1@44.9' timber floor on I-Beams with timber caps and piles. The proposed bridge consists of 2@45', 2@55' 21" cored slab with 4'-0" caps. The effective FEMA floodplain
mapping indicates that the proposed crossing is located in Zone AE and was studied by Limited Detail Study methods. No deck drains are required for the bridge.

Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your project overlaps during a

Nationwide Conservation Measures describes measures that can help avoid and minimize impacts to all birds at any location year round.
Implementation of these measures is particularly important when birds are most likely to occur in the project area. When birds may be
breeding in the area, identifying the locations of any active nests and avoiding their destruction is a very helpful impact minimization measure.

What does IPaC use to generate the list of migratory birds that potentially occur in my speci ed location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCC) and other species that may warrant special
attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based
on a growing collection of survey, banding, and citizen science datasets and is queried and ltered to return a list of those birds reported as
occurring in the 10km grid cell(s) which your project intersects, and that have been identi ed as warranting special attention because they are a
BCC species in that area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to o shore activities or
development.
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds

The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian Knowledge Network (AKN).
This data is derived from a growing collection of survey, banding, and citizen science datasets.
Probability of presence data is continuously being updated as new and better information becomes available. To learn more about how the
probability of presence graphs are produced and how to interpret them, go the Probability of Presence Summary and then click on the "Tell me
about these graphs" link.
How do I know if a bird is breeding, wintering or migrating in my area?
To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your
location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the pro les provided for each bird in
your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area,
there may be nests present at some point within the timeframe speci ed. If "Breeds elsewhere" is indicated, then the bird likely does not breed
in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA
(including Hawaii, the Paci c Islands, Puerto Rico, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and
3. "Non-BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts

Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how
your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to
generate the migratory birds potentially occurring in my speci ed location". Please be aware this report provides the "probability of presence"
of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey e ort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high
survey e ort is the key component. If the survey e ort is high, then the probability of presence score can be viewed as more dependable. In
contrast, a low survey e ort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is
not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be
there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to con rm presence, and

Impacts to NWI wetlands and other aquatic habitats may be subject to regulation under Section 404 of the Clean Water Act,
or other State/Federal statutes.

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location, type and
size of these resources. The maps are prepared from the analysis of high altitude imagery. Wetlands are identi ed based on vegetation, visible
hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on-the-ground inspection of any particular site may
result in revision of the wetland boundaries or classi cation established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of
the collateral data and the amount of ground truth veri cation work conducted. Metadata should be consulted to determine the date of the
source imagery used and any mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or eld work. There may be occasional di erences in
polygon boundaries or classi cations between the information depicted on the map and the actual conditions on site.

Data exclusions
Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data
source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal
zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tuber cid worm reefs) have also been excluded
from the inventory. These habitats, because of their depth, go undetected by aerial imagery.
Data precautions
Federal, state, and local regulatory agencies with jurisdiction over wetlands may de ne and describe wetlands in a di erent manner than that
used in this inventory. There is no attempt, in either the design or products of this inventory, to de ne the limits of proprietary jurisdiction of
any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies. Persons
intending to engage in activities involving modi cations within or adjacent to wetland areas should seek the advice of appropriate Federal, state,
or local agencies concerning speci ed agency regulatory programs and proprietary jurisdictions that may a ect such activities.

NCDOT Division 5 to update the status of Bald eagle and Harperella for the above
referenced project.
Bald eagle: IPaC does NOT identify potential for this species at the project location. Habitat
for Bald eagle primarily consists of mature forest in proximity to large bodies of open water
for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 miles of
open water. Based on an examination of aerial photography and the site investigation
conducted on March 2, 2022, potential habitat exists within the project study area due to the
presence of Kerr Lake. A review of NCNHP records, March 7, 2022, revealed no known
occurrences of this species within 1.0 mile of the project location. No bald eagles or nest
trees were observed in the project study area or within 660 feet of the study area during a
visual survey conducted on March 2, 2022. Due to the lack of known occurrences and lack of
species or nest trees observed during the visual survey, a biological opinion of No Effect is
rendered for this species.
Harperella: Habitat for this species does not exist within the project study area. The study
area is comprised mainly of hardwoods and young pines alongside the existing bridge
structure over Kerr Lake which does not consist of rocky, sandy, or gravelly shoals on the
edges of a swift flowing stream system. Additionally, review of the NCNHP database
indicates no known occurrences of the species within 1.0 miles of the study area. Due to the
lack of suitable habitat and no known occurrences, a biological opinion of No Effect is
rendered for this species.

