A project is under construction that will increase the capacity at the Landfill EQ & Pumping Facility to a firm capcity of 8.75 MGD with 5.1 MG in storage. That project is expected to be complete before the enough paper flow is converted to actual flow to reach the capcity of the station. Therefore: Given reasonably expected conditions and planning information, there is sufficient justification to allow this flow to be permitted, without a significant likelihood of over -allocating capacity in the system infrastructure. I understand that this does not relieve the collection system owner from complying with G.S. 143- 215.67(a) which prohibits the introduction of any waste in excess of the capacity of the waste disposal system. Winston Pointe is a Master Planned community where Carolina Water Service is the provider of the utilities for the community. W-354, SUB 305 BEFORE THE NORTH CAROLINA UTILITIES COMMISSION In the Matter of Notification of Intent by Carolina Water Service, Inc. of North Carolina, Post Office Box 240908, Charlotte, North Carolina 213224, to Begin Operations in an Area Contiguous to Present Service Area Providing Water and Sewer Utility Service in Winston Pointe Subdivision, Phase 1 B, in Johnston County, North Carolina, and for Approval of Rates ORDER RECOGNIZING CONTIGUOUS EXTENSION AND APPROVING RATES BY THE COMMISSION: On January 24, 2007, Carolina Water Service, Inc of North Carolina (CWS or Applicant), filed an application notifying the Commission of its intent to begin operations in an area contiguous to a present service area and for approval of rates. The Applicant desires to expand water and sewer utility service into Winston Pointe Subdivision, Phase 1 B, which is contiguous to the Applicant's existing Winston Pointe Subdivision, Phase 1 A, service area in Johnston County, North Carolina. The Applicant's proposed rates are the same as currently approved in its other franchised service areas. On July 21, 2009, the Applicant filed a revised notification and exhibits replacing its January 24, 2007, and June 30, 2009, filings. The Applicant states that it is presently serving 44 customers and that no other person or utility seeks to provide the service proposed. The Applicant expects eventually to serve 119 residential customers in Winston Pointe Subdivision, Phase 1 B. On the basis of the verified notification and the records of the Commission, the Commission makes the following FINDINGS OF FACT 1. CWS holds approximately 81 water and 38 sewer utility franchises in North Carolina, serving approximately 20,820 water and 14,510 sewer customers CWS's record of service is satisfactory. 2. The service area covered is the area shown on the plans attached to the application as Exhibit 7. CWS states that it is already serving 44 customers in Winston Pointe Subdivision, Phase 1 B. CWS expects to eventually serve 119 residential customers in this subdivision. 3. The Public Staff has recommended that CWS be required to post a $20,000 bond for Winston Pointe Subdivision, Phase 1 B. CWS currently has $1,550,000 of bonds posted with the Commission. Of this amount, $1,435,000 of bond surety is assigned to specific subdivisions and $115,000 of bond surety is unassigned. 4. CWS has the technical, managerial, and financial capacity to provide water and sewer utility service in this contiguous extension. 5. The Applicant has filed all exhibits required with the notification. 6. The NC Division of Environmental Health has issued a plan approval letter in Winston Pointe Subdivision, Phase 1 B, for 8-inch, 6-inch, and 4-inch water mains to connect to the Winston Pointe Subdivision, Phase 1A, service area water system. The plans are approved under serial number 07-00113, dated February 22, 2007. 7. The NC Division of Water Quality has issued plan approval letters in Winston Pointe Subdivision, Phase 1 B, for 8-inch gravity mains that will tie into the existing sewer collection system of the Winston Pointe Subdivision, Phase 1A, service area. The plans are approved under Permit Nos. WQ0031158 and WQ0031298, both dated February 8, 2007. The sewer system is approved for 119 connections (45 74 connections). 8. CWS has entered into a Water & Sewer System Service Agreement with the developers, Solaris Development Corporation, d/b/a Sunstar Homes, and Develco, LLC, dated April 15, 1996. This Agreement was amended on April 15, 1996, March 16, 1998, and December 13, 2000. On August 21, 2002, in Docket No. W-354, Sub 160, the Public Staff and CWSNC filed a joint stipulation agreeing to a water connection fee of $500 and a sewer connection fee of $2,000 that applies to all customers in Winston Pointe Subdivision, Phase 1A, and future phases of Winston Pointe Subdivision. Based upon the foregoing, the Commission is of the opinion that $20,000 of the Applicant's unassigned bond surety should be assigned to Winston Pointe Subdivision, Phase 1 B; that the notification to provide water and sewer utility service in Winston Pointe Subdivision, Phase 1 B, meets the criteria for contiguous expansion; and that the requested rates should be approved. IT IS, THEREFORE, ORDERED as follows: 1. That $20,000 of the $115,000 unassigned bond surety shall be assigned to Winston Pointe Subdivision, Phase 1 B.
