Sullins, Director Division of Water Quality The purpose of this letter is to inform you and other interested parties, that the Director of the Division of Water Quality has decided to hold a public hearing for the purpose of reviewing public comment and additional information for the proposed Dillsboro dam removal project in Jackson County in accordance with 15A NCAC 2H .0504. DWQ staff are working to locate an appropriate, nearby place for the hearing and we will inform you of the place and time of the hearing once those details are determined. We plan to hold one public hearing and will announce the details of that hearing in local papers and to our 401 Certification mailing list as well as our listserve once those details have been determined. As you know, this decision of the Director effectively places this project on hold although staff will continue to review the application. The public notice must be posted in a local paper at least 30 days before the date of the hearing and the hearing record will remain open for an additional 30 days after the hearing. Therefore, our 60 day clock for completing review of your application will restart from the day of the hearing. The activity for this Certification is sought to remove the Dillsboro dam and powerhouse in Jackson County in accordance with a Federal Energy Commission (FERC) license. The application for the project includes plans to dredge the sand behind the dam, stabilize locations where vegetation is removed during the dredging as well as water quality and biotic monitoring during the dredging and dam removal process. The public is hereby notified that that the Division of Water Quality will hold a public hearing on September 25, 2007at Western Carolina University starting at 6 p.m. at the Ramsey Center in Cullowhee, North Carolina. The public is invited to comment in writing on the above-mentioned application as well as during the Public Hearing. Speaking times will likely be limited to 3 minutes maximum per speaker, with the final time limit to be determined on the day of the hearing depending upon the number of speaking slots requested. Those wanting to speak need to register at the hearing and speaking sequence will be in order of registration. Written comments may be forwarded at any time before or after the hearing provided they are received by the Division no later than October 26, 2007 (30 days after the date of the hearing). Comments should be sent to the N.C. Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center, Raleigh, NC, 27699-1650, Attn: John Dorney (919-733-9646, FAX: 919-733-6893).
