This meeting will occur in the Ground Floor Hearing Room of the Archdale Building at 512 N.
Salisbury St, Raleigh, NC. Commissioners, staff, and scheduled speakers will attend in-person. Limited seating will be available to the public. Face coverings are optional for employees and visitors. I. Preliminary Matters
1. Call to Order and Notice of NCGS 138A-15………………….Chair Deerhake
North Carolina General Statute 138A-15 mandates that at the beginning of any meeting
of a board, the chair shall remind all members of their duty to avoid conflicts of interest
under this Subchapter. The chair also shall inquire as to whether there is any known
conflict of interest with respect to any matters coming before the board at the time.
2. Approval of Draft Minutes from November 9, 2022 Meeting
II. Action Item
1. Request for a Major Variance from the Jordan Lake Riparian Area Protection Rule by Toll NC II, LP for the Pines at Wake Crossing at 0 Parlier Drive, Apex NC (Sue Homewood, Division of Water Resources)
A request has been received for the Water Quality Committee to grant a Major Variance from the Jordan Lake Riparian Area Protection Rule to Toll NC II, LP for the excavation of 14,110 square feet buffer within the Pines at Wake Crossing Residential Subdivision to resolve a violation of FEMA regulations. The Town of Apex has been designated authority to administer the Jordan Lake Riparian Area Protection Rule. The Town of Apex Board of Adjustments approved a Major Variance from the Town of Apex Unified Development Ordinance in accordance with the requirements in Section 2.3.8(D) and have submitted their Findings of Fact and Conclusions of Law for consideration by the Water Quality Committee of the Environmental Management Commission.

Semi-Annual Progress Report on 1,4 dioxane in the Cape Fear River Basin (Jenny Graznak and Michael Montebello, Division of Water Resources) DEQ is required to provide semi-annual progress reports to the Water Quality Committee describing: a. Ongoing and planned surface water and discharge sampling efforts, including the
results of such sampling, b. Identification of point source dischargers of 1,4-dioxane in the Cape Fear River Basin upstream of any drinking water intake, c. Public update on the actions DEQ is taking to reduce 1,4-dioxane concentrations in the Basin from sources identified under paragraph (b), including incorporation of 1,4-dioxane
limits into the NPDES permits if the agency determines that the discharger has a reasonable potential to violate applicable water quality standards, and d. A brief explanation of DEQ’s reasoning regarding the foregoing and the expected time for completion.
