffer: Shoreline stabilization with the
construction of 1,751' linear feet of vinyl/wood bulkhead (1,670 replacement bulkhead
along the shoreline of Lots 42, 43 and 44 and 81' new constructed bulkhead within Lot
209). The existing 100' Groin located in front lot 42 will be repaired.
Construction within Public trust waters: Dock with seven (7) finger piers for six (6)
boat slips; covered boathouse with six (6) boat lifts for the six boat slips. Excavation
below NWL to achieve -6.0 water depth to widen manmade canal. Repair existing groin
Upland disturbancelstructures: wooden walkway, parking area and highground
excavation within Lot 209.
EXISTING ENVIRONMENT: Lots 209, 42, 43 and 44 are currently pine forested land with no
existing development (excluding existing dilapidated bulkhead) or impervious surfaces. There are
no Section 404 wetlands within the project area (confirmed by AEC). Submerged aquatic
vegetation (SAV's) was not present during AEC site visits and when water depths were taken by
AEC. Coastal wetlands do not exist within Lots 209, 42, 43 or 44 or within this subdivision. The
adjacent shoreline (River Glen S/D) in the~rrtanmade canal is 151 feet away from Lot 209
shoreline and 116' from the proposed 35' boathouse, therefore, this project is consistent with the
with 15A NCAC 07H.0208(b)(6)(iii). Boathouses exceed the 400 s.f. limitation to allow for
adequate and safe portage of six foot boats to accommodate six property owners within the
Pelican Point Subdivision. The shoreline along Lot 42 consists. of a dilapidated wooden bulkhead
and a 100' groin to be repaired in its existing location under this modification request. The existing
groin consists of the 6" x 6" pilings on 4' centers with 4" x 6" whalers for horizontal support and no
vertical sheeting remaining. The repair of the groin will include the replacement of the vertical
sheeting and replacing any pilings or whalers that are damaged. Lot 42 is adjacent to the
manmade basin north of Lot 209. The shoreline along Lot 43 consists of a dilapidated wooded
bulkhead to be replaced under this modification request. Lot 43 is adjacent to the Pasquotank
River, east of Lot 42. The shoreline along Lot 44 consists of a dilapidated wooden bulkhead to be
replaced under this modification request. Lot 44 is adjacent to the Pasquotank River, south of Lot
43. The Proposed bulkhead ends at the south end (shoreline) of Lot 44 adjacent to Lot 45.
Existing water depths are sufficient for this project to not require dredging or future dredging.
Water depth adjacent to the proposed dock is -5.3 feet. Water depth within the center of the
manmade canal is -7.0+ feet.
CONSTRUCTION ACTIVITIES: Dock, finger piers, walkway, groin, and boathouse will be
constructed using hydraulic pump and hand tools. Highground excavation will take place using
an excavator and dump truck. Excavated highground material along with excavated material
below NWL to -6.0 feet, will be utilized as backfill for the proposed bulkhead within Lots 209, 42,
43 and 44. Bulkhead alignment along Lot 209 (within the manmade canal) will be an average of
2' and a maximum of 7'. Bulkhead alignment along Lots 42, 43 and 44 will be an average of 2'
and maximum of 2'. The bulkhead replacement for Lot 42 at the entrance to the manmade canal
will be constructed in the same location in order to avoid narrowing the canal entrance. The
existing groin in front of lot 42 will be repaired in its existing location. Gravel for parking area
within the Common Area will be trucked in and spread with a front end loader.

The proposed improvements will allow continued stabilization of the shoreline along Lots 42, 43
and 44 and also allow stabilization along Lot 209 shoreline where boating traffic will take place.
In addition the repair of the groin will help prevent continued shoaling in the canal/basin entrance.
The proposed boathouse and seven boat slips with lifts will allow six property owners within
Pelican Point docking and boating access within the manmade canal to access the Pasquotank
River for recreational purposes. Highground excavation allows safe passage of boats within the
manmade canal allowing safe access to the Pasquotank River and safe portage.