Species: Bald eagle (Haliaeetus leucocephalus)
Survey Date: May 31, 2019
Habitat Description/Survey Information: A desktop-GIS assessment of the study area, as
well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits (the
review area), was performed on May 29, 2019 using 2016 color aerial photography. The
study area spans a southwestern leg of John H. Kerr Reservoir (an immersed floodplain of
Johnson Creek), which is large enough and sufficiently open to be considered a potential
feeding source for bald eagle. Trees along the shoreline offer suitable roosting and nesting
habitat for bald eagle. Since there is suitable habitat within the study area, a survey of the
study area and the area within 660 feet of the project limits was conducted during the May
31, 2019 site visit. No bald eagle nests occur in the study area and withi n 660 feet of the
project limits, and no individuals of this species were identified during the field survey.
Length of Survey: 1/2 Person Hour
Findings: Due to the field survey results and minimal impact anticipated for this project, it
has been determined that this project is unlikely to adversely affect this species

Habitat Description/Survey Information: The day of the site visit, a visit to the Snow Hill
Road location in Durham, NC found smooth coneflower to be in bloom. Habitat for this

systematic survey of all areas of potential habitat was conducted on May 31,2019. No
individuals of this species were identified during the survey.

Dear Mr. Murray:
Coast Guard review of your proposed project as provided in your letter and in your email dated
January 25, 2022, is complete.
Based on the documentation provided and our research, it is determined that a Coast Guard
Bridge Permit will not be required for the proposed highway fixed bridge – SR 1442 (Dave
Winston Road) across Johnson Creek/John H. Kerr Reservoir/Roanoke River, at location
[36.534198, -78.610343] near Stovall, Granville County, NC.
The project will be placed in our Coast Guard Authorization Act of 1982 exemption category for
the location and structure described above and is valid for five years from the date of this
letter. The Coast Guard Authorization Act of 1982 exempts bridge projects from Coast Guard
Bridge permits when the bridge project crosses non-tidal waters which are not used, susceptible
to use in their natural condition, or susceptible to use by reasonable improvement as a means to
transport interstate commerce. The following conditions apply to this determination:
a. If the construction project on the above bridge does not commence within this time, you
must contact this office for reaffirmation of this determination.
b. Future bridge projects along the above waterway will have to be independently evaluated
before they may be considered for placement in the Coast Guard Authorization Act of
1982 exemption category. This includes modification, replacement and removal of the
above bridge, following its initial construction.
In addition, the requirement to display navigational lighting at the aforementioned bridge is
hereby waived, as per Title 33 Code of Federal Regulations, Part 118.40(b). This waiver may be
rescinded at any time in the future should nighttime navigation through the proposed bridge be
increased to a level determined by the District Commander to warrant lighting.

