Hello John Dorney,
I'm with The Sylva Herald newspaper, and I'm a little confused about some of the
details surrounding Duke Energy's Western North Carolina relicensing applications.
This newspaper wrote in May 2005 that "the N.C. Division of Water Quality issued a
certificate approving the removal of Dillsboro Dam." In addition, through the years
of the relicensing talks and stakeholders' meeting NCDWQ seems to have been a
consistent supporter of Duke's plans to remove the dam.
What I've gleaned from various sources seems to be that NCDWQ issued a previous 401
WQC and that now another approval certifying that Duke has met all the conditions of
the first one must be issued before dam removal can proceed. Is that right?
Also, given NCDWQ's participation in the Stakeholders' process and support of dam
removal, is there a possibility that such approval would not be forthcoming?
There is also now discussion of dredging behind the dam, something that Duke
opponents have long asked for but that was not made part of the Stakeholders
Agreement that NCDWQ approved. How does this change the various approvals Duke must
secure?
Did the state change its position and stipulate that Duke must perform some
dredging?
