The NOV letter identifies the SSO with a notice of intent to enforce and allows Cary the opportunity to provide evidence or justification within 10 business days from receipt of the letter to address the cause of non-compliance, remedial actions, and actions to prevent SSO recurrence. Cary wastewater collection system staff took immediate action to stop the overflow. Wastewater flowed from the manhole ring and cover base into an unnamed tributary of Black Creek. The Sewer Spill Estimation Guide provided on the NCDEQ website along with site conditions were used to estimate the total amount of sewer spilled reaching the creek. Spill volume estimates were based on the distance the sewer traveled along with average creek widths and depths observed at the time of the spill. Cary staff used a hydraulic sewer jetting machine to clear the blockage and stop the sewer overflow at 1:50 PM. The SSO cause was a 4-inch PVC sanitary tee plumbing fitting found lodged in the 8-inch gravity sewer line that allowed sanitary wipes and debris to accumulate leading to the blockage. The sanitary tee was from a 4-inch service lateral manhole connection. We believe that this sanitary tee was unintentionally knocked off by a plumbing contractor while servicing a private service lateral blockage. CCTV image gfblockage caused by tee 4-inch tee removed, from sewer line Following the October 27, 2022, sewer spill, Cary staff inspected upstream manholes and video inspected the sewer lines to ensure there was no additional debris or blockages in the sewer lines where the blockage occurred. Sewer Spill Cleanup — After stopping the SSO, Cary staff immediately began cleaning up the spill. A temporary dam was constructed in two locations. One dam was installed approximately 500 feet downstream of the overflowing manhole and a second dam was installed approximately 7,800 feet downstream in Black Creek beyond where the sewer spill traveled. A pump was installed at the first dam closest to the manhole that spilled where the majority of material from the spill was pumped back into the sewer system for disposal and treatment. A jet truck water tank was used with dechlorinated water to flush and wash down the area of the spill and the first 500 feet of creek. A pump was installed at the second dam approximately 7,800 feet downstream in Black Creek. 381,400 gallons of dechlorinated water was used to flush the creek. Cary staff walked the creek and assured good stream flow to remove any accumulated wastewater. The creek was flushed for approximately 27 hours, the water and contents in the creek were pumped to the sanitary sewer for disposal and treatment. During the creek cleaning operation the pumping system had a backup of approximately 750 gallons of cleanup water at the cleanup site, but was contained and pumped to the sewer system for disposal. NCDEQ Regional Staff were contacted, and the 750 gallons of cleanup water was reported and determined to be associated with the initial stream cleanup efforts. This is the only sewer spill that has occurred in this location of the sewer system. After clearing the blockage, the area sewer lines were video inspected (1,800 feet video inspected) to ensure there was no additional accumulation or partial sewer line blockages. Sixty-two manholes upstream of the blockage were inspected, and the manhole (SP76411005) was identified where the 4-inch PVC sanitary tee was knocked off inside the manhole. There is a substantial history of inspections associated with this area of the sewer system and prior to the SSO and includes: September 1, 2022 Sewer easement inspection, including the sewer line segment and manhole that overflowed with no issues or problems noted. June 23, 2022 Manhole inspection associated with a planned sewer odor testing event. No issues were noted during the sewer odor testing. December 21, 2021 Performed sewer line acoustic testing with no issues noted with blockages or obstructions in the sewer lines. May 4, 2021 Sewer grid hydraulicly cleaned and jetted with no issues noted. Enforcement Actions — We request NCDEQ to consider that this unfortunate sewer spill was unexpected and caused by a private service line cleaning that Cary was unaware occurred and that lead to the 4-inch sanitary tee plumbing fitting being knocked into the sewer system causing the blockage and overflow. Cary believes that this situation was beyond the reasonable control and operation of the collection system. Cary responded in an expedited manner to quickly stop the SSO and immediately initiated cleanup efforts to minimize the impact of the sewer spill. When 15,000 gallons or more of untreated wastewater enters surface waters, a public notice shall be published within 10 days and proof of publication shall be provided to the Division within 30 days. The Director, Division of Water Resources, may take enforcement action for SSOs that are required to be reported to Division unless it is demonstrated that: 1) the discharge was cause by sever natural conditions and there were no feasible alternative to the discharge; or 2) the discharge was exceptional, unintentional, temporary and caused by factors beyond the reasonable control of the Permittee and/or owner, and the discharge could not have been prevented by the exercise of reasonable control. Comments: The debris issue was a result of a plumbing fitting that found its way into the sewer line allowing debris to accumulate. W do not suspect we received excessive sanitary wipes or paper debris. The lodged plumbing fitting was the root cause of 1 back-up. The sewer line blockage was cleared using a hydraulic let truck. Once the blockage was cleared the spill stopped and a vacuum truck was used to remove the accumulated sanitary wipes and paper debris. The hydraulic let dislodged the sanitary tee plumbing fitting, and it was removed from the sewer line. The sewer spill was cleaned up by picking up any solid debris. A temporary dam was installed on the creek below where the sewer spill flowed, and pumps were used to pump the wastewater and clean up water back to the sewer system for disposal and treatment. Dechlorinated water was used to flush and clean the creek to the dam and pumped to the sewer system for disposal. Staff walked the creek and lightly raked areas to ensure the spill was flushed from the creek. 381,400 gallons of dechlorinated potable water was use to flush and clean approximately 7,000 feet of creek affected by the sewer spill. 5 fish were collected following the spill an creek clean up. During the cleanup of the creek, the pumping system had a 750-gallon backup at the cleanup site but we: contained and pumped to the sewer system with the cleanup. Powdered activated lime was applied and raked in around the manhole that spilled to treat the soil.