A. Project Description:
The proposed project involves replacing Bridge No. 143 on SR 1442 (Dave Winston Road)
over Johnson Creek/John H. Kerr Reservoir in Granville County. The replacement
structure will be a bridge approximately 170 feet long providing a minimum 33-foot six-inch
clear roadway width. The bridge will include two 11-foot lanes and five-foot nine-inch
offsets. The proposed offsets and 42-inch rails will accommodate bicycles. The bridge
length is based on preliminary design information and is set by hydraulic requirements. The
roadway grade of the new structure will be approximately the same as the existing
structure.
Project construction will extend approximately 270 feet from the southern and
approximately 240 feet from the northern end of the new bridge. Two 11-foot lanes will be
provided along SR 1442 within the project limits. Minimum two-foot wide grass shoulders
are required (seven-foot wide shoulders are required if guardrail is utilized). Eight-foot six-
inch shoulders (four-foot paved) with guardrail will be provided if rock plating is required.
Traffic will be detoured off-site during construction (see Figure 1).
B. Description of Need and Purpose:
The purpose of the proposed project is to replace an obsolete bridge. The bridge is
considered functionally obsolete due to a structural evaluation appraisal of 3 out of 9 and a
deck geometry appraisal of 2 out of 9 according to Federal Highway Administration (FHWA)
standards.
Bridge No. 143 was built in 1960. The bridge is 161 feet long, with a clear roadway width of
approximately 19 feet. The bridge has a timber floor on I-beams. The substructure consists
of timber caps, concrete pier caps, timber piles, and concrete columns.
NCDOT Bridge Management Unit records indicate Bridge No. 143 has a sufficiency rating
of 30.87 out of a possible 100 for a new structure.
The superstructure and substructure of Bridge No. 143 have timber elements that are fifty-
seven years old. Timber components have a typical life expectancy between 40 to 50
years due to the natural deterioration rate of wood. Rehabilitation of a timber structure is
generally practical only when a few elements are damaged or prematurely deteriorated.

However, past a certain degree of deterioration, most timber elements become impractical
to maintain and upon eligibility are programmed for replacement. Timber components of
Bridge No. 143 are experiencing an increasing degree of deterioration that can no longer
be addressed by reasonable maintenance activities, therefore the bridge is approaching the
end of its useful life.
In addition, components of the concrete substructure have experienced an increasing
degree of deterioration that can no longer be addressed by maintenance activities. The
posted weight limit on the bridge is 12 tons for single vehicles and 16 tons for truck-tractor
semi-trailers. Replacement of the bridge will result in safer traffic operations.

E. Special Project Information:
Cost:The proposed project is included in the 2016-2025 State Transportation
Improvement Program (STIP). Right of way acquisition and construction are scheduled for
federal fiscal years 2017 and 2018, respectively. The estimated costs for the project,
based on the current STIP, are as follows:

The total cost for the project included in the approved 2016-2025 STIP and draft 2017-
2027 STIP is $1,738,000. This total includes $238,000 for right of way acquisition and

Accidents:Crash records for a recent ten year period indicate one single-car accident
occurred in the vicinity of the project. The accident involved a vehicle that ran off the road
and struck the face of the guardrail, resulting in injury and property damage. Alcohol was
suspected to be a factor. Bridge geometry was not noted as a factor.
Pedestrian and Bicycle Accommodations:This portion of SR 1442 is not a part of a
STIP bicycle project. In addition, the Granville County Comprehensive Transportation
Plan does not identify this portion of SR 1442 as an existing or recommended designated
bicycle route. Furthermore, the Kerr Tar Regional Council of Governments’ North Carolina
Lakes District Regional Bike Plan does not identify any existing or proposed bicycle
facilities along this portion of SR 1442. However, in coordination with the Kerr Tar
Regional Council of Governments, NCDOT has agreed to provide 42-inch rails on the
bridge to accommodate bicycles. The proposed five-foot nine-inch offsets will
accommodate bicycles.
Bridge Demolition: Bridge Demolition: Bridge No. 143 includes a superstructure
composed of timber and steel and can be removed by standard techniques with no
resulting fill. The substructure is composed of two end bents constructed of timber caps on
timber piles and two interior bents on concrete piers. A temporary causeway will likely be
used to remove the interior bents, which will result in temporary fill in the stream.
Alternatives Discussion:
No Build –The no build alternative would result in eventually closing the road which is
unacceptable given the volume of traffic served by SR 1442.
Rehabilitation – The bridge was constructed in 1960; the concrete and timber
components of the bridge substructure are reaching the end of their useful life.
Rehabilitation would require replacing the concrete and timber components which
would constitute effectively replacing the bridge.
Offsite Detour –Bridge No. 143 will be replaced on the existing alignment. Traffic will
be detoured offsite (see Figure 1) during the construction period. The offsite detour was
evaluated using the NCDOT Guidelines for Evaluation of Offsite Detours for Bridge
Replacement Projects and was found to be acceptable.
The offsite detour for this project would include SR 1431 (Grassy Creek Road), SR
1445 (Herbert Faucet Road), SR 1448 (Pittard Road), SR 1443 (Harry Davis Road), VA
723 (Shiney Rock Road) and VA 725 (Williamson Road).The speed limit on all routes
along the detour is 55 miles per hour. The detour for the average local road user living
on SR 1442 in the project vicinity would result in up to approximately six minutes
additional travel time (up to 5.25 miles additional travel). The detour for the average

