In researching the FRO files, I didn't find executed setback waivers for the two fields in question; SF09-01 or SF09-02 as
footnoted in the Attachment B for permit WQ0014868. I do know from past site visits that EMA does direct injection
when land applying on these two fields because of setback issues to homes along Barker Ten Mile Rd and NC Hwy 20
and property line configurations. If the 400' buffer was instituted to the residences verses the 200' buffer with injection;
both fields would be marginal for land application, hence EMA utilizing the injection method.l
I would propose changing the language in both footnotes to address the need for executed setback waivers if injection is
not utilized or provide updated buffer maps with the necessary 400' buffer to address the language of " regardless -Of
whether a surface application method".
I don't recall the reason for the language in the Attachment Bin the 22July 2014 permit. I'm providing a copy of the
Attachment B issued 15 Sept. 2008 that was done by the Fayetteville Regional Office that addresses the 200' buffer for
injection. Hopefully a copy of this modification is in the central(file.

There were footnotes on setback waivers in the2014 permit, but I can't find any signed setback agreements in the
file. Do you have copies of these? My inclination is to remove them if I don't have copies of them.
Also, on five properties, the ownership has changed since 2014. I am putting a note that before residuals can be placed
on these fields, there has to be a new Land Owner Agreement in place. As you point out, this is up for renewal soon and
this will not force them to spend time putting new LOAs in place, but notify them they will have to do it if they want to
keep the land in the permit in the future or replace it.
