Director NORTH CAROLINA Environmental Quality December 15, 2022 Shawn Wilkerson DWR Project #: 2018-0196v2 Wildlands Holdings V, LLC Durham County (via electronic mail: swilkerson&wildlandseng.com ) Re: Catfish Pond II Mitigation Banking Instrument (MBI) Catfish Pond II Bank Parcel Credit Release — Task 7 Dear Mr. Wilkerson: On November 16, 2022, the Division of Water Resources (DWR) received notification and supporting documentation from Wildlands Holdings V, LLC (Wildlands) that the conservation easement for the Catfish Pond II site has been successfully assigned to Unique Places to Save (UPS). UPS is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this mitigation bank. In accordance with the MBI, signed on September 14, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 7) Item B (1) of Section X in the MBI has been completed and approved by DWR 5% (conservation easement assignment) By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and therefore the following credits are being released: • 5% of the Neuse buffer Restoration credits (0.05 x 342,834 ft2 = 17,141.700 ft2) are available to sell. • 5% of the Neuse buffer Enhancement via Cattle Exclusion credits (0.05 x 52,041.411 ft2 = 2,602.071 ft2) are now available to sell. • 5% of the Nitrogen nutrient offset credits (0.05 x 43,287.706 lb-N = 2,164.385 lb-N) are now available to sell. • 5% of the Phosphorus nutrient offset credits (0.05 x 2,788.063 lb-P = 139.403 lb-P) are now available to sell. Additionally, the riparian buffer credits must be used for authorized impacts in the Neuse River Basin according to guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