through-traffic road user would result in up to approximately 3.5 minutes additional
travel time (up to three miles additional travel). Up to a 12-month duration of
construction is expected on this project.
Based on the Guidelines, the criteria above indicate that the preference of an offsite
detour requires a stronger evaluation of other project variables. In this case, Granville
County Schools Transportation Crew Lead has indicated that an offsite detour is
acceptable. Granville County’s Emergency Management Coordinator has indicated that
the project would have a moderate impact on emergency response if the bridge were
closed for up to 12 months.
Onsite Detour – An onsite detour was not evaluated due to the presence of an
acceptable offsite detour.
Staged Construction –Staged construction was not considered because of the
availability of an acceptable offsite detour.
New Alignment – Given that the alignment for SR 1442 is acceptable, a new
alignment was not considered as an alternative
Agency Comments:
As part of project scoping, comments were requested from state, federal and local
agencies.
The North Carolina Division of Water Resources (DWR), in a memorandum dated April 27,
2017, recommended that highly protective sediment and erosion control Best
Management Practices (BMPs) be implemented to reduce the risk of nutrient runoff to
Johnson Creek. NCDOT will implement BMPs for erosion and sedimentation control to the
maximum extent practicable.
In addition, the DWR memorandum requested that dewatering and access measures be
discussed in the Categorical Exclusion. While construction access is determined by the
contractor once design is finalized, in general, construction access to the interior bents
and piles or shafts would be obtained by temporary riprap causeway, temporary timber
pile causeway, or floating barge. Dewatering at the vertical abutments would likely not be
required if the abutments are located outside of the lake limits.
The U.S. Army Corps of Engineers (USACE), Lakes Branch, in an April 25, 2017 e-mail,
indicated the project must be evaluated for impacts to the USACE-owned land in the
project area in accordance with the Non-Recreation Outgrant Policy (ER 1130-02-550,
Chapter 17). NCDOT will coordinate with the USACE and submit a Non-Recreation
Outgrant Request prior to final design.

The United States Coast Guard (USCG), in a letter dated April 14, 2017, indicated that a
USCG bridge permit will not be required for the bridge replacement on SR 1442 over
Johnson Creek, and noted that the project will be placed in the Coast Guard Act of 1982
exemption category.
Public Involvement:
A letter was sent to all property owners affected directly by this project. Property owners
were invited to comment but no comments were received.
In addition, a newsletter has been sent to residents living along SR 1442 in the project
study area and along the detour route. Two comments expressing support for the bridge
replacement have been received to date.
Impacts to Waters of the U.S.
The project would result in an estimated 117 linear feet/0.45 acre of permanent impact to
Johnson Creek/Kerr Reservoir resulting from placement of fill in the lake to widen the
causeway and stabilize the embankments. Impact totals are based on functional design
and extend to 10 feet beyond slope stakes. In addition, approximately 0.10 acre of
temporary impacts to Johnson Creek/Kerr Reservoir are anticipated resulting from
construction access. Impact totals will be refined upon final design.
Permits Required:
It is expected the proposed project will require a Section 404 Nationwide Permit No. 23
from the U.S. Army Corps of Engineers. The lake impacts are based on an area 10 feet
outside the slope stakes per the functional design. A Nationwide Permit No. 33 may also
apply for temporary construction activities such as stream dewatering, work bridges, or
temporary causeways that are often used during bridge construction or rehabilitation. The
Corps of Engineers holds the final discretion as to what permit will be required to authorize
project construction. If a Section 404 permit is required, then a Section 401 Water Quality
Certification from the NC Division of Water Resources will also be required.
In addition, the project will require Corps of Engineers approval pursuant to the Non-
Recreation Outgrant Policy (ER 1130-02-550, Chapter 17) for impacts to USACE-owned
land. The Non-Recreation Outgrant Policy requires no net loss of maximum storage
capacity of the reservoir. Therefore, it is anticipated that excavation will be required
somewhere in the reservoir to offset the volume of fill placed in the reservoir in order to
achieve no net loss of maximum storage capacity.

