The proposed development of the subdivision has been designed to avoid impacts to surface waters and wetlands and therefore the DWR has no comment. Their application did not highlight many current or future creek, wetland, or AEC impacts. Phase I is stand alone. If they come back with concerning impacts for other development, I will comment then. I did not delve into the stormwater treatment design and do not normally unless it is really ridiculous. It was not submitted express, so it is being processed out of WiRO if you would like them to know any information. Stormwater generally gets a thorough review. I understand the concern about a system that functions as a PNA but is not designated. I have stated concerns for similar situations in the past. However, I do not think my comments would have been significantly different now than before. I would likely have stated some general concerns but would not have gone with a denial. Based on comments that I received from Jud Kenworthy (attached), I'm leaning towards recommending denial until they can demonstrate that there will be no impact to public trust/estuarine waters (as stated in the application). There's a lot of other issues with it, primarily related to stormwater issues. I wanted to touch base with you both to find out where you were in your process with that application and any potential comments you're planning on submitting. Any feedback is greatly appreciated.