Question 8 – Northern Long-Eared Bat:
Although not listed for Granville County, the US Fish and Wildlife Service has developed
a programmatic biological opinion (PBO) in conjunction with the Federal Highway

Administration, the US Army Corps of Engineers and NCDOT for the northern long-
eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers
the entire NCDOT program in Divisions 1-8, including all NCDOT projects and
activities. The programmatic determination for NLEB for the NCDOT program is May
Affect, Likely to Adversely Affect. The PBO provides incidental take coverage for NLEB
and will ensure compliance with Section 7 of the Endangered Species Act for five years
for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Granville
County.
Question 16 – Floodplains/Floodways:Granville County is a participant in the
National Flood Insurance Regular Program. Johnson Creek is included in a limited
detailed flood study, having a regulated non-encroachment area. The Hydraulics Unit
will coordinate with the Federal Emergency Management Agency (FEMA) to determine
if a Conditional Letter of Map Revision (CLOMR) and a subsequent final Letter of Map
Revision (LOMR) are required for the project. If required, the Division will submit sealed
as-built construction plans to the Hydraulics Unit upon project completion certifying the
project was built as shown on construction plans.
Question 21 – Impact to Federal Lands: The project area impacts John H. Kerr
Reservoir and land immediately adjacent to the Reservoir, which are owned by the U.S.
Army Corps of Engineers. NCDOT will coordinate with the USACE prior to final design,
in accordance with the Non-Recreation Outgrant Policy (ER 1130-02-550, Chapter 17).

2017). The Atlantic pigtoe is not covered in the Programmatic Biological Opinion (PBO) for
Bridge and Culvert Replacement/Repairs/Rehabilitations in Eastern North Carolina,
NCDOT Divisions 1-8 (June 13, 2018). Consultation with the US Fish and Wildlife Service
(USFWS) may be necessary.
The design will remove portions of the existing causeway and require additional permanent
right-of-way (ROW), permanent drainage easement (PDE), and temporary construction
easement from US Army Corps of Engineer (USACE) property at John H. Kerr Lake.
Permanent and temporary easements may impact open water habitat and reservoir
storage. Forest habitat, timber, wetlands, and recreation impacts are not anticipated. A
USACE Non-Recreation Outgrant Request (in accordance with the Non-Recreation
Outgrant Policy (ER 1130-02-550, Chapter 17) for additional permanent ROW, PDE, and
temporary construction easements was submitted to the USACE in March 2019.
A Boater Safety Plan was completed in March 2019 to address on water construction and
safe vessel operation at Bridge No. 143.
D. Conclusion:
The above NEPA/SEPA documentation has been reevaluated (as required by either 23
CFR 771 or by NC General Statute Chapter 113A Article 1). The current proposed action
is essentially the same as the original proposed action. Proposed changes, if any, are
noted below. It has been determined that anticipated social, economic, and environmental
impacts were accurately described in the above referenced document(s) unless noted
otherwise herein. Therefore, the original Administration Action remains valid.
